PUBLIC POWER COUNCIL, et al., Intervenor-Defendants, Intervenor-Defendant State of Idaho respectfully gives notice of case authority relevant to the first question under Part I.B of this Court's Order dated September 23, 2004. 1. Bowen v. Hood, 202 F.3d 1211, 1219 (9th Cir. 2000) ("It is clear enough that the Bureau could not go on construing the phrase 'nonviolent offense' in a manner contrary to our prior rulings.... But the Bureau did not do that at all. Once it was foreclosed from a simple interpretation of the statute, it, instead, exercised the discretion that Congress indisputably conferred upon the Director and reached the same conclusion on an entirely different ground. It can hardly be doubted that 'an agency is free on remand to reach the same result by applying a different rationale.' Arizona Electric Power Cooperative, Inc. v. United States, 816 F.2d 1366, 1373 (9th Cir. 1987). Our prior decisions could have 'held no more and no less than that the [Bureau's] first [position] was unsupportable for the reasons supplied by that agency.' SEC v. Chenery Co., 332 U.S. 194, 200, 67 S. Ct. 1575, 1579, 91 L. Ed. 1995 (1947). Here, the Bureau relied on an entirely different part of the statute for its decision. U.S. Parole Comm'n, 981 F.2d 97, 105 (3d Cir. 1992) ("[L]egal error in an agency decision does not prevent the agency from expanding its record and rethinking its original order. [ ] A corollary to this tenet of administrative law is that the appropriate judicial remedy when an agency exceeds its discretion is a remand to the agency for further proceedings consistent with the court's opinion. See Federal Power Comm. v. Idaho Power Co., 344 U.S. 17, 20, 73 S. Ct. 85, 87, 97 L. Ed. 15 (1952). United States, 574 F.2d 926, 930 (7th Cir. 1978) (although agencies are bound by law-of-the-case principles, "[t]he administrative tribunal is free on remand to reach the same result on different grounds").
