Department of Public Health and Human Services FAMILY RELATED MEDICAID Section: FOSTER CARE MEDICAID Subject: Therapeutic Foster Care and Group Supersedes:, 05/01/99 References: 42 CFR 435.145;.222(b)(1);.308(b)(1); &.403(g); ARM 37.82.101,.205 GENERAL RULE--Therapeutic Foster Care and Therapeutic Group are less restrictive settings than residential treatment in which children receive Medicaid covered mental health services. Children placed in Therapeutic Foster Care or Therapeutic Group for medical treatment are not absent from the home but are out of the home receiving medical treatment. Placement for medical services could be the same process as placement for residential treatment. NOTE: Do not terminate Medicaid eligibility unless the child has also been placed under the supervision and control of the State of Montana, a private nonprofit child care agency, private child care institution, BIA or Tribes. If the child has been placed with one of these entities, the CFS IV-E unit will review for foster care Medicaid eligibility.
