6 Trading Application Form Page 6 of 6 TERMS AND CONDITIONS OF TRADE All invoices are due for settlement in full within 30 days of the invoice date, unless otherwise specified on the invoice. RLR Distribution Ltd. reserves the right to request payment in advance at its own discretion or payment by return. RLR Distribution Ltd. reserves the right to charge interest on a daily basis and without deduction of tax at a rate of 2% per calendar month on any amount outstanding beyond its due date. The Company further reserves the right to suspend delivery to a customer where any invoice has not been paid by its due date. RLR Distribution Ltd. reserves the right to include reasonable legal and collection fees in addition to any balance owed, should it be necessary to take action to collect any debt due. Notwithstanding delivery and the passing of risk in the goods, title and property in the goods, including full legal and beneficial ownership, shall not pass to the customer until RLR Distribution Ltd has received in cash or cleared funds payment in full for all goods delivered to the buyer under this and all other contracts between the buyer and RLR Distribution Ltd for which payment of the full price of the goods there under has not been paid. All delivery of goods as specified in the Company s sales order and or invoice will be deemed to have been received and accepted by the purchaser unless notification of non delivery or fault is received by the company within 2 working days of the invoice date. No liability is accepted for loss arising from any delay in despatch or delivery however caused. RLR Distribution Ltd. shall not be liable for any loss, injury or damage whatsoever direct or indirect, arising out of any defect in the goods sold, unless such loss, injury or damage is caused by the negligence, act or omission or wilful default of the Company. Any addition to, or variation from these conditions shall not be deemed to be a waiver of its rights and remedies of any subsequent default by the customer in the performance or compliance with any of the terms or conditions The invalidity of any individual provisions of these conditions shall not affect the validity of the remaining provisions. The Terms and Conditions of Trade shall in all respects be governed and construed in accordance with English Law. WARRANTY The following outlines our Warranty and Returns policies. CABLES AND LEADS: 90 DAYS. ACCESSORIES (NON MOVING PARTS): 90 DAYS. I.E. Memory Cards, Gamehunters, DVD remotes, stands, multi taps, expansion packs, light/magnifiers, power adaptors etc. ACCESSORIES (MOVING PARTS): 45 DAYS. I.E. Joypads, Steering wheels, Laser units, Light guns, etc. HARDWARE (IMPORT): 120 DAYS. I.E. Playstation 2 JAP/US, Dreamcast JAP/US, Gamecube JAP/US, X box JAP/US. HARDWARE (UK/PAL): 1 YEAR MANUFACTURERS WARRANTY. Return to manufacturer. IMPORT GAMES: 45 DAYS. Please note, warranty is only given on games not sealed at manufacture, or not sealed upon delivery. PAL/UK SOFTWARE: 45 DAYS. We only except returns authorised by staff at RLR Distribution Ltd. Any returns sent back without prior notification will note be accepted and returned to the sender. Please send for the attention of the Returns Department, with a list of all faulty items on company headed paper and a small explanation as to why they have been returned. All credit notes will be produced within 28 days of receipt of goods. Data Protection RLR Distribution LTD will hold information on you/your company only when it is relevant to our current or potential trading relationship. This information will be used where necessary to enable us to service your requirements including the provision of relevant (optional) marketing communications. The information held will be updated at the time changes are identified or discovered. Relevant information will only be shared with third parties when they are appointed by us to carry out duties in relation to our business.
