What Does Probation Mean? In cases where the Commission has reason to believe that a school is not in compliance with accreditation standards and other requirements, the Commission may, at its discretion, place a school on Probation. A school subject to a Probation Order will be required to demonstrate corrective action and compliance with accrediting standards. The Commission may require a school to submit Commission-directed reports and receive on-site evaluation teams in conjunction with a Probation Order. Failure to demonstrate compliance with accrediting standards or other accrediting requirements by the end of the probationary period may result in the school being removed from the accredited list. When a Probation Order is directed, a written notice is sent promptly to the school. The notice: States fully the reasons why the Probation Order was issued; Identifies the standard and other accreditation requirements with which the school may not be in compliance; Explains the reasons and cite the evidence indicating that the school may not be in compliance with accreditation requirements; and Advises the school of its obligations under the Probation Order and the deadline for response. ACCSC s Rules of Process and Procedure require a school subject to a Probation Order to inform current and prospective students that the school has been placed on Probation and that additional information regarding that action can be obtained from the Commission s website 2. A summary of the Probation Order is made public via the Commission s website in accordance with Section VII (L)(7), Rules of Process and Procedure, Standards of Accreditation. 2
3 Page 3 of 9 ORIGINATION DATE: JUNE 6, 2012 CONTINUED PROBATION DATE: DECEMBER 18, 2012 ARIZONA AUTOMOTIVE INSTITUTE 6829 N 46TH AVENUE PHOENIX, AZ SCHOOL # At its November 2012 meeting, the Commission considered its previous decision to place on Probation Arizona Automotive Institute ( AAI-Phoenix ) located in Phoenix, Arizona. Upon review of the June 6, 2012 Probation Order and the school s response, the Commission voted to Continue the Probation Order for AAI-Phoenix to May A summary of the grounds for the Commission s decision are set forth below. 1. AAI-Phoenix must demonstrate that its financial structure is sound, with resources sufficient for the proper operation of the schools and the discharge of obligations to its students (Section I (C), Substantive Standards, Standards of 2. AAI-Phoenix must demonstrate that there is adequate management and sufficient administrative resources at the corporate level and at the campus level to ensure that AAI-Phoenix is capable of meeting the school s objectives, fulfilling obligations to students, and operating in compliance with accrediting standards (Section I, Statement of Purpose, Substantive Standards, Standards of 3. AAI-Phoenix must demonstrate that an acceptable percentage of students successfully complete their program of study and obtain employment in the field for which training was provided (Section VII, Statement of Purpose, Substantive Standards, Standards of 4. AAI-Phoenix must demonstrate that the Commission can place a high level of reliance upon information, data, and statements provided by the school, through supplying verifiable records of graduate initial employment (Preamble, Introduction, Rules of Process and Procedure; Section VI (C)(3), Substantive Standards, Standards of 5. AAI-Phoenix must demonstrate compliance with application requirements set forth in law and regulation (Section I (D)(2)(d), Substantive Standards, Standards of The Commission became aware of an unsealed lawsuit filed against ATI by the United States of American and Qui Tam Plaintiffs (Civil Action No.: 3:09-CV-1313-G) in which the Plaintiffs allege, among other things, that ATI made false statements and claims as a means to operate and garner access to funding sources and engaged in a widespread scheme to defraud the Department of Education and the Texas Workforce Commission. The Commission reviewed the complaint as well as ATI s narrative regarding the history of the matter, and the description of ATI s position relative to the allegations. At this time, the Commission requests that ATI and AAI-Phoenix provide a narrative update with regard to the status of this action.

ATI Enterprises, Inc. submitted a Notice of Closure for the above-listed ATI-Branded campuses. According to the Notice of Closure, ATI has initiated the process of securing teach-out agreements with other institutions. In light of this notification, the Commission voted to Continue the Probation Order, in accordance with the previous June 6, 2012 Probation Order, for the above schools through the closure date identified in the Notice of Closure and as approved via the Commission s teach-out processes. A summary of the ground for Probation set forth in the June 6, 2012 Probation Order follow: 1. Financial Soundness: Demonstrate financial soundness with resources sufficient for the proper operation of the schools and discharge of obligations to students (Section I (C)(1), Substantive Standards, Standards of 2. Integrity of Employment Records: Demonstrate that the Commission can place a high level of reliance upon information, data, and statements provided by the ATI system of schools, which is fundamental to the accreditation process, through supplying verifiable records of graduate initial employment that supports reported employment rates (Preamble, Introduction, Rules of Process and Procedure; Section VI (C)(3), Substantive Standards, Standards of 3. Student Achievement: Demonstrate that an acceptable proportion of students successfully progress through and complete their program of study and obtain employment in the field for which trained (Section VII, Statement of Purpose & (B),Substantive Standards, Standards of 4. Management and Administration: Demonstrate that there is adequate management and sufficient administrative resources to ensure that each school is capable of meeting the school s objectives, fulfilling obligations to students, and operating in compliance with accrediting standards (Section I, Statement of Purpose, Substantive Standards, Standards of 3 South Texas Vocational Technical Institute is a branch campus of the main school ATI Career Training Center, North Richland, Hills, TX and its accreditation is dependent on its main school s continued accreditation.
5 Page 5 of 9 S ORIGINATION DATE: MARCH 7, 2012 CONTINUED PROBATION DATE: SEPTEMBER 7, 2012 PERFORMANCE TRAINING INSITUTE 1012 COX CRO ROAD TOMS RIVER, NEW JERSEY SCHOOL #M Performance Training Institute located in Toms River, New Jersey has been placed on Continued Probation by the Accrediting Commission of Career Schools and Colleges for the reasons summarized below. The Probation Order and the school s response will be reviewed by the Commission at its February 2013 Meeting. 1. Performance Training Institute must demonstrate that the school has the appropriate administrative capacity and infrastructure necessary to provide oversight and management of all staff and operations that fall under the scope of ACCSC accreditation (Section I (A)(1) Substantive Standards, Standards of Performance Training Institute management must also demonstrate that the school has not undergone changes that have been so substantial such that the school to which the Commission granted accreditation has ceased to operate (Section IV (D)(9) Rules of Process and Procedure, Standards of 2. Performance Training Institute must demonstrate that the school s program offerings prepare students for entrance or advancement in an occupation and that the educational objectives of each program offered by the school provides graduates with the necessary competencies, skills, and level of education for employment in their fields of study (Section I (B)(1)(d)(i) Rules of Process and Procedure). In addition Performance Training Institute must demonstrate successful student achievement by reporting acceptable rates of student graduation and employment and by supporting these rates through student transcripts, the school s verifiable records of initial employment of its graduates, or other verifiable documentation (Section VII (B)(1), Substantive Standards, Standards of 3. Performance Training Institute must demonstrate compliance with all applicable federal, state, and local government requirements (Section I (D)(2)(d), Rules of Process and Procedure, Standards of

The Commission will review the Probation Order and the school s response at its February 2013 meeting. 1. Prism Career Institute must demonstrate that the financial structure of the school is and can remain sound with resources sufficient for the proper operation of the school and the discharge of obligations to its students (Section I (C)(1), Substantive Standards, Standards of 2. Prism Career Institute must demonstrate that the school has adequate management and administrative capacity in place and that the continuity of management and administrative capacity is ensured through the reasonable retention of management and administrative staff (Section I (A)(1) & I (A)(4), Substantive Standards, Standards of Prism Career Institute must demonstrate that each member of the school s management is qualified to fill their respective management role and has a past record of integrity that would ensure compliance with accrediting standards (Section I (A)(2) & I (B)(1)(b), Substantive Standards, Standards of 3. Prism Career Institute must demonstrate compliance with accrediting standards with regard to Program Advisory Committees (Section II (A)(5), Substantive Standards, Standards of 4. Prism Career Institute must demonstrate successful student achievement by maintaining acceptable rates of student graduation and employment in the career field for which the school provided education and support these rates through the school s verifiable records of initial employment of its graduates (Section VII (B)(1)(b), Appendices VII, Substantive Standards, Standards of 5. Prism Career Institute must demonstrate institutional assessment and improvement goal setting, benchmarking and implementation activities appropriate to the size and scale of the school s operations (Section I (B)(2), Substantive Standards, Standards of 6. Prism Career Institute must provide further documentation to demonstrate that the school maintains written policies and procedures addressing student services (Section VI (A), Substantive Standards; Standards of

COMMERCIAL STREET SPRINGFIELD, MO SCHOOL #M The Accrediting Commission of Career Schools and Colleges (ACCSC) placed Professional Massage Training Center located in Springfield, Missouri on Probation for the reasons summarized below. After a March 7, 2012 Commission Decision revoking accreditation based upon the grounds for probation stated in the December 7, 2011 probation order and a July 11, 2012 Appeals Panel Decision upholding the Commission, PMTC filed an action in the U.S. District Court for the Eastern District of Virginia. On September 17, 1012, PMTC obtained a Preliminary Injunction directing the Commission to withdraw the Commission and Appeals Panel decisions, to reinstate PMTC s accreditation, and to refrain from taking further action against PMTC for the duration of the action. On September 19, 2012 ACCSC reinstated PMTC s accreditation subject to the Probation Order dated December 7, Under the terms of the Court Order, PMTC s probation will not be subject to the normal procedures and ACCSC will take no further actions against PMTC, nor will it request any further action, information or submission from PMTC, under the Probation Order, during the pendency of the Action. 1. Professional Massage Training Center must demonstrate that the school maintains full-time on-site supervision by an individual or team that has the demonstrated ability to lead and manage the institution (Section I (A)(1), Substantive Standards, Standards of Accreditation), must demonstrate that the school maintains appropriate administrative and operational policies and procedures to which the school adheres and reviews and updates as needed (Section I (A)(1)(d), Substantive Standards, Standards of Accreditation), must demonstrate that the school ensures that members of school management and administrative employees participate in ongoing development and training activities that support their particular roles in the school (Section I (A)(3), Substantive Standards, Standards of Accreditation), and must demonstrate that institutional assessment and improvement activities are significant and ongoing experiences at the school (Section I (B)(2), Substantive Standards, Standards of 2. Professional Massage Training Center must demonstrate that the continuity of management and administrative capacity is ensured through the reasonable retention of management and administrative staff (Section I (A)(4), Substantive Standards, Standards of 3. Professional Massage Training Center must demonstrate that the school s learning resource system is managed by qualified school personnel with sufficient experience to provide oversight and supervision (Section II (A)(6)(c), Substantive Standards, Standards of Accreditation), and must demonstrate that use of the learning resource system materials are integrated into the school s curriculum and program requirements as a mechanism to enhance the educational process and to facilitate positive learning outcomes for students (Section II (A)(6)(b), Substantive Standards, Standards of 4. Professional Massage Training Center must demonstrate that the school s faculty have a minimum of three years of related practical work experience in the subject area(s) taught (Section III (B)(5), Substantive Standards, Standards of Accreditation), and must demonstrate that the school verifies prior work experience and maintains documentation of academic credentials of all faculty members and administrators, as required, to demonstrate compliance with applicable Standards of Accreditation (Section III (A)(4), Substantive Standards, Standards of

The Commission will review the Probation Order and the school s response at its May 2013 meeting. 1. Westech must demonstrate that a fair and equitable refund policy is applied in accordance with the school s established refund policy (Section I (D)(5), Substantive Standards, Standards of 2.
