(100%) It is noted for the record that the Commission originally considered the institution s application for reaccreditation at its August 2015 meeting. After reviewing the on-site visit team reports (visits conducted May 12-13, 14-15, 18-19, 19-20, 21-22, and 27-28, 2015, and June 10-11, 16-17, 22-23, and 24-25, 2015), and the institution s responses to those reports, received June 19 and June 29, 2015, and July 1, 6, 7, 14, 16, 20, 21, 22, and 24, 2015, the Commission voted to defer further consideration pending review of an interim report at the December 2015 meeting, which resulted in an additional deferral and the issuance of an Institutional Show Cause directive requiring the institution to show cause why the institution s accredited status should not be withdrawn due to the institution s continued failure to demonstrate full compliance with ACCET standards and policies, including those pertaining to financial procedures, performance measurements, and student progress. The Commission further directed the institution to submit an interim report to include the following: 1) a narrative update with supporting documentation for all campuses demonstrating staff training, supervisory reviews, and internal audits to ensure that enrollment agreements are complete and accurate, that refund policies are consistent with ACCET standards, and that the institution s revised enrollment, cancellation and refund policies are systematically and effectively implemented; 2) a narrative update with supporting documentation for the New York, Austin, Chicago, San Francisco, and Beverly Hills branches demonstrating effective staff training, implementation, and utilization of the institution s new speaking proficiency exit exam; 3) a narrative update with supporting documentation for the Austin, Raleigh, Chicago, San Francisco, and Beverly Hills branches demonstrating the systematic and effective implementation of the Rules and Regulations and the regular production of progress reports for all F-1 students and the use of individual learning plans for all F-1 students who repeat a level more than once. Upon its review, the Commission voted to grant reaccreditation and to vacate the Show Cause directive based on the institution s substantive response to the interim report. Therefore, the Commission expresses its confidence that the institution will continue to review, monitor, and enhance its operations to assure the high quality of education and training toward which we all strive. Toward that end, the Commission directed the institution to provide an additional interim report as follows:

5 Page 3 of 5 1) In its response, the institution provided an amended enrollment agreement, evidence of training, and requested refund samples which appeared to be generally compliant with ACCET cancellation and refund policy. However, the institution continues to utilize a refund policy based on calendar time. Berlitz s 2016 Enrollment Policy includes the following language: It is mandatory to accurately determine and fill in the expiration date for all enrollments. All programs have defined consumption periods. It is the salesperson s responsibility to calculate the expiration date, and clearly inform the students of the policy and the date. This should occur at time of enrollment, and be explained during the orientation of the first day of class. It is required to remind students throughout their program of the expiration date. However, as noted in the institution s response to the interim report, the option to reschedule is greatly valued by students, and it is common practice at the institution that students do not have a fixed calendar schedule. The institution provided a rationale for using calendar time, and Welcome Kit information which advises students on the academic benefits of keeping to schedule in their studies, but did not submit documentation to demonstrate that the institution clearly and directly communicates with students to explain how the calendar time is applied to refund calculations. The Commission noted that this calendar-time policy is only acceptable for enrollments of less than 300 clock hours, and only for programs other than English. The institution must ensure that its policy complies with the requirements of ACCET Document 31 for foreign language enrollments of 300 clock hours or more and ACCET Document 31.ESL for English Language programs. In addition, the institution did not provide evidence that cancellation and refund policy and procedures have been revised to specifically reference that all refunds must be made within 45 days of the date of determination. Therefore, the institution must provide a narrative update, with supporting documentation, evidencing a revised cancellation and refund policy, enrollment agreement, and Welcome Kit information to demonstrate that students are clearly and directly advised of the institution s use of calendar time for the purpose of refund calculations for foreign language programs of less than 300 clock hours for students who withdraw from the programs. In addition, the institution must provide a narrative update, with supporting documentation, to evidence a revised refund and cancellation policy that is compliant with ACCET Documents 31 and 31.ESL and ensures that all refunds are processed within 45 days of the date of determination, as well as evidence of staff training to ensure that the revised policy is systematically and effectively implemented throughout the institution. 2) The institution has seven (7) programs approved by ACCET: Berlitz Jr.; Berlitz Virtual Classroom; Charter (Group); Private Instruction; Semi-Private; Small Group; and Total Immersion. All programs are recorded with ACCET as having variable hours. However, in the case of international students who are F-1 visa holders, the institution s students must study a minimum of 18 hours a week. While the team reports indicate that F1 students are enrolled in fulltime study by studying for a minimum of 18 hours a week in one of the institution s approved programs, it is unclear as to how the institution structures its Intensive English Program (IEP).

6 Page 4 of 5 Therefore, the institution is directed to provide a narrative update, with supporting documentation, to include a description of hours per week, weeks per level, and the number of levels for each intensive English program in which students are enrolled. A copy of this report, including the attached interim report cover sheet, must be mailed to interimreports@accet.org no later than June 24, 2016, in order for the institution s application for reaccreditation and final branchy approval to be considered further at the Commission s August 2016 meeting. As a reminder, please be advised that late submission and receipt of documents and reports are subject to significant late fees in accordance with Commission policy. These fees are outlined in ACCET Document 10, which can be found at The institution is further advised that a one-day Quality Assurance Visit to one branch campus will be conducted during the institution s current grant of accreditation, typically occurring near the midpoint of the accreditation period. The team s review will include an assessment of any areas cited as weaknesses during the last accreditation visit in order to validate that corrective actions have been systematically and effectively implemented to ensure a positive impact on the institution s operations. The appropriate state and federal education officials will be notified of this action by copy of this letter.
