Unless stated otherwise in the documentation, you shall not display, modify, reproduce and distribute any of the stock files included with the software. You may not provide access to the Spigot Softbranded software to any person for any purpose other than processing your internal data for the intended use of the Spigot Soft-branded Software. You agree that you shall use the software only in a manner that complies with all applicable laws in the jurisdiction in which user uses the software, including, but not limited to, applicable restrictions concerning copyright and other intellectual property rights. Spigot Software does not guarantee the outcome of the performance of the software if the software is NOT used in a way that it is intended to be used. Spigot Software shall also not be liable directly or indirectly for the outcome in such an event of wrong usage. You agree to not export, license or otherwise transfer the Spigot Soft-branded Software as a standalone product or as bundled with any third party technology to any country where such transfer is prohibited or in violation of the laws of any other country. Where you are presented with hardware and/or a click-accept license prior to installation of Spigot Software s products, such license for the product is between you and the manufacturer of such hardware and/or software, and may be used only in conjunction with the Spigot Software Product. Spigot Software accepts no liability whatsoever for such bundled hardware and associated software product or its use. Other than Spigot software s specific certification set forth above, Spigot software disclaims all warranties and any associated remedies, written or oral, expressed or implied. To the extent allowed by local law, Spigot software disclaims all implied warranties or conditions including any implied warranties of merchantability and fitness for a particular purpose, title and non-infringement. 4. Termination. This License is effective until terminated. You may terminate this License at any time by destroying the Software, related documentation and all copies thereof. This License will terminate immediately without notice from Spigot Software if you fail to comply with any provision of this License. PROVISIONS WHICH, BY THEIR NATURE, MUST REMAIN IN EFFECT BEYOND THE TERMINATION OF THIS LICENSE SHALL SURVIVE. Upon termination you must destroy the Software and related documentation and all copies thereof. 5. Export Law Assurances. You may not use or otherwise export or re-export the Software except as authorized by Indian law and the laws of the jurisdiction in which the Software was obtained. 6. Limited Warranty on Media. Spigot Software warrants the diskettes on which the Software are recorded to be free from defects in materials and workmanship under normal use for a period of sixty (60) days from the date of purchase on the receipt. Spigot Software s entire liability and your exclusive remedy will be replacement of the diskettes not meeting Spigot

9 Software s Limited Warranty and which are returned to Spigot Software with a copy of the receipt. Spigot Software will have no responsibility to replace a disk damaged by accident, abuse or misapplication. ANY IMPLIED WARRANTIES ON THE DISKETTES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THIRTY (30) DAYS FROM THE DATE OF DELIVERY. 7. This License shall be governed by Indian law provisions (except to the extent applicable law, if any, provides otherwise). With respect to disputes in which at least one party is a citizen of, or an entity chartered or registered to do business in India, any litigation relating to this License shall be subject to the jurisdiction of the courts in Bangalore,, with the losing party responsible for costs, including without limitation, court costs and reasonable attorneys' fees and expenses.
