FILE NO: TENDER - BLACKWATTLE BAY AND JOHNSTONS CREEK CATCHMENT AREAS FLOODPLAIN RISK MANAGEMENT STUDIES AND PLANS S TENDER NO: 1320 SUMMARY This report provides details of the tenders received for the Blackwattle Bay and Johnstons Creek catchment areas Floodplain Risk Management Studies and Plans. Blackwattle Bay and Johnstons Creek catchment areas together comprise approximately 20% of the City s total Local Government Area. These catchment areas include the suburbs of Glebe, Chippendale, Darlington, Camperdown, Redfern, Surry Hills, Annandale, Forest Lodge and part of Ultimo. The NSW Government has developed a Flood Prone Land Policy to determine if development on floodplains is appropriate and sustainable. The Policy states that individual councils have the primary responsibility for floodplain risk management and the NSW Government will, if required, provide technical and, in some cases, financial support. The Floodplain Development Manual 2005, developed by the NSW Government, sets out a four stage approach as follows: preparation of a Flood Study, to identify the nature and extent of flooding; preparation of a Floodplain Risk Management Study, to investigate all available flood mitigation solutions or options, in consideration of social, ecological and economic factors relating to flood risk; formulation of a Floodplain Risk Management Plan, including preferred solutions and/or options and formal adoption by the Council; and implementation of the Floodplain Risk Management Plan. The preparation of a Flood Study for the Blackwattle Bay and Johnstons Creek catchment areas has been completed. Tenders have subsequently been invited to undertake the next two stages of the process as outlined above. The Floodplain Risk Management Plans will describe how particular areas of flood prone land are to be used and managed. They will constitute a draft program of works to guide the City s future expenditure on major flood mitigation and drainage improvement works. This report recommends that Council accept the tender offer of Tenderer C to undertake the Blackwattle Bay and Johnstons Creek catchment areas Floodplain Risk Management Studies and Plans.
2 RECOMMENDATION It is resolved that: (A) (B) (C) Council accept the tender offer of Tenderer C to undertake the Blackwattle Bay and Johnstons Creek catchment areas Floodplain Risk Management Studies and Plans; authority be delegated to the Chief Executive Officer to negotiate, execute and administer the contract relating to the tender; and Tender Evaluation Summary, Attachment B to the subject report, remain confidential in accordance with Section 10A(2) of the Local Government Act ATTACHMENTS Attachment A: Catchment Plan Attachment B: Tender Evaluation Summary (Confidential) (As Attachment B is confidential, it will be circulated separately from the agenda paper to Councillors and relevant senior staff only)
3 BACKGROUND 1. The development of Floodplain Risk Management Studies and Plans for all the stormwater catchments within the City s Local Government Area is required by legislation. The Long Term Financial Plan has allocated $59.5M for drainage capacity upgrade works arising from these studies over the next 10 years. 2. The City has also developed and adopted a Decentralised Water Master Plan which focuses on water re-use and water quality measures. A further $24M of initiatives relating to this Master Plan are expected to be allocated within the Long Term Financial Plan over the next 10 years. 3. The NSW Government has developed a Flood Prone Land Policy to determine if development on floodplains is appropriate and sustainable. The Policy promotes a merit based approach to balance social, economic, environmental and flood risk parameters. 4. The Policy states that individual councils have the primary responsibility for floodplain risk management and the NSW Government will, if required, provide technical and, in some cases, financial support. 5. The Floodplain Development Manual 2005, developed by the NSW Government, sets out a four stage approach as follows: preparation of a Flood Study, to identify the nature and extent of flooding; preparation of a Floodplain Risk Management Study, to investigate all available flood mitigation solutions or options, in consideration of social, ecological and economic factors relating to flood risk; formulation of a Floodplain Risk Management Plan, including preferred solutions and/or options and formal adoption by the Council; and implementation of the Floodplain Risk Management Plan. 6. The preparation and implementation of the various Floodplain Risk Management Plans are critical components in improving the way the City plans and manages flood risks, including infrastructure requirements. 7. In August 2008, Council resolved to establish a Floodplain Risk Management Committee to assist the City in the development and implementation of Floodplain Risk Management Plans. 8. The Floodplain Risk Management Committee is comprised of representatives from the: (e) community; NSW Office of Environment and Heritage; NSW State Emergency Services; NSW Fisheries; Sydney Water; and
4 (f) NSW Roads and Maritime Services. 9. There are eight drainage catchment areas (Attachment A) in the City s Local Government Area which are: CATCHMENT HECTARE % CITY S LOCAL GOVERNMENT AREA Alexandra Canal 1, Blackwattle Bay Centennial Park City Area Darling Harbour Johnstons Creek Rushcutters Bay 64 2 Woolloomooloo TOTAL 2, Blackwattle Bay and Johnstons Creek catchment areas together comprise approximately 20% of the Local Government Area. These catchment areas include the suburbs of Glebe, Chippendale, Darlington, Camperdown, Redfern, Surry Hills, Annandale, Forest Lodge and part of Ultimo. 11. The preparation of Flood Studies for the Blackwattle Bay and Johnstons Creek catchment areas have been completed and were reported to Council in December The next steps for the Blackwattle Bay and Johnstons Creek catchments are to undertake the Floodplain Risk Management Studies and to develop Floodplain Risk Management Plans. 13. The Floodplain Risk Management Plans will describe how particular areas of flood prone land are to be used and managed. It will constitute a draft program of works to guide the City s future expenditure on major flood mitigation and drainage improvement works. 14. On 10 December 2012, Council resolved to proceed to the next stages of the Floodplain Risk Management process. INVITATION TO TENDER 15. Invitations to Tender were advertised in The Sydney Morning Herald and The Daily Telegraph on Tuesday 2 April The tender period closed on Tuesday 23 April Tenders were also advertised through
5 TENDER SUBMISSIONS 16. Four submissions were received from the following organisations: BMT WBM Pty Ltd Cardno (NSW/ACT) Pty Ltd WMA Water Pty Ltd Worley Parsons Pty Ltd 17. No late submissions were received. TENDER EVALUATION 18. All members of the Tender Evaluation Panel have signed Pecuniary Interest Declarations. No pecuniary interests were noted. 19. The relative ranking of tenders as determined from the total weighted score is provided in the Confidential Tender Evaluation Summary Attachment B. 20. All submissions were assessed in accordance with the approved evaluation criteria being: (e) (f) (g) (h) (i) the lump sum price and the schedule of prices; specified personnel and resources to carry out the work under the contract and their qualifications; demonstrated technical and management skills, capacity and experience; the proposed project plan and program; time allocation for major activities; the proposed methodology including communication and public consultation methods; Workplace Health and Safety; environmental management; and financial stability and financial position of the tenderer including insurances. PERFORMANCE MEASUREMENT 21. The City will ensure the successful tenderer meets the required performance standards, by: conducting regular meetings with the Consultant; the City s Project Manager carrying out regular reviews and monitoring to ensure the Consultant remains on track with regard to the program and the quality of works;
6 presenting regular progress reports and results to the Floodplain Risk Management Committee and seeking input and addressing issues raised by members of the Committee; and ensuring the Consultant completes the Floodplain Risk Management Studies and Plans as specified in the tender documents. FINANCIAL IMPLICATIONS 22. There are sufficient funds allocated for this project in the Long Term Financial Plan over the next 10 years for Flood Studies and Floodplain Risk Management Plans. 23. Under the NSW Government 2012/13 Floodplain Management Program, the City secured a grant of $280,000 towards the total project cost. RELEVANT LEGISLATION 24. The tender has been conducted in accordance with the Local Government Act 1993, the Local Government (General) Regulation 2005 and the City s Contracts Policy. 25. Information provided by tenderers which is commercial-in-confidence has been protected and will not be disclosed in accordance with section 10A(2) of the Local Government Act A consistent standard for all tenderers has been used in assessing any request for confidentiality by a tenderer. 26. It is not considered to be in the public interest to make commercial-in-confidence information available, as it would discourage future tenders from companies who do not wish this information to be in the public domain. CRITICAL DATES / TIME FRAMES 27. The key dates for the Blackwattle Bay and Johnstons Creek Catchment areas Floodplain Risk Management Studies and Plans are as follows: Floodplain Risk Management Study and Plan commences July 2013 Draft Floodplain Risk Management Study and draft Floodplain Risk Management Plan complete June 2014 Public exhibition period July-September 2014 Committee/Council Report December 2014 PUBLIC CONSULTATION 28. During the preparation of the Floodplain Risk Management Studies, a survey will be conducted to seek comments from the flood affected residents and business owners. The survey will seek input on their past flood experience, and ask respondents to rank potential flood risk management approaches for consideration.
7 29. When completed, the Blackwattle Bay and Johnstons Creek catchment areas Floodplain Risk Management Studies and Plans will be placed on public exhibition for community comment. The associated flood studies for these catchments will also be exhibited at this time. 30. Regular progress reports will be presented to the Floodplain Risk Management Committee which includes representatives of community groups and other stakeholders.
