The full cost of insurance will be automatically added to your invoice at the following rates unless you can provide proof of alternative adequate cover. The cover, arranged by Endsleigh Insurance, costs 9.09 per week ( 400 per annum) and will commence from the point of booking to cover cancellation and travel to the UK. Full cover will begin from the start of your course until the end of the academic year (June 30th). If you wish to arrange your own insurance, please tick the box on page 5 and attach a copy of your insurance policy from a recognised insurance provider to this application form. 6 TERMS AND CONDITIONS 1 Application and enrolment To enrol a student at the College, the application form must be completed, signed by the student and the person responsible for the fees. Send your application directly to Admissions with the following items: a) The student s full academic transcripts/ reports and evidence of English language level b) A copy of the student s passport and all prior UK visa pages if applicable. Students are required to fully disclose any prior application to enter the UK, including any visa refusals received, together with information about the level and content of any prior studies undertaken in the UK, as this is an immigration requirement before we can sponsor any student. c) Four passport-size photographs d) Payment of: i) 200 for Domestic students to cover the registration fee or; ii) 200 registration fee, 2,500 tuition deposit and 500 boarding deposit/homestay booking fee if accommodation is required e) The College will confirm as soon as possible whether or not the enrolment has been accepted. Formal enrolment documentation will be sent to you once the application has been accepted. 2 Payment of tuition and accommodation Fees a) The fees are paid in two equal instalments at the start of the Autumn Term in September and the start of the Spring Term in January. b) If payment of the relevant term s fees has not been made in full on the first day of term, the College reserves the right to suspend or cancel tuition and/ or accommodation. The student may be prevented from sitting examinations where fees remain unpaid in whole or in part. c) Fees may be paid in two ways: i) By bank transfer to the bank details shown on the invoice. Please provide a payment reference so that the College can easily identify funds upon arrival. The reference must be the student s reference number and full name as written in English. ii) By credit/debit card Please contact the College Bursar by telephone on to arrange payment by credit card. 3 Provision of tuition The College reserves the right to make alterations to programmes shown in the prospectus or other College literature. 4 Increase of Fees The College reserves the right to increase fees at short notice should circumstances demand it. 5 Additional Services All additional services (trips, examination fees, etc) must be paid for in advance in cash if the College so requests. Any invoiced expenses will be due for payment within seven days. 6 Cancellation and Withdrawal a) In order to withdraw a student from a Programme, or from part of a Programme that has already started, the person responsible for the payment of fees is required to give notice, in writing, for the remainder of the current term plus one full academic term. Failure to give such notice will oblige the person responsible for the fees to pay the College the remainder of the academic term s fees plus one term s fees in lieu of notice. In the event of a student being withdrawn without a full term s written notice being provided to the Principal and receipt acknowledged in writing, fees will be charged for the remainder of the current term plus a full term s fees. Any student withdrawing will be required to provide documentary evidence of their return to their home country or their sponsorship by a new educational establishment (eg CAS documents from new sponsor). If an International student cancels and withdraws after confirmation but prior to arrival then: i) 200 non-refundable Registration Fee is retained ii) 2,500 deposit is retained unless a visa is refused through no fault of the student iii) 500 accommodation deposit is retained unless a visa is refused through no fault of the student iv) The first terms fees remain due unless a visa is refused through no fault of the student b) It is assumed that the student intends to remain at the College until completion of both the AS and A2 components of a full A-Level course. If a student wishes to withdraw from the College before completion of a full A-Level course the fees for the following term remain payable unless written notice is received by the College on or before the first day of the last term to be attended by the student. Receipt of this notice must be confirmed in writing by the Bursar. c) Notice of discontinuation of any subject must be given in writing one full term in advance, otherwise payment for the next term will be required. Receipt of this notice must be confirmed in writing by the Bursar. d) Any International students withdrawing from a College Programme of study will be reported to the UKBA. Any student withdrawing will be required to provide documentary evidence of their return to their home country (eg visa stamp) or their sponsorship by a new educational establishment. 7 Refund of deposits The initial deposit cannot be used by the student to pay for expenses or cover shortfall in fees. The deposit that is required by the College cannot be refunded until the final account has been settled in full. Only once a student s account has been fully settled will any remaining deposit funds be returned to the student or person responsible for paying the fees, as applicable. 8 Vacation charges a) Charges will be made should the student remain in College accommodation during vacation periods. b) Charges will be made if the student leaves belongings in College accommodation during vacations in such a state that it is impractical to clean, maintain or repair their room. 9 Illness or injury a) The College is unable to refund fees when the student is absent due to illness or injury or other emergency, unforeseen event or change in personal circumstances. The person responsible for the fees is therefore advised to arrange adequate insurance to provide cover for the refund of fees. b) If, as a result of illness or injury or other emergency, unforeseen event or change in personal circumstances, a place at the College is cancelled, or a student is withdrawn from a Programme, then the relevant charges or fees, set out in section 7 above, will apply. c) Students studying for less than 6 months are not eligible for NHS treatment beyond accident and emergency and should ensure they obtain medical cover prior to their arrival. 10 Grounds for Exclusion from the College a) The student must abide by the College s rules as set out in Student Handbook or as may be published or announced by the Principal. b) The College reserves the right to require a student s withdrawal including immediate withdrawal from a Programme, or part of a Programme, for a serious or aggravated disciplinary or behavioural matter including continued or repeated misconduct, or if it is considered by the Principal that such a withdrawal is in the best interests of the student or the study group. c) In the event of a student s temporary or permanent withdrawal from a Programme, or expulsion from the College, no refund of the term s fees or deposit will be made. d) In the event of a student being withdrawn from a Programme or part of a Programme arrangements will be made for the student to return home at the earliest possible opportunity, and the student will be required to confirm their safe arrival to their home country. Their visa sponsorship will be withdrawn. In this event, any relevant costs and expenses incurred by the College, including the costs of shipping/ storing personal property, shall become payable by the person responsible for payment of the fees. e) Students are required to maintain appropriate levels of attendance and may be expelled and/or reported to the UKBA should this fall below the required level. vi) Parents confirm that they will as soon as possible, inform the college in the student develops any new medical condition, disability or learning difficulty whilst they are a student at the College. If the medical condition is a communicable disease parents agree that the student will be kept from the College until medical advice is provided stating that it is safe return to the College. 11 Academic performance a) The student is accepted at the College on the understanding that progression through the relevant Programmes is conditional upon satisfactorily attending lessons and attaining reasonable performance targets. English for Academic purposes will form part of a student s study Programme until such point as they reach IELTS 7.0. b) If, in the reasonable opinion of the Principal, the student has not satisfactorily attended lessons or has achieved below 80% attendance, or has failed to attain reasonable performance targets, the College may not enter the student for examinations or allow the student to continue with the programmes for which enrolled. In such circumstances the student will be offered suitable alternative Programmes or asked to withdraw from the College. In the event of a student being withdrawn no refund of the term s fees or deposit will be made. See section 6. c) Any student found to have misled the College as to their qualifications, prior UK Visa history and suitability for entry will be subject to expulsion from the College without recourse to refund of tuition fees already paid Accommodation a) The student is expected to live in College accommodation unless either living at home with a parent or guardian aged at least 21 years (subject to College approval), within reasonable travelling distance of the College. b) While the College will endeavour to provide a student with the accommodation requested on the application form, their preference is not guaranteed and confirmation will be made prior to arrival. c) The student may at any time be asked to change accommodation where this is due to misbehaviour, negligence, act or omission of the student. Any additional supplement shall become immediately payable. d) Should the student wish to change or move out of College accommodation the person responsible for the payment of fees is required to give notice, in writing, for the remainder of the current term plus one full academic term. Failure to give such notice will oblige the person responsible for the fees to pay the College the remainder of the academic term s fees plus one term s fees in lieu of notice. In the event of a student being withdrawn without a full term s written notice being provided to the Principal and receipt acknowledged in writing, fees will be charged for the remainder of the current term plus a full term s fees. e) From time to time the college needs to inspect its residential premises. Whenever possible, reasonable notice will be given of such visits but the college reserves the right to conduct unannounced checks of accommodation, including student bedrooms. 13 Fines and Penalties a) The student is liable for any loss or damage caused by the student to the premises in which the student is being taught or is living. b) The College may impose a reasonable penalty or fine for other forms of misconduct such as contravening health & safety regulations or infringing College policy. 14 Personal property The College does not accept responsibility for students personal possessions. Parents are advised to ensure that the student s property is covered by an adequate insurance policy. 15 Publicity By enrolling with the College, the student, parents or guardians for the student, and the person responsible for the payment of fees, consent to the reasonable use of the student s details and achievements. This includes images or recordings of the student for promotional purposes, exam results and University destinations. 16 Liability The College shall not be liable for either death or personal injury suffered by any student except as may arise through the negligence of the College. Parents, Guardians and the student must agree to notify the College of special dietary needs, allergies or other medical conditions where special arrangements have to be made. Parents, Guardians and students also agree that the College may administer any nonprescription medication or first aid as is deemed appropriate and to seek medical, dental or optical treatment when required. 17 Force Majeure In this agreement force majeure shall mean any cause beyond a party s control (including for the avoidance of doubt strikes, other industrial disputes, act of god, war, riot, civil commotion, compliance with any law or government order, rule, regulation or direction (including that of a local authority), accident, fire, flood, storm, pandemic or epidemic of any disease, terrorist attack, chemical or biological contamination). In the event of a force majeure arising which prevents or delays the College s performance of any of its obligations under this agreement, the College shall forthwith give you notice in writing specifying the nature and extent of the circumstances giving rise to the force majeure. Provided that the College has acted reasonably and prudently to prevent and minimise the effect of the force majeure, the College will have no liability in respect of the performance of such of its obligations as are prevented by the force majeure while it continues. The College shall use its best endeavours during the continuance of the force majeure to provide educational services. If the College is prevented from performing its obligations for a continuous period greater than 90 days, the College shall notify you of the steps it shall take to ensure performance of the agreement. 18 Data protection Any information provided to the College may be held on computer and shall be used by the College in accordance with its data protection registration and the data protection principles. 19 Jurisdiction Any alterations to the above terms and conditions are rendered void unless confirmed in writing by the Principal. These terms and conditions, and any disputes arising from contracts or agreements with the College shall be governed by and construed in accordance with English Law under the non-exclusive jurisdiction of the English Courts.
