'WHo Is NAM? -Wp An-E A Malon ADR PRovrnnR FoR: I Commercial/Business/Corporate I Construction I Employment r lnsurance I Personal/Catastrophic lnjury I Real Estate National Arbitration and Mediation (NAM) is one of the nation's premier dispute resolution providers, offering clients cost-effective alternatives to expensive and often time-consuming litigation. Founded in 1992, NAM has a nationwide panel of more than 1,700 top-tier former judges and practicing specialists uniquely qualified to resolve legal matters in a private forum. The company maintains rosters in every major city of the United States, with specific expertise in the areas of Complex Commercial, Personal lnjury, Construction, lnsurance, Employment and Real Estate dispute resolution. NAM offers disputants a wide array of conflict resolution options and tools such as arbitration, mediation, mock jury trials, video-conferenced proceedings, Alternative Dispute Resolution (ADR)training and program design services. Most importantly, NAM offers exceptional customer service and a knowledgeable staff of experienced ADR consultants. f 'WE'nr rhp ExpEnrs rn ADR NAM has been a featured expert in the area of ADR on ABC World News, Fox Network News, Court TV, CNBC, Channel 5 New York, Bloomberg Radio and other television and radio broadcasts. Additionally, the company has been quoted or mentioned in more than 150 Associated Press articles nationwide, as well asin Newsday, The Wall Street Journal, Forbes, Business Week, The NY Daily News, The New York Law Journal, USA Today, The New York Post, Treasury & Risk Management, lnsurance Advocate, Claims Magazine and numerous Bar Association publications. The company has also been featured as an ADR innovator by the CNN Network, News 12 Long lsland, The ABA Journal, Trial Magazine, Best's Review, Interactive Week and Technology Review.

I A RExowNnr> Rosrsn NAM provides its clients with access to the best panel of Arbitrators and Mediators in every major city in the nation. NAM'S Hearing Officer roster includes former top-tier judges and senior attorneys, with expertise in a myriad of fields. Through consistent and rigorous market analysis, NAM's Neutral Management Team identifies and recruits only those individuals with exceptional credentials and outstanding reputations. The talent available through NAM is especially invaluable in "high-stakes" litigation and is crucial to ongoing, high-volume ADR initiatives. By design, all NAM Hearing Officers are independent contractors and are not employees of NAM. This eliminates any possibility of business conf licts, thus affording parties the most pristine forum available.,it': i:ri i:': i..lir

I An SITRATIoN Arbitration is a less formal alternative to traditional litigation, offering parties a forum to definitively resolve their dispute with the undivided attention of an Arbitrator. The Arbitrator rules on discovery requests, determines what evidence is admissible and reviews testimony prior to rendering a binding decision. The three primary forms of arbitration offered by NAM are: r Open Arbitration, a hearing in which the Arbitrator hears a case and renders a final decision. r High-Low Arbitration, a process in which the parties, by agreement, restrict the range of an Arbitrator's decision by establishing "high" and "low" parameters. r Baseball Arbitration, which typically involves the submission by each party of his/her last best figure and the reason why it should be accepted with the Hearing Officer's determination being restricted to either one figure or the other. MsorerroN Mediation ls a non-binding, informal settlement conference facilitated by the efforts of one of NAM's skilled Mediators. As established by NAM's Rules of Procedure, discussions held during a mediation conference are confidential. The Mediator cannot be called as a witness in any subsequent litigation and any settlement offers made during the conference are not admissible in court. More than '75o/o oi NAM-mediated cases result in the resolution of all outstanding issues. When a settlement is reached, a Post-Mediation contract is signed by the parties and by the Mediator to confirm the mutually agreed-upon terms. r Rated by Business lnsurance as "Best in Legal Services" r Named "ADR Provider of the Year" r Rated as one of "Long lsland's Top 100 Companies"

I'Wr-rv Born Srops CnoosE ljs NAM receives thousands of case submissions each year, sourced equally from both plaintiff and defendant law f irms and institutions. As an established major neutral in the market, NAM actively works with more than 3,300 commercial clients. Over the course of any twelve-month period, NAM's clientele is so diverse, that no client represents more than 2% of NAM's revenue. As such, parties can rely on the fairness and integrity of a NAM-administered initiative. Also, NAM is well known for its superb customer service and for delivering exceptional results. ln fact, more than 75o/o of NAM-administered Mediations result in the settlement of all outstanding issues. Perhaps the best indication of client satisfaction with NAM's service is that over any f ive-year period, NAM retains regular ongoing ADR programs with more than 93% of its clientele.! SrarE-oF-THE-Anr TrcsNorocy NAM has invested more than $10 million in its internal state-of-the-art case management system and thus can provide the most timely, efficient and responsive service in the industry. The company's electronic intelligence, data management and case-tracking capabilities serve to ensure the timely processing of cases. Convenient locations and times are made available. All of the appropriate documents needed are secured in advance. The date, time and location for scheduled cases are triple-confirmed with all participants. ln addition, videoconferencing technology is available to allow parties at different locations to resolve disputes and may also be used for training purposes.

! MvADR As the acceptance of ADR continues to grow, so has the volume, size and complexity of cases referred to NAM. Many of NAM's clients today oversee ADR initiatives that range from several hundred thousand dollars in resolved cases to more than $100 million per annum. Given ihe magnitude of such initiatives, NAM developed MyADR, a unique, patented dispute resolution case management system designed to help c ients oversee their ADR programs. MyADR is an online portal into NAM's in-house system that provides clients with secure ADR-related data such as case calendars, tracking and status reports as well as decisions and awards. MyADR also acts as an ADR "report card" oy providing broad program analyses and case-turnaround information so that clients may observe the superior performance of NAM. zt.rfi 4 I ri; 7 I NAM's CovrvrERCrAL DtvtstoN To properly address the unique and sensitive nature of each commercial case, the Commercial Division's priority is to offer a flexible and customized approach. For instance, procedures can be tailored for handling discovery issues and the submission of legal briefs. Multi-day cases can be scheduled on consecutive days. Additionally, NAM has designated a select panel of Hearing Off icers that includes former commercial division judges and well-respected, qualified practicing attorneys. NAM's Commercial Division is able to resolve matters in such a manner that existing business relationships are often preserved I Tnrnr Pn Epen arron Snpvrcps Scecifrcally designed for "high-stakes" litigation, NAM can provide the se'vrces of one or more of the company's panel members for consultation 'egarding a particular case. ln addition, mock jury trials, with the jurors :cl,lpr sed of NAM panel members or actual lay people recruited by '.,cm to serve on such juries, can provide invaluable feedback regarding :^e effectiveness of various trial strategies being considered. Multiple ^-cck jury hearings can be conducted with different jurors to test several In each scenario, NAM has the capability to videotape 'ccroaches. :"e deliberations. Such videotapes can subsequently be reviewed :'d analyzed, which may prove invaluable in formulating litigation or se::lement strategies. These services can result in significant cost sav, ngs, settlement alternatives or, if necessary, more effective litigation.
