1 19 One Gateway Plaza Los Angeles, CA Tel metro.net PLANNING AND PROGRAMMING COMMITTEE SEPTEMBER 17, 2014 SUBJECT: ACTION: FY 2014 FEDERAL HOMELAND SECURITY PROGRAM APPROVE PROGRAMMING RECOMMENDATION RECOMMENDATION Approve programming of up to $6.3 million from fiscal year (FY) 2014 federal Department of Homeland Security- Transit Security Grant Program (TSGP) funds that are available for the eligible Union Station Gateway Complex capital transit project shown in Attachment A. ISSUE The Board of Directors must approve the programming of up to $6.3 million in federal transit security grant funding for eligible capital projects, before we may begin to draw down such funding according to grant guidance. Approving the programming of up to $6.3 million in available federal transit security funds will help to implement priorities that the Board of Directors has established through the Long Range Transportation Plan process for Los Angeles County. DISCUSSION On July 28, 2014, the federal Department of Homeland Security (DHS) announced awards from Congress that appropriated $1.6 billion through the Consolidated Appropriations Act, 2013, Division D (Public Law 113-6). The Transit Security Grant Program is one of the DHS Fiscal Year (FY) 2014 grant programs that directly support transportation infrastructure security activities. The process for applying for these funds was competitive. We were awarded $6.3 million out of the $90 million of appropriated funds for TSGP nationwide to enhance security at the Union Station Gateway Complex. Federal TSGP Funding Federal TSGP funding made available through the DHS may be used for protecting critical infrastructure within our transit system from terrorism, especially explosives and
2 non-conventional threats that would cause major loss of life and severe disruption within the greater Los Angeles region. Since 2004, we have received an estimated $44.8 million in federal transit security funds that we have been using to harden security within our subway, enhance surveillance at all bus facilities, operate random and unpredicted patrols throughout the transit system, and develop and provide training for the majority of the transit staff in terrorist awareness. Union Station Gateway Complex Security Enhancements The $6.3 million awarded by DHS in FY 2014 TSGP funding is recommended to be programmed for a project to enhance security in the Union Station Gateway Complex (see Attachment A). This project includes features to address three vulnerability areas: 1) Communications - installation of a state-of-the-art emergency public announcement system throughout Union Station Gateway with control center; 2) Response - purchase of mobile data terminals that will consolidate emergency surveillance data for use by security personnel; and 3) Security- purchase state-of-the-art secured access system for Metro Headquarters building. We submitted our application for this funding on May 16, These FY 2014 TSGP federal funds must be encumbered and expended by August 31, DETERMINATION OF SAFETY IMPACT The implementation of the $6.3 million in federal Transit Security Grant Program funds will support activities that were previously Board-approved. In particular, the federal funding will be allocated towards projects identified in the Baseline Assessment for Security Enhancement (BASE) performed by Transportation Security Administration (TSA) in 2008 on the Union Station Gateway Complex. FINANCIAL IMPACT No expenses for the projects listed in Attachment A are included in the FY15 Budget. These funds will be included in future year budgets, once DHS authorizes expenses to be incurred. As this is a multi-year project, the transit security project managers will be responsible for budgeting the project costs required in their cost centers in future years. Impact to Bus and Rail Operating and Capital Budget The funds programmed by this action will come from $6.3 million in federal TSGP funds to finance the eligible Union Station Gateway Complex capital project as shown in Attachment A. These funds are for security eligible capital projects only and may not be used for operating expenses per grant guidance. These activities will impact our bus and rail budgets because operating funds are required to sustain the needed project at an estimated cost of $2 million over a 10-year period. 3 ALTERNATIVES CONSIDERED The Board of Directors may choose not to program the available DHS-awarded grant funding. We do not recommend this option because without Board approval, we cannot access the $6.3 million in federal transit security funds that have been awarded to the needed Union Station Gateway Complex transit security project shown in Attachment A NEXT STEPS With Board approval of the recommended programming, we will process the necessary documents with DHS to secure the $6.3 million in transit security funds awarded for the Union Station Gateway Complex transit security project. We also will work to ensure timely implementation of the project and monitor grant compliance activities.
