Martinez-Fraga is a partner in DLA Piper's international arbitration and litigation practice. Based in Miami, he is the firm's Coordinator of International Disputes for Latin America and Florida. Mr. Martinez-Fraga has significant experience and exclusively practices in the field of international litigation and transnational arbitration, including complex jurisdictional disputes concerning common law and civil law issues, sovereign immunity, act of state contentions, international investment law, corporate governance, anti-suit injunctions, cross-border energy disputes (oil and gas, cogeneration, and geothermal), asset tracing, cross-border interim relief, and issues concerning the recognition of foreign judgments and arbitral awards. He has represented seven sovereignties in Latin America, in addition to the Kingdom of Spain, together with geopolitical subdivisions and state instrumentalities. his arbitration experience includes arbitral disputes under the the following institutions and rules: ICSID (World Bank), ICC, LCIA, ICDR, DIS, and Hong Kong Chamber of Commerce. He founded and chaired that firm's International Litigation and Arbitration department. Mr. Martinez-Fraga is a noted scholar, author and lecturer in the fields of public and private international law, including international arbitration and arbitration, jurisprudence and private procedural international law and has been published in 15 countries and four languages. He has written more than fifty peer-reviewed articles, four books on private and public procedural international law, and is the co-editor and a contributing author of a fifth book on international arbitration. His recent book, The American Influence on International Commercial Arbitration, published by the Cambridge University Press, forms part of the permanent collection of over 100 leading law school and university libraries in the United States and throughout the world. 3 Mr. Martinez-Fraga has lectured at more than 20 law schools throughout Europe, Latin America, Asia and the United States. Mr. Martinez-Fraga currently serves as an adjunct professor at the New York University (NYU) School of Law. He served as an adjunct professor at the University of Miami School of Law from , and is a full visiting professor of International Litigation and Arbitration of the Global Law Program of the University of Navarra School of Law, and an Honorary Professor of Law of the Universidad de San Ignacio de Loyola in Lima, Perú. The venue was Jamaica Representing successfully the Republic of Chile in a landmark case that garnered international recognition concerning the prosecution of former Chilean President Augusto Pinochet Defending successfully a criminal and civil complaint filed in Bari, Italy against an individual charged with a transnational racketeering scheme concerning the illicit trafficking of merchandise and tax fraud in Germany, Holland, Montenegro and Italy Representing a leading provider of natural gas services and the largest pipeline company in North America in litigation resulting from proceedings conducted in the Dominican Republic and a related ICC arbitration, and obtaining final judgment enforcing an arbitration award and a permanent injunction barring the opposing party from continuing litigation in the Dominican Republic Representing a client in the successful defeat of a claim for US$56 million in an ICC arbitral proceeding Obtaining dismissal of a multimillion dollar claim filed in the United States District Court for the Middle District of Florida by a citizen of Belgium against a defendant corporation incorporated under the laws of the Cayman Islands. The action was dismissed on the papers upon full briefing on the single issue of lack of personal jurisdiction Representing Corporación de Fomento de la Producción, an instrumentality from the Republic of Chile, in a pre-action 28 U.S.C proceeding to solicit discovery in aid of civil and criminal cases filed in Chile. Based exclusively on this pre-action effort directed at a financial institution in South Florida, a multimillion-dollar settlement was reached with the referenced financial institution without the need of filing, let alone prosecuting, a civil action Obtaining summary judgment as to seven of eight claims filed on behalf of 340 Canadian citizens and three corporate entities against a financial service institution seeking, in part, rescission of a US$28 million transaction. Upon
7 dismissal of these claims, the federal action settled for US$83,000 and the order granting summary judgment generated a published opinion on numerous common law causes of action pursuant to California law Filing against the Republic of Cuba under the Castro regime the first proceedings before the Inter-American Court on Human Rights and a United States Federal District Court, an action on behalf of an imprisoned dissident journalist Defending successfully an entity in an ICDR arbitration and prevailing on a counterclaim that the client filed against the claimant in that proceeding. The successful defense included prevailing against claims for breach of contract, fraud in the inducement, fraud in the execution and breach of fiduciary duty purportedly arising from a licensing agreement to market and reformulate a product. The client was also awarded attorney s fees and costs Representing successfully a Guatemala-owned airline in a Petition for Remission and Mitigation of Penalty Defending successfully in an ICC/ICA arbitration conducted in Spanish and English in Lima, Perú against a multinational corporation Defending successfully six interrelated cases, each alleging multimillion-dollar claims against affiliated entities, filed in Spain, the British Virgin Islands, Delaware, Puerto Rico and Florida. The cases were settled in favor of the various defendants for a total of US$60,000,000. This representation, in part, entailed strategic planning and representation in a seventh proceeding before the National Assembly in Spain. The cases garnered international attention Representing the Republic of Argentina in a claim alleging the massive conversion by the Republic of Argentina of computer equipment. The complaint was dismissed with prejudice pursuant to the Act of State Doctrine and the Foreign Sovereign Immunity Act. The case is of particular significance in that it meaningfully contributed to the jurisprudence governing a sovereign's normative basis for the exercise of its police powers. The case received national and international media attention and was featured in the National Law Journal s Verdicts & Settlements section in March 2002 Representing the Republic of Argentina in a US$20 million complaint alleging tortious interference with multiple contractual and business relations. The case was removed to federal court, where the judge granted a motion to dismiss based on numerous grounds including lack of subject matter jurisdiction under the Foreign Sovereign Immunities Act Successfully representing the Federated Republic of Brazil in the civil prosecution of defendants who had successfully implemented the largest defalcation in that country s history
