11 Assessment mandates s.47(1) NHS and Community Care Act 1990 where it appears to a local authority that any person for whom they may provide or arrange for the provision of community care services may be in need of any such services, the authority: shall carry out an assessment of his needs for those services, and having regard to the results of that assessment, shall decide whether his need calls for the provision by them of any such services

12 s.47(2) NHSCCA 1990 assessment under both for disabled people if at any time during the assessment. it appears to the local authority that he is a disabled person, the authority (a) shall proceed to make such a decision as to the services he requires as is mentioned in section 4 of the Disabled Persons (Services, Consultation and Representation) Act 1986 without his requesting them to do so and (b) shall inform him that they will be doing so, and of his rights under that Act

13 s.47(3) NHSCCA 1990 referral to health & housing authorities If at any time during the assessment of the needs of any person it appears to a local authority: (a) that there may be a need for the provision to that person by (a health authority), or (b) that there may be a need for the provision to him of any services which fall within the functions of a local housing authority the local authority shall notify that authority and invite them to assist, to such extent as is reasonable in the circumstances, in the making of the assessment

14 Disabled people s.4, Disabled Persons (Services, Consultation & Representation) Act 1986 when requested to do so by a disabled person, or any person who provides care for him, a local authority shall decide whether the needs of the disabled person call for the provision of any services in accordance with section 2(1) of the Chronically Sick and Disabled Persons Act 1970

15 Disabled children s.5/6 Disabled Persons (Services, Consultation and Representation) Act 1986 Social services must determine whether a child who has a statement of special educational need is disabled at the first review after the 14th birthday. The school leaving dates of children so identified must be notified to social services, so that an assessment of need for community care provision can be made.

16 Definition of disabled s.29 National Assistance Act 1948 and s.17(11) Children Act 1989 blind, deaf or dumb, or who suffer from mental disorder of any description, and other persons who are substantially and permanently handicapped by illness, injury or congenital deformity, or such other disabilities as may be prescribed

25 Carers assessment s.8, Disabled Persons (SCR) Act 1986 Where an assessment of a disabled person is being undertaken under s.4 of this act, the assessment must take into account the carer's willingness and ability to continue to care s.1, Carers (Recognition & Services) Act 1995 where a local authority carry out an assessment under section 47(1) of the NHS and Community Care Act and an individual (the carer) provides or intends to provide a substantial amount of care on a regular basis. the carer may request the local authority, before they make their decision as to whether the needs of the relevant person call for the provision of any services, to carry out an assessment of his ability to provide and continue to provide care for the relevant person
