INTRODUCTION This Schedule 6 (Tariff Schedule) is legally binding on both Parties and will remain in effect until amended following directon by the JCRA or following agreement of both Parties to such amendment or if necessary following a general review of the Reference Interconnect Offer Agreement and its Schedules In this Schedule, a reference to a Clause or Appendix unless stated otherwise, is a reference to a Clause or Appendix of this Schedule 6. Unless defined otherwise, words and expressions have the meaning given in Schedule 1 (Definitions) of this Agreement All Charges shown under this Schedule 6 are in pounds sterling unless otherwise stated Schedule 6 contains Charges for Services provided by JT, Charges for Services provided by OLO and Charges for termination onto third Party networks. The service descriptions for Services offered by JT and OLO are reciprocal. Where services are offered by both Parties, for the avoidance of doubt, in this Schedule, the provider (namely JT and OLO) is specified For each Service, this Schedule 6 will provide details of the current Charges including the effective date of the Charge. 1.2 Call Charging Definitions Call Charges will be dependent on: Call Duration; and Tariff gradients for Daytime, Evening and Weekend Calls The definitions of Daytime, Evening and Weekend are as follows in respect of all Call Charges: Mon Tue Thus Fri Sat Sun Daytime 08:00-18:00 08:00-18:00 08:00-18:00 08:00-18:00 n/a n/a Evening 00:00-08:00 18:00-00:00 00:00-08:00 18:00-00:00 00:00-08:00 18:00-00:00 00:00-08:00 18:00-00:00 n/a n/a Weekend n/a n/a n/a n/a 00:00-00:00* 00:00-00:00** *Midnight Friday night to Midnight Saturday night **Midnight Saturday night to Midnight Sunday night Charging for Call Duration is on a per-second basis, with a minimum duration of 60 seconds for all services If a day on which payment of money falls due is not a Business Day, the due day for such payment shall be deemed to be the next following Business Day. SPECIAL ACCESS SERVICES 4.1 Emergency Services Access Service The following table shows the Usage Charges payable by OLO to JT pursuant to the Emergency Services Access Service description Operator Assistance Access Services The following table shows the Usage Charges payable by OLO to JT pursuant to the Operator Assistance Access Services Service Description Any Call with call completion assistance terminated to a JT Subscriber or JT Mobile Subscriber is subsequently charged at the standard PSTN Terminating Access Service, or PLMN Terminating Access Service Charges as appropriate. 4.3 Directory Number Inclusion Service The following table shows the Charges payable by OLO to JT pursuant to the Directory Number Inclusion Service. TRANSIT SERVICES 5.1 On-Island Transit Service The following table shows the Usage Charges payable by OLO to JT pursuant to the On-Island Transit Service Description Outgoing Off-Island Transit Service The Usage Charges for the Outgoing Off-Island Transit Service consist of two components: The Transit Charge stated below; and The Settlement Rate payable to the Third Party Telecoms Provider outside of Jersey The Transit Charge is stated in the following table, which shows the Usage Charges payable by OLO to JT pursuant to the Outgoing Off-Island Transit Service Description The second component of the Usage Charges is the Off-Island Settlement Rate payable to the Third Party Telecoms Provider. These Usage Charges will be made available electronically by JT to OLO on commencement of the Agreement. 5.3 Incoming Off-Island Transit Service The Usage Charges for the Outgoing Off-Island Transit Service consist of two components: The Transit Charge outlined below; and The Off-Island Settlement Rate paid or charged (dependent on the service) by the Third Party Telecoms Provider Where the Off-Island Settlement Rate is greater than or equal to the sum of the JT Transit Retention Rate and the OLO Termination Rate, JT will pay OLO the OLO Termination Rate Where the Off-Island Settlement Rate is less than or equal to the sum of the Page 8 of 15
9 JT Transit Retention Rate and the OLO Termination Rate, JT will pay the Off- Island Settlement Rate less the JT Transit Retention Rate, where the Off- Island Settlement Rate less the JT Transit Retention Rate is greater than zero. Otherwise, JT and OLO will agree an alternative regime in accordance with clause 10.2 of the Legal Framework The following table shows the JT Transit Retention Rate payable by OLO to JT pursuant to the Incoming Off-Island Transit Service Description Page 9 of 15

13 7. DATA MANAGEMENT AMENDMENTS SERVICE The following table shows the One-off Charge and Monthly Recurring Charge payable by OLO to JT pursuant to the In-Span Interconnection Service. Charging Unit per DMA Charge 95 per hour up to a maximum of 2,500 per DMA 8. TERMINATION ONTO THIRD PARTY NETWORKS 8.1 On-Island Termination Rates levied by Third Party Telecom Providers based On-Island will be communicated from time to time by JT. 8.2 Within the UK These services specifically excludes calls destined for Third Party Telecoms Providers operating within the Bailiwick of Guernsey: For all other Usage Charges refer to the BT Carrier Price List. 8.3 Other Countries Per Country Charges are defined in the JT Carrier Price List, updated on the 1 st April each year, and are available only to Parties subscribing to this service. The Charges are confidential to JT and to the Party who has signed this agreement. Page 13 of 15

PENALTIES 9.1 Compensation for Delay or Cancellation Pursuant to section 3.5 of Schedule 4 (Operations and Maintenance Manual) of this Agreement, in the event that, in relation to any Order for Interconnect Capacity, the Ready for Test Date or Ready for Service Date is not met through the act or omission (including negligence) of OLO, JT shall be entitled to apply the following penalties: Delay After RFS Date % of installation Charge included in penalty payment % of Monthly 2.048Mbit/s Switch Port Link rental included in penalty payment 1 5 Business Days 50% 20% 6 10 Business Days 50% 40% Business Days 100% 60% Business Days 100% 80% >20 Business Days 100% 100% 9.2 Cancellation of Interconnect Capacity Order If OLO cancels an Interconnect Capacity Order after the date of Interconnect Capacity Order acceptance and in accordance with the provisions of paragraphs and , OLO shall be liable to pay JT: 100% of the installation charge from 4 weeks prior to the Ready For Testing date; or A cost based charge, up to 100% of installation, at JTs discretion, at any time up to 4 weeks prior to the Ready For Testing date. 15 9.3 Failure to restore Service within the Service Restoration Times Pursuant to section 5.4 of Schedule 4 (Operations and Maintenance Manual) of this Agreement, penalties for failing to restore Service within the Service Restoration Times specified in Schedule 5 (Service Schedule) of this Agreement are specified in the table below. Note that penalties are applicable only where the Carrier System of the Interconnecting Link Service is either the In Span Interconnection Service or the Full Span Interconnection Service, and not the Non Diverse Full Span Interconnection Service.
