4 MARITIME PERSONAL INJURY The attorneys at Lewis Brisbois Bisgaard & Smith LLP have extensive experience defending bodily injury and death claims brought by seamen (Jones Act, DOHSA), longshoremen/ship repair workers (LHWCA), workers on rigs in the outer continental shelf (OCSLA), on Oceanographic Research Vessels (ORVA), vessel passengers and claims for asbestos exposure and other maritime toxic tort actions. We have experience in virtually all types of injury claims that invoke application of the general maritime law of the U.S. or state and federal laws and statutes regulating marine and offshore energy commerce, whether in state or federal courts. We represent P&I clubs, domestic and international insurers and their insureds, as well as owners, operators and individuals engaged in marine-related activities in the U.S. and abroad. We have particular expertise in handling cases involving the unique risks and exposures created by oil and gas exploration and production in the Gulf of Mexico. CASUALTY AND COMPLEX LITIGATION Our attorneys litigate claims arising from marine casualties, including allisions, collisions, salvage, and other property and hull damage claims. We routinely litigate in federal courts and are experts in complex maritime litigation including admiralty limitation of liability proceedings, in rem and maritime attachment actions, vessel arrests, ship mortgage foreclosures, general average, bankruptcy and other issues involving maritime liens. OCEAN AND INLAND MARINE INSURANCE We have extensive experience in advising insurance clients on coverage and policy language for ocean and inland marine risks, such as P&I, MEL, hull & machinery, yacht, pollution, and other policies that insure carriers, charterers, ship builders and repairers, wharfingers, terminals, bailees and warehousers, rig and platform owners and operators in the Gulf of Mexico, and other third-party contractors. We also specialize in defending insurers from bad faith claims involving ocean and inland marine policies. MARITIME CONTRACTS Our attorneys negotiate and draft Master Service Agreements, ocean transportation contracts, including charter parties, offshore equipment leases, bills of lading, terminal leases, and litigate disputes arising from these agreements. 5 GOVERNMENT CONTRACTS AND REGULATORY COMPLIANCE We routinely represent maritime interests involved in governmental agency proceedings, including the United States Coast Guard, the United States Department of Labor, and OSHA. We also specialize in representing the interests of employers in claims arising under FELA, the Defense Base Act, the War Hazards Compensation Act, and the Nonappropriated Fund Instrumentalities Act. We routinely counsel clients regarding compliance with the myriad regulations governing the transportation industry promulgated by various government agencies such as the Departments of Homeland Security and Transportation.
