1 NATIONAL REPORTING OBLIGATIONS UNDER IPPC:THE KENYA STATUS REPORT Presentation made at IPPC National Reporting Obligations and Plantwise workshop, 4-6 February 2014, Nairobi, Kenya Presenters: Philip Njoroge & Asenath Koech 1

3 Background Mandate of IPPC: International cooperation in controlling pests of plants and plant products & in preventing their international spread, & especially their introduction into endangered areas Work with contracting parties to ensure establishment & implementation of effective phytosanitary systems Development of International Standards for Phytosanitary Measures (ISPMs) i.e. standards, guidelines & recommendations for phytosanitary measures applied WT O- SPS Agreement). 3
4 Responsibilities of an NPPO Article IV.2 of the convention (1997) outlines these to include: Pest surveillance & reporting of occurrence, outbreak and spread of pests, and of controlling those pests inspection of consignments of plants & plant products moving in international traffic and, with the object of preventing the introduction and/or spread of pests issuance of certificates relating to the phytosanitary regulations of the importing contracting party for consignments of plants, plant products &other regulated articles the disinfestation or disinfection of consignments of plants, plant products and other regulated articles moving in international traffic, to meet phytosanitary requirements 4
5 NPPO issues related to trade and plant protection NPPO required to: Have systems to protect endangered areas Designate, maintain & survey and establish pest free areas & areas of low pest prevalence conduct of pest risk analyses. Phytosanitary certification Set requirements in relation to imports International cooperation in information exchange 5
6 KENYA s NPPO As provided under Article IV.1- General provisions relating to the organization of NPPO, The Government of Kenya: Established KEPHIS as the NPPO as a state corporation under MoA in Now KEPHIS Act 2012 is in place Mandate include regulation of agricultural sector through the application/enforcement of SPS measures Vigilates on matters of plant health & Agricultural produce quality control. Role of KEPHIS wider than that provided under IPPCdeals with UPOV, ISTA, Codex, UNECE and OECD matters too. Key player in regional matters touching on SPS 6
7 2. KENYA s NPPO cont d-1 Under Articles Art. IV, VII.2d, & VIII.2 of Convention on notification of NPPO, designation of entry points status and the official contact points respectively:. Status for Kenya Kenya has notified its NPPO and Official contact Point as requirement and posted relevant information on the IPP. List of entry points has been posted. Note- entry points same as those designated as immigration and custom entry points Official Contact Points can also nominate information officers (IPP Editors) to report information on their behalf Official IPP Editor has been nominated & notified to IPPC, and who manages the Online Comment System (OCS) 7
8 KENYA s NPPO cont d-2 Under Article VII.2b, NPPO s to publish and transmit phytosanitary restrictions, including prohibitions. Article VII.2i also provides for Establishment and provision of updated lists of regulated pests and make list available to other contracting parties and IPPC Status in Kenya: The Information availed to other NPPOs thro Plant Import Permits (PIPs) Plant Import Order (PIO)- official register of requirements under the Plant protection Act, Cap 324 NB: PIO - Under review. Use ISPM No.19 (Guidelines on lists of regulated pests) in update- 8
9 KENYA s NPPO cont d-3: NPPO s under Articles IV.2b & VIII.1a are expected to undertake pest surveillance with objective of reporting including reporting the occurrence, outbreak & spread of pests, & of controlling those pests Status for Kenya Done as provided under relevant ISPMs including ISPM is No.17 (Pest reporting) Internally & regionally reporting done through Horticulture Task Force, WTO-SPS committees, COMESA-SPS committee etc 9

VII.2c requires NPPOs to make available to any contracting party the rationale for phytosanitary requirements, restrictions & prohibitions Status- Kenya Kenya bases phytosanitary requirements, restrictions & prohibitions on: ISPM 2:2007 Framework for pest risk analysis (originally adopted in 1995, revised in 2007) ISPM 11:2013 Pest risk analysis for quarantine pests (originally adopted in 2001, revised in 2004 and 2013), ISPM 21:2004 Pest risk analysis for regulated nonquarantine pests 10
11 KENYA S NPPO cont d -5 Article VII.6: Provides for the contracting parties to take emergency measures on the detection of a pest posing a potential threat to its territories & report action taken to the concerned parties of such detection Status for Kenya Non-compliance - ISPM 13:2001 Guidelines for the notification of non-compliance and emergency action WTO-SPS online notification system and IPP Other avenues include utilizing bilateral approaches to notify concerned parties (NPPOs) & similarly receive notifications from other contracting parties 11

VII.2j: NPPOs are required to conduct surveillance for pests and develop & maintain adequate information on pest status in order to support categorization of pests, and for the development of appropriate phytosanitary measures. Kenya status: undertaken with due regard to the relevant ISPMs: ISPM 6: Guidelines for surveillance, SPM 8:1998 Determination of pest status in an area Detection survey new pest report Delimiting surveys Monitoring surveys 12
13 KENYA S NPPO cont d -8 What happens in event of pest outbreaks?. Article VII.6: Provides for the contracting parties to take emergency measures on the detection of a pest posing a potential threat to its territories & report action taken to the concerned parties of such detection: Kenya applies guidelines of - ISPM 13:2001 Guidelines for the notification of non-compliance and emergency action, NOTE Though: There are challenges including:- inadequate funding for PRA related activities Inadequacy of personnel for identification, taxonomy, surveillance 13
14 Partners in delivery of responsibilities PCPB, HCDA, MoA, CABI, NMK, KWS, KARI, Private sector (AAK, FPEAK, KFC) and research organizations (ICIPE) & Universities among others Ministry of Agriculture - provides the Regulatory framework & overall policy guidance in the agricultural sector. Ministry of Trade/Industry - Kenya Bureau of Standards (KEBS) - Is the National Standards body Develops Standards through Technical Committees and undertakes Quality Assurance Certification and Accreditation. CABI (CPC pest information source, Knowledge Bank & plant clinics through Plantwise Initiative) 14
15 Recommendations and way forward Continue to lobby for funding to undertake activities as expected by the IPPC convention; Undertake joint programs with related institutions (local and international) including soliciting for funding; Promote national system on rapid alert and response initiative targeting pest incursions, occurrences, emergency measures etc Enhance regional approaches to pest management, including surveillance, reporting and control (EAC, COMESA, TRIPARTITE approach etc. 15
