2 Residence or holiday home Even before considering where you want to buy, it is important to know whether this property will be your principal residence or a holiday home. This has significant implications for your wealth tax, inheritance tax, structuring of the acquisition and other matters. Before signing the final deed of sale, we therefore strongly recommend you contact our International Structurer and Estate Planner, who can help you optimise your financial arrangements. The perfect house in the perfect location The South of Spain obviously has many real estate agents. We work with several of the region s finest registered agencies and can give you the contact details of one with local knowledge of the particular area in which you are interested. Financing your property Having found your property, we can help you identify the best way to finance your purchase, taking you through all the relevant options. Using your own capital is not always in your best interest. Depending on your specific circumstances, it may be better to finance your purchase with a mortgage. Here again we can offer various options. Working with you to find the construction that best suits your needs and financing your new property from Luxembourg, the Netherlands, Jersey, Guernsey or Asia. Buying your property Once your offer has been accepted by the seller, a compraventa (preliminary sales contract) will be drawn up. Though this can be done by the real estate agent or their notary, we recommend you have it done by your own notary. In this brochure you will find the contact details of a notary who we can recommend. The compravanta should contain conditions precedent (things that must be delivered for the contract to be binding), such as building permits, urbanisation plans and required financing. You have seven days in which to cancel this contract without having to give a reason. After the seven days, you must deposit 10% of the sales price with the notary. The deposit will only be returned if the compravanta is cancelled for non-fulfilment of the conditions precedent. Within 3 months of the signing of the compraventa, the final deed should be signed.
