1 School Rules Basic Provisions 1.1 By signing the registration card (the Card ) the legal guardians of the child specified on the Card (the "Client") confirm the accuracy of the information contained therein and familiarity with the School Rules. 1.2 The Operator (Maxíkova jazyková školka a jesle) is fully competent to operate a training-education facility for children of preschool age teaching foreign languages and undertakes to ensure these conditions throughout the term of the contract. 1.3 The signing of the Card creates a contractual relationship between the Client and the Operator (Act no. 89/2012 Coll., the Civil Code). 1.4 The place of this activity is: Maxíkova jazyková školka a jesle, (the Establishment or Preschool ). 1.5 For the avoidance of doubt, the Contracting Parties specifically agree that, in the event that the Client s child participates in Operator s events organized outside the Establishment, the place of such event shall too be considered the Operator s place of business. 1.6 Under the terms and conditions agreed in this Contract, the Operator undertakes to pursue activities aimed mainly at: (a) (b) (c) preschool teaching and language education, didactic-pedagogic care, and looking after the child. 1.7 The Client is interested in the Operator s services and undertakes to pay the Operator a fee for them in accordance with the Card. 2 The Operator s Rights and Obligations 2.1 The Operator must engage professional personnel for teaching 1 and looking after the child at the Preschool at the time scheduled for this. 2.2 The persons teaching and looking after the children must be qualified and competent to carry out these activities. 2.3 Preschool will operate every workday, except Christmas (from to 1.1. of each year). Compensation is not provided for this period (even public holidays). The exception shall involve any day specified in the calendar of school activities. On such days (e.g. a skiing course, field camp, etc.) the Preschool may be closed, unless 1 Professional personnel are understood as persons qualified to teach children of a preschool age at the Preschool and with the relevant practice in this field.

2 at least 5 children above or under three years of age wish to attend the Preschool on that day. The Client will be informed about the closure of the Preschool at least 10 days in advance. If the Preschool is closed due to insufficient number of children wishing to attend the Preschool on such a day, no compensation is provided. 2.4 The school year is the period from to (the "School Year"). 2.5 The Operator will make sure the Preschool operates smoothly even if one or more teachers are ill. The Client acknowledges that teaching by external personnel (e.g. from another branch, etc.) may occur for a temporary period because of, for example, the illness of a teacher. 2.6 The Operator also undertakes that it will observe the children s dietary needs or other special requirements stated in the Card. 2.7 The authorized person 2 collecting the child from the Preschool, or providing information on the child and having any contact with the Client s child is only the Client himself or herself or a person authorized by him or her to do these things. Before the child can be handed over to another person than the Client, the Client must submit an authenticated written power of attorney signed by and granted only to a person of legal age that can take over the child on behalf of the Client. 2.8 The Operator is not liable beyond the legal framework for any valuables, money, mobile telephones, toys, etc. that are brought by the child into the Preschool. The Client must always notify the Operator that the child has a valuable item with him or her and the Operator is entitled at its discretion to require that this item is not brought into the Preschool The Operator is entitled during the school year to declare up to 5 days off for serious organizational and technical reasons. This will be announced, if possible, at least 10 working days in advance. Compensation is not provided. 3 The Client s Rights and Obligations 3.1 The Client undertakes to give the Operator all the facts in the Card that are known to him or her about the state of health of the child and other facts that may influence the health of the child or other factors influencing his or her presence at the Preschool or in other activities. 3.2 The Client undertakes that the child will attend the Preschool healthy, without evident symptoms of any illness. The Client must inform the Operator and/or the personnel of the Preschool without delay of the initial symptoms of any illness, allergy or other indisposition of the child, if any. If evident symptoms of a cold / illness become apparent during the attendance, the Client will be contacted by the Operator s representative with a request to immediately remove the Client s child from the Preschool. 2 The authorized person is understood to be a person that is non-interchangeably specified (the name, date of birthday / birth registration number, relation to the Client) by the Client in the Contract. When collecting children, this person must produce valid proof of his or her identity (identity card etc.). 3 Toys for sleeping (usually child up to 3 years of age) are permitted.

3 If chronic illnesses and/or repeated illnesses of the same nature occur the Operator can ask the Client to prove the state of health of the Child by a Bill of Health of the child issued by a physician. 3.3 The Client undertakes to outfit his or her child with reserve clothes, in particular: (a) (b) (c) (d) general: a track-suit, a T-shirt, a pair of pyjamas, underclothes, socks, overshoes with quality soles and arch supports, a toothbrush, and a cup. in winter: gloves, a scarf, a cap, a winter once-piece suit, a warm jacket, a sweatshirt, tights, and a long sleeve T-shirt. in summer: a peaked cap, a handkerchief, and a pair of sunglasses. other: gum boots; a raincoat; a drinks bottle; drugs, if any; etc. 4 Price The Client also undertakes that he or she will automatically and continuously replace these items with clean ones corresponding to the child s needs (seasons, trips, etc.). Items that are not visibly and non-interchangeably marked with the child s label are brought into the Preschool at the Client s own risk. 3.4 The Client confirms that the child has a compulsory vaccination provided by Act no. 258/2000 Coll., on the protection of public health If the Client wants to change the mode / rate of attending the Preschool, or change of the branch, it is possible to do so after the announcement of the change by to office@maxikovaskolka.cz. At least 1 full calendar month in advance, but always by the 25th day at the latest; (i.e. until February 25 th for a period starting April 1 st ). 4.1 The price for the programme is listed in the Card (the "Fee"). 4.2 If the Client uses an attendance rate of less than 5x a week, the exact days of attendance must be specified The Client must respect the attendance rate In the event that a child uses the Customer Service Preschool beyond the agreed mode, the Client will be charged CZK 75 for every 30 minutes. This does not apply to arrivals / departures: (i) am, (ii) pm and (iii) from pm. 4.3 No registration fee is charged. 4.4 The Fee is guaranteed for the whole School Year. The Fee for services provided to the same extent for individual school years will not exceed 5 percentage points above the rate of inflation announced by the Czech Statistics Office for the preceding calendar year. 4 The hexa first (diphtheria, tetanus, whooping cough, polio, hepatitis B, a disease caused by Haemophilus influenzae t. B).

4 4.5 If any change in the amount of the Fee occurs before the new School Year the Operator undertakes to notify the Client of this at least 30 days before the commencement of the new School Year: (a) by , or (b) on the notice board at the Preschool, or (c) on its web pages. 4.6 The Client acknowledges that the structure and scope of services may differ over time, especially because of the season or the age structure of the children, etc. (e.g. outdoor schooling, ski training, trips to the seaside, alternations of Preschool activities in summer/winter, etc.). 5 Payment Terms 5.1 The Fee is to be paid by the Client automatically, and no later than the on the 10th day of the month for which the Fee is to be paid (the "Period"). The Client s payment obligation is fulfilled in time if the amount that the Client has to pay according to the Card is credited to the Operator's account no later than on the date that is agreed as the due date (even if public holiday). The Client is obliged to provide variable symbol. The variable symbol will be notified to the Client. 5.2 In the case of delay in the payment of the Fee, the Client agrees to pay the Operator a penalty for late payment of 0.1% of the outstanding amount for each day of delay. 5.3 Provided there is no payment even within 10 calendar days after the deadline specified in above, the Operator is entitled to terminate the attendance of the child to Preschool with immediate effect; the Reservation Security (see below) will be forfeited in favour of the Operator as a contractual penalty. 6 Reservation Security 6.1 The Reservation Security (the Security ) is CZK 5,000 per child. The Security is to make sure the Client places the child in the Preschool after concluding the Contract. The Security is accountable within 10 calendar days from the termination of the contractual relationship. 6.2 If, however, the Client terminates the Contract in writing 30 days before the child commences attending the Preschool, the Operator will refund the Client 100% of the Security within 5 days after the delivery of the written termination notice. The 30-day period commences on the first day following the date when the termination notice was delivered to the Operator. If the child is not placed in Preschool in accordance with the Card for reasons attributable to the Client, this is a breach of the Card and the Client will pay the Operator a contractual penalty equal to the Security. The Operator is entitled to set off its claim to the Contractual penalty against the Client s claim for the refund of the Security. 7 Absence The absence can be compensated by exchanging a day for a day (i.e.: morning for morning, afternoon for afternoon, whole day for whole day), provided that: (i) the absence will be reported to the MaxInfo System by the Client no later than by 6.00 pm

5 of the previous day when the absence occurs and (ii) in the period to which the compensation of the absence belongs, the Client is not in arrears with the payment of the Fee. (E.g. February payment until February 10 th (at latest) enables the option to compensate the absence in March.) The replacement day is determined by the Client in the MaxInfo System no later than by 7 pm of the previous day (limited capacity). Compensation of the future absence not available. 7.1 The compensation for absence may be claimed as follows: until until The right to replace the days after and respectively, expires. 7.3 Compensation can only be used entirely in excess of the attendance agreed on the Card for. The right to use the compensation of absence (except for siblings of the child) is not transferable. 7.4 Financial compensation is provided for a long-term absences only. If a long-term (min. 30 days consecutively) curative absence occurs (hospitalization / curative stays in a spa, etc.), the Client is entitled to compensation of 50% of the daily Fee. The Client must prove this type of absence by the relevant certificate from a physician no later than on the day on which the child resumes attendance at the Preschool. The Operator reserves the right to have it verified by a reviewing physician. Financial compensation is accounted (credit note) by the actual length of absence in the following calendar month when the child restarts the attendance to the Preschool. Financial compensation is available in 12 consecutive months once for a period of max. 60 days. 7.5 If a of long-term (planned) absence occurs, the Client is entitled to compensation of 100% of the daily Fee provided that such absence exceeds 30 days continuously and will be reported at least two full calendar months in advance to: manager@maxikovaskolka.cz 8 Terminating the Contractual Relationship 8.1 The Contract is concluded for an indefinite period. 8.2 The Contract can only be terminated: (a) by a termination notice from one of the Contractual Parties without stating a reason with a one month notice period commencing on the first day of the month after the month of the delivery of the termination notice. The termination notice to the Operator is to be sent by registered mail to the address: P.O.Box 74, , Jindřišská 14, Praha 1 Nové Město or by the MaxInfo System.

This data will be processed by the Operator to offer services provided or procured by the Operator. The data will be accessible to the Operator s employees only and will be submitted only to the extent needed by the providers of the services ordered. 9.2 The Client also agrees to have photographs and audio-visual broadcasts taken in the common areas of the Preschool, during activities, trips, etc. and subsequently having them placed on the Operator s web pages or used for the Operator s marketing purposes. 9.3 Operator reserves the right to change School Rules during the school year to the extent appropriate. Such a change will be communicated to clients: (i) on board of Preschool, (ii) website and (iii) by .
