3 Dear women, Violence against women is a serious blight on society, one which requires thorough, urgent, fundamental solutions. According to Ministry of Social Affairs data, there are more than 145,000 battered women in Israel. Violence against women takes a number of forms; physical, sexual, financial and psychological. Victims experience humiliation, suffering, fear and stress to the point where they lose all sense of self. In some cases, many years can go by until women are able to open up, tell others that they are being abused, and take active steps to put an end to it. Within my capacity of Deputy Minister in the Prime Minister s Office of Youth, Students and Women Affairs, and in conjunction with the Authority for the Advancement of the Status of Women, we present you with this booklet, which includes relevant information to help you deal with the violence perpetrated upon you. In this booklet you can find information about centers for preventing and treating domestic violence, emergency help lines, hospital emergency rooms, help and treatment for victims of sexual assault, assistance for women trapped in prostitution, legal aid bureaus, social service bureaus and details about victims rights. 3
4 In recent years it has become widely recognized that it is not up to women alone to fight violence against women in all its ugly manifestations; men, too, have an important role to play in this ongoing battle. Too often, men who are not violent remain silent in the face of other men s violent behavior towards women. It is not enough that women understand that such violence deprives them of their basic rights men must understand it, too. One of the important efforts today is to make men understand and identify with this struggle, and to draw them in as full partners and as an integral part of the effort to eradicate the violence. All of us, men and women alike, must do all in our power to stop violence against women! 5 Legal Rights According to the Prevention of Family Violence Law, , an individual may apply for, and obtain, a court protection order against any family member who behaves violently towards other family members. Violence can be physical, emotional, financial or of a different kind. The protection order may be given in the presence of the applicant alone, but a hearing with both parties present must take place within seven days of issuing the protection order. The protection order can, for example, prohibit the violent person from entering the family s residence, harassing any family member, and so on. According to the Rights of Victims of Offenses Law, the victim of an offense has the right to protection during a trial from the suspect/defendant and his/her close associates, the right to receive information about the aid services offered to victims, the right to receive a copy of the indictment, the right to voice an opinion on any plea bargain with the defendant before a decision is made and, if the convicted offender is about to be released, the victim has the right to voice an opinion regarding the danger that may present. According to the Public Protection From Sex Offenders Law, the authorities must conduct a risk appraisal of sex offenders, and a Monitoring and Surveillance Order can be issued specifying the offender s restrictions, in order to protect the public from repeat sex offenses. 5
6 The Sexual Harassment Law prohibits five types of sexual references. The victim may choose to address the matter through the disciplinary channel in the workplace/school, through the civil channel (by means of a lawsuit) or through the criminal channel (by filing a complaint with the police). The Prevention of Threatening Harassment Law is meant to provide protection when the violence is not physical. Harassment, stalking or threatening to harm a person or his/her friends and relatives is prohibited. When the harasser substantially disrupts the victim s way of life, the victim can request and receive a court order to prevent the threatening harassment. The Human Trafficking Law prohibits holding individuals in slavery conditions for work or services, including sexual services. Victims of trafficking are entitled to free legal aid, the court is entitled to order seizure of the offender s assets and use the money to compensate the victims. The Employment of Women Law prohibits firing a female employee who is staying in a shelter for battered women. 6
7 The Legal Aid department, through legal aid bureaus throughout the country, provides guidance, legal counseling and representation in the presence of both parties on civil issues, including in cases in which a protection order, an order for protection against threatening harassment or a restraining order is issued. The legal aid bureau also helps any woman to filie a lawsuit, on her own behalf or on behalf of her children, to prohibit her husband from living in the family s home on grounds of physical or emotional/psychological violence, threat or cruelty, which prevent the woman and her children from living in peace. The legal aid bureaus throughout the country are also constantly in touch with shelters that require legal aid. They provide legal aid to victims of human trafficking in matters pertaining to proceedings under the Entry into Israel Law, or civil proceedings stemming from human trafficking offenses, all without the women having to pass any test of financial eligibility. 7
