Lockwood called the regular meeting of the Delaware Township Committee to order on June 13, 2016, at 7:30 p.m., at the Delaware Township Municipal Building, 570 Rosemont Ringoes Road (County Route 604) in Sergeantsville, New Jersey. PLEDGE OF ALLEGIANCE All present recited the Pledge of Allegiance. NOTICE REQUIREMENTS Ms. Lockwood read a statement noting that the Notice Requirements, provided for in the Open Public Meetings Act, have been satisfied. Notice of this meeting was properly given by transmission to the Hunterdon County Democrat, Lambertville Beacon, Trenton Times, Courier News, and Star Ledger, by posting at the Delaware Township Municipal Building, and by filing with the Township Clerk all on January 6, ROLL CALL Present: Susan Lockwood, Alan Johnson, Samuel Thompson Absent: Charles Herman, Joe Vocke Also Present: Kristina P. Hadinger, Esq. APPROVAL OF MINUTES FROM THE REGULAR MEETING ON MAY 31, 2016 Mr. Thompson moved to approve the minutes from the regular meeting on May 31, Mr. Johnson seconded the motion, and members unanimously approved the minutes as written. MEETING OPEN TO THE PUBLIC FOR COMMENTS ON AGENDA ITEMS ONLY No comments were made Add on Agenda item: Pastor Jessica Stenstrom from Sergeantsville United Methodist Church requested permission from the Township Committee to use the Village Green for an interfaith vigil for the Violence in Orlando and also, all the violence in general. Pastor Stenstrom has reached out to the Delaware Twp. Police and fire department. The fire department gave them permission to have parking for this event in their back lot. Pastor Stenstrom will be reaching out to other churches in the area to also participate in this event. Mr. Thompson moved to approve this use of the Village Green. Mr. Johnson seconded the motion, and members unanimously approved the motion. ORDINANCE # TO INCREASE THE PLENARY LIQUOR LICENSE PERMIT FEE TO DELAWARE TOWNSHIP FROM $2,400 TO $2,500 BEGINNING WITH LICENSING TERM ORDINANCE # Ms. Lockwood read the following ordinance by title on first reading.

2 Page 2 This Ordinance authorizes to increase the plenary liquor license permit fee to Delaware Township from $2,400 to $2,500, beginning with licensing term and adds a fee for a retail distribution license if we choose to have one. DELAWARE TOWNSHIP ORDINANCE # AN ORDINANCE OF THE TOWNSHIP OF DELAWARE, COUNTY OF HUNTERDON AND STATE OF NEW JERSEY AMENDING AND SUPPLEMENTING SECTION (LIQUOR LICENSE FEES) OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF DELAWARE. # BE IT ORDAINED AND ENACTED AS FOLLOWS by the Mayor and Township Committee of the Township of Delaware, County of Hunterdon and State of New Jersey: Section 1. Section License Fees - Maximum Number shall be repealed in its entirety and replaced as follows: License Fees - Maximum Number. The annual license fees and maximum number of licenses for the sale or distribution of alcoholic beverages in the Township of Delaware shall be as follows: Class of License Annual License Fee Number of Licenses Plenary Retail Consumption License $2, Retail Distribution License $2, Club License $ The provisions of this subsection with respect to the limitation on the number of licenses shall not apply to the renewal or transfer of licenses presently issued. This ordinance authorizes the municipal clerk to issue licenses and permit games of chance. DELAWARE TOWNSHIP ORDINANCE # AN ORDINANCE OF THE TOWNSHIP OF DELAWARE IN THE COUNTY OF HUNTERDON, NEW JERSEY AMENDING "THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF DELAWARE TO ADD NEW SECTION 4-6 GAMES OF CHANCE, OF THE CODE OF THE TOWNSHIP OF DELAWARE, NEW JERSEY, TO AUTHORIZE THE MUNICIPAL CLERK TO ISSUE LICENSES AND PERMIT GAMES OF CHANCE. BE IT ORDAINED by the Mayor and Council of the Township of Delaware in Hunterdon County, New Jersey as follows: Section 1. Section 4-6. The Revised General Ordinance of the Township of Delaware, 1985 are hereby amended to add the following new section to read as follows: 4-6 GAMES OF CHANCE

4 4-6.1 A license pursuant to may be issued for any day of the year without limitation as provided by N.J.S.A. 5:8-31 and N.J.S.A. 5: The Municipal Clerk is hereby designated as the issuing authority and is delegated the authority to approve the issuance of licenses. All complete applications for a license must be filed with the Municipal Clerk together with the required fees pursuant to law June 13, 2016 Page 4 The Municipal Clerk shall refer applications at the Clerks discretion to the Township Committee. Section 2. Repealer. All ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed for review and approval. Section 3. Severability. If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate and independent provision and shall not affect the validity of the remaining portions hereof. 5 Page 5 Roll Call Vote: Ayes Thompson, Johnson, Lockwood Second reading and the public hearing for Ordinance # will be held on Monday, June 27, 2016, at 7:30 p.m. PROPOSED ORDINANCE TO AMEND HAWKERS AND PEDDLERS ORDINANCE DISCUSSION AND REFERRAL TO TOWNSHIP ATTORNEY Mayor Lockwood gave a summary of what the status is on the verbiage needed to complete this ordinance. A discussion ensued, with the Township Committee, on how to create additional language to include consequences or restrictions when the background check comes back with a violation. This discussion also included how to have the Hawkers and Peddlers become responsible for the fees of the background checks. Attorney Hadinger reviewed the issue and would like to create the revised ordinance to also include the protocol on how to handle a violation for the required background check. Attorney Hadinger reviewed, with the Township Committee, the restrictions that are required if a veteran requests to use the Hawkers and Peddlers privilege. The veteran does not need to fill out an application; they must only let the police department know of their Peddling. The Veteran is also exempt from fees for the permit. RESOLUTION # TO AUTHORIZE THE REPLACEMENT REGISTRAR Members reviewed the following Resolution. DELAWARE TOWNSHIP RESOLUTION # WHEREAS, Judith A. Allen, CMR currently serves as the Delaware Township Registrar of Vital Statistics; and and WHEREAS, Judith A. Allen s appointment as Registrar terminates on January 30, 2018; WHEREAS, Delaware Township has fewer than 5,000 residents according to the most recent Census report. Therefore, the Township Clerk serves as Registrar pursuant to N.J.S.A. 26:8-11; and WHEREAS, Delaware Township Committee desires to name a replacement Registrar. NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Delaware, County of Hunterdon and State of New Jersey hereby appoints Jodi

DELAWARE TOWNSHIP RESOLUTION # WHEREAS, the Township Committee of the Township of Delaware, County of Hunterdon and State of New Jersey has reviewed an application for renewal of a Plenary Retail Consumption license for the twelve month period ending June 30, 2017 for the following licensed premises: And Blackdog, Inc. Trading as the Sergeantsville Inn 601 Rosemont Ringoes Road Sergeantsville, New Jersey License # SonTort Food Services, LLC Trading as Brunello Trattoria Bar & Restaurant 300 Old Croton Road Flemington, NJ License# WHEREAS, no timely written objection has been filed with the office of the Delaware Township Clerk related to these licensed premises. NOW, THEREFORE, BE IT RESOLVED that the Delaware Township Committee does hereby grant a one-year renewal to both of the above listed licensed premises. Roll Call Vote: Ayes Thompson, Johnson, Lockwood SCHOOL BUS SHELTERS ROBIN HILL II DEVELOPMENT REQUEST FOR REPAIRS/REPLACEMENT Mayor Lockwood gave a summary of how the bus shelters originally came to exist in the Robin Hill development. The bus shelters were the alternative to placing sidewalks throughout the development. These bus shelters need repairs or replacements at this time. Mr. Johnson commented that Jay Trstensky has been advised and is currently working on storm drain repairs in Robin Hill, and will add the repairs for the bus shelters to be done. Mr. Johnson proposed that a letter be sent to the school system to see if they would contribute towards the repairs and replacements of these bus shelters. Mayor Lockwood commented that this was an agreement, when the sidewalks were not placed in Robin Hill, that Township would take over maintenance and replacement. Mr. Johnson suggested that we reevaluate the shared service agreement with the school system. Mayor Lockwood agreed that this might be a good idea to review and make future changes to the shared service agreement. Mrs. Allen reminded the Committee that this agreement was just renewed in December. Mr. Johnson stated that it has been around 6 or 7 years since the bus shelters have been repaired. Mayor Lockwood asked where the funding for this project will be coming from? Mr. Johnson stated that he will reach out to the school system to see if they will be willing to help with the cost of these repairs. The money is already part of the budget. Mr. Johnson moved to approve DPW to make repairs to the shelters. Mr. Thompson seconded the motion, and members unanimously approved by roll call vote. 9 Page 9 SEVERNS WAY EASEMENT ISSUES RECOMMENDATION FROM ENVIRONMENTAL COMMISSION Attorney Hadinger stated that she has reviewed the situation and the filed map reflects the open space area, and that is a recorded instrument. There was a Homeowners Association created. She has not seen the homeowner association documentation, but this also should have been recorded. The Homeowner s Association documents should have included in them the maintenance of these easements. The Townships ordinance, regarding open space standards, addresses open space maintenance and what can take place in those areas. It also addresses what the Homeowners Association is required to do with the open space. She has not seen the associated Homeowner Association documents, but if they have been done in conjunction with the Planning Board resolutions, then it is open space, and it needs to be maintained in a fashion consistent with the ordinance. The Homeowners Association should be involved in doing so. Mayor Lockwood stated that they did not ever mention that they had a Homeowners Association. Ms. Klink stated that it is a recorded document. Ms. Klink was able to locate the Homeowners Association document, and Attorney Hadinger took the document to review it. Mayor Lockwood again expressed that the Severns Way residents never mentioned a homeowners association. Is this Homeowners Association functioning? James Waltman, Severns Way, stated that the Homeowners Association will be in effect once a certain percentage of homes are sold in this development. It is his understanding that this percentage, at this time, has not been reached. Attorney Hadinger stated that the Homeowners Association should have filed a recorded master deed. This will explain what the responsibilities are and then everyone is subject to them. Until this Homeowners Association document is filed, then the Developer would be required to be responsible for the open space in a fashion that is in conjunction with the ordinance. James Waltman asked what is the number of the ordinance, and where could they find this ordinance? Attorney Hadinger stated that it is 11:12.2 through 11:12.4. This is in the Township Land Use Regulations. This section is three pages long. Chris Simone thanked the Attorney since they have been looking for this for 2 ½ years. Mayor Lockwood asked what we can do next. The reason this issue arose is because some of the residences have been using this open space area for other purposes, other than open space. Residents are asking for clarification on what they are allowed to do with this area.

10 Page 10 Attorney Hadinger stated that the Township could take enforcement action if it wished to do so. The first step is to have an educational process so that the residents know what they are allowed to do as well as not to do and to review the standards. James Waltman stated that the residents on the North side of the development have septic systems in the easement area. What would the restriction be to maintain this area so that the overgrowth does not interfere with the septic system? Attorney Hadinger stated that this would be an exception to the open space ordinance since this is something that would need to be done due to the septic system placement. Attorney Hadinger suggested that they follow the septic system maintenance protocol so that they do not have any septic issues in the future. The Open Space other than where the septic systems are should be left to their natural state. Mr. Johnson asked if there was an amendment in the ordinance when it comes to invasive species. Attorney Hadinger stated that there is not an exception for invasive species in the Ordinance and that if this was needed the Planning Board would make the amendment to the application. Attorney Hadinger will do research on when the Homeowner Association is taking the development over from the developer. REQUEST FROM VAN HOLTEN VI, LLC MEADOW VIEW SEVERNS WAY FOR EXTENSION OF TIME PERIOD TO COMPLETE THE INTERIOR SIDEWALKS UNTIL SEPTEMBER 15, SEVERNS WAY RECOMMENDATION FROM PLANNING BOARD Mayor Lockwood stated that the Planning Board sent a recommendation letter for Severns Way. This recommendation suggested that the developer have an extension for the sidewalk placement untill October 1, The application to remove the sidewalks will be submit at that time. Residents do not want the sidewalks that the developer has planned on putting in throughout the development. We need to approve this deadline for extension or deny this extension. Mr. Thompson asked what other choices do we have other than extending this application deadline? Mr. Johnson is concerned that they have already missed the last deadline and this is not a good standard to follow. Mayor Lockwood stated that the application might not be approved by the Planning Board once they receive the application in October. There are no guarantees. Mr. Thompson moved to approve the Planning Board recommendations to extend the deadline untill October 1, Mr. Johnson seconded the motion, and members approved by roll call vote.

11 Page 11 Roll Call Vote: Ayes Thompson, Lockwood Nays and abstain Johnson DILTS FARM PARK UPDATE ON HERBICIDE/ PESTICIDE APPLICATION REPAIRS TREE REMOVAL, WALKING TRAIL, SPEED BUMPS, PARKING LOT GRAVEL, FIELD MIX, SIGNAGE, SIGNAGE, ETC. Mr. Johnson gave the following report on Dilts Park: The spraying of fields and trail was done by a third party named True Green. They have been told to cease in spraying in the future until this issue can be resolved. Mr. Herman spoke with the school and they also never knew that the fields were going to be sprayed. Mr. Trstensky has sent an asking the company to put a hold on spraying until further notice. Mr. Johnson stated that the company was cooperative with sending fact sheets on what was sprayed. There have been flags ordered to place out when and where spraying has been done as well as posted signage at the entrance of the park that spraying has been done with the date when the fields and park can be re-opened for the future. Mayor Lockwood would like to track down the original contract. How did the Township establish a relationship with the contractor? We should not be paying them for this spraying. Mr. Thompson suggested that the Supervisor from True Green attend a Township Committee meeting to discuss the spraying issue and other items. Mr. Johnson stated that the Shade Tree Committee will be scheduling a visit to review the trees in the park. The gravel will be revisited once the trees, that will need removal from the park, are taken down and the excess money will be going toward the gravel in the budget. FIRE SAFETY ALARM SYSTEM UPDATE ON PURCHASE AND INSTALLATION Mr. Johnson will be additional updating on the Fire Safety System at the June 27, 2016 meeting. Mr. Johnson spoke with Mr. Trstensky, and the wiring for the strobe lighting should be adequate for the fire system. PROPOSED TAX BILL INSERT - The Board of Health has presented a sample of the increase in animal fees for 2017 year. Ms. Allen will make up a short version of the Emerald Ash Borer insert to warn residents of this borer that destroys trees. There will also be information from the Recreation committee. NJLM CONFERENCE NOVEMBER 15 TH, 16TH AND 17 TH Mr. Johnson has concerns on the expense and the attendance for this event. Mr. Johnson is concerned with closing the Municipal Building and would prefer that there is still coverage.

12 Page 12 Mayor Lockwood asked if the building was closed last year and suggested that attendees write a summary of what they attended as well as what was discussed. Ms. Allen commented on the choices of hotels. Some prefer Caesars and some preferred the Tropicana. The pricing and location of hotels was discussed. Mrs. Allen stated that the building was closed last year, so the employees were able to attend the event. Mr. Johnson would like to see if an employee works with other municipalities that they share in the expense of the conference. The Township Committee discussed the other options to as to who should be attending, and the number of days that will be required. REVIEW OF MEETING DATES The Township Committee discussed the option of having one meeting in both July and August. The decision to table the discussion and decision was made for the June 27, 2016 Township Committee meeting, so that all the members can have input on the date for these two meetings. Add on item Ms. Allen added an item to the Township Committee for the appointment of Jim Vena as an advisor to the Board of Health Committee. Mr. Johnson moved to approve the appointment of Jim Vena as an advisor to the Board of Health Committee. Mr. Thompson seconded the motion, and members approved by roll call vote. Roll Call Vote: Ayes Thompson, Lockwood, Johnson Mrs. Allen requested that a letter be completed by the Township Committee allowing Mrs. Allen a sick-time payout of the cap of $5, for unused sick time. Mr. Johnson moved to approve the letter to be written to allow Mrs. Allen the sick time payout of $5, Mr. Thompson seconded the motion, and members approved by roll call vote. Roll Call Vote: Ayes Thompson, Lockwood, Johnson The Township Committee reviewed the upcoming meetings and events list. 20. COMMENTS OF THE COMMITTEE Mr. Thompson announced that there will be a joint meeting between the Delaware River Basin Commission and the Pipeline activists at Lower Bucks County, at the Washington Crossing, at

13 Page 13 10:00 a.m. on June 15, The Pipeline Activists will be asking to have one meeting per township that is being affected by the pipeline. Mr. Thompson thanked all that had distributed the material safety sheets and passed them out to the snack shack as well as to the other organization to give them the information about the chemicals that where sprayed at the park and school. There seems to be additional work that will be needed to be done to solve this issue. Mr. Johnson apologized to Kathy Klink since her proposal to the Township Committee could not be discussed due to conflict of interest. This topic will be rescheduled for the June 27, 2016 Township Meeting. Mr. Johnson has been trying to make a phone connection to speak with Leslie Sauce regarding the 523 Drainage and he has not been able to speak with her at this time. Mr. Johnson asked Attorney Hadinger when she would be coming back to see us? Mayor Lockwood stated that the goal was to have Attorney Hadinger attend once a month. Mayor Lockwood would think Attorney Hadinger would be attending the July 25 th meeting. Attorney Hadinger would prefer the July 25, 2016 meeting date. Mr. Johnson is concerned with the situation of the sidewalks, and this concern has been brought up, once again, as a topic, he noted we had an issue earlier this year where the residents on Jurgenson Road has complained about the lack of the turnaround, and the residents of Severns Way felt that it was a sidewalk that is going nowhere. We have been trying to develop a sidewalk plan that would be comprehensive in moving people around in the Village; however, the Sergeants Green Development was designed and met the Planning Board approval. Mr. Johnson has concerns about the exception to the performance bond requirement that a previous committee adopted. Mr. Johnson believes that it does save the developers a significant amount of cash each year, and does not serve a beneficial purpose to the Township, since the performance bond would be protecting the Township. Mr. Johnson would like to investigate whether we can overturn the agreement that is in place, or become a party on the mortgage. Mr. Johnson would like to be consistent on how we deal with developments. Mr. Johnson would like to have a performance bond just like any other developer has. Mr. Johnson would like to have Attorney Hadinger review this agreement and investigate if we can rescind the agreement with the requirement of the performance bond on the developer for Sergeants Green. Attorney Hadinger stated that it is hard to just break the agreement when the two parties have met. Attorney Hadinger recalls that there is a mortgage on this property and therefore a regular performance guarantee must be in place. Mr. Johnson is concerned that with this not being developed that this will leave a void in the Township s plan. Attorney Hadinger asked Mr. Johnson if the plan is to still development this land, or is this just being delayed?

14 Page 14 Mr. Johnson responded that to the developer if there was plans to develop was asked this land in the next two years, and the answer was no. Mr. Thompson commented that agreements were made for Hamlet as well as Severns Way, based on there being a thorough fare, assuming that there would be traffic cutting through. Residents now want a turnaround at this location since there is not the ability to pass through. Attorney Hadinger commented that it is hard to have all the developments go through at the same time. Going forward, what is in the best interest of the town in the future? Mayor Lockwood stated that with the Severns Way Outlet, we made sure that the exits from Rittenhouse would line up on either side. The planning Board did not want a cul-de-sac. Mr. Johnson is concerned that they have very little incentive to move on what was planned. Mayor Lockwood stated that other than the roads not lining up, she feels that this is not hurting the Township in anyway. Mr. Thompson would like the Township Committee just to review the agreement and check for deadlines, as well as, any stipulations, instead of having the attorney review this agreement. Attorney Hadinger stated that there is a mortgage on this property, and that once work begins the property must be replaced with bonds. Mr. Johnson stated that Mr. Herman was in contact with the school. He was told that they were not informed about the spraying and that they had a field day scheduled for the next day. Mr. Cline asked Attorney Hadinger if the deed, with Severns Way was necessary or not? Attorney Hadinger stated that it is not necessary; it would be nice to have this in the deeds. RESOLUTION TO GO INTO EXECUTIVE SESSION TO DISCUSS ITEMS OF ANTICIPATED LITIGATION, ADVICE OF COUNCIL FOR AFFORDABLE HOUSING MATTER, VOLUNTEER AND EMPLOYEE OF THE YEAR RESOLUTION AUTHORIZING CLOSED SESSION DELAWARE TOWNSHIP COMMITTEE WHEREAS, Section 8 of the Open Public Meetings Act N.J.S.A. 10:4-12 (b) (1) et seq. permits the exclusion of the public from a meeting in certain circumstances; and WHEREAS, the Delaware Township Committee is of the opinion that such circumstances exist. NOW, THEREFORE, BE IT RESOLVED by the Delaware Township Committee as follows: 1. The public shall be excluded from discussion related to the closed session on June 13, The general nature of the subject matter to be discussed involves any pending or anticipated litigation or contract negotiation in which the public body is or may become a party. In this case the Township Committee will discuss anticipated litigation with property owners in connection with zoning matters. 3. Any matter involving pending or anticipated litigation or contract negotiation in which the public body is or may become a party and any matter falling within the attorneyclient privilege to the extent that confidentiality is required to preserve the attorneyclient relationship may be discussed in closed session pursuant to N.J.S.A. 10:4-12(b)(7). 4. The general nature of another subject matter to be discussed involves personnel matters related to the employment, appointment or termination of current or prospective public employees, unless all individuals who could be adversely affected request, in writing, that

16 the matter be discussed at a public meeting. The Committee will discuss items of personnel, namely, the positions of Planning Board Administrative Officer and Administrative Assistant.
