OPEN DATA WHEREVER POSSIBLE AND LEGALLY PERMISSIBLE, IT IS THE POLICY OF THE STATE THAT DATA HELD BY A STATE ENTITY BE OPEN AND MACHINE READABLE AND RELEASED TO THE PUBLIC IN WAYS THAT MAKE THE DATA EASY TO FIND, ACCESSIBLE, AND USABLE (A) IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS INDICATED. (I) (1) OPEN DATA MEANS DATA THAT IS COLLECTED BY A STATE ENTITY WHERE THE UNIT IS PERMITTED, REQUIRED OR ABLE TO MAKE THE DATA AVAILABLE TO THE PUBLIC CONSISTENT WITH ANY AND ALL APPLICABLE LAWS, RULES, REGULATIONS, ORDINANCES, RESOLUTIONS, POLICIES, OR OTHER RESTRICTIONS, REQUIREMENTS OR RIGHTS ASSOCIATED WITH THE DATA. (2) OPEN DATA INCLUDES CONTRACTUAL OR OTHER LEGAL ORDERS, RESTRICTIONS, OR REQUIREMENTS. (3) OPEN DATA DOES NOT INCLUDE DATA THAT BY BEING MADE PUBLIC WOULD: 3

(K) STATE ENTITY MEANS A DEPARTMENT, BOARD, COMMISSION, AGENCY, OR A SUBUNIT IN THE EXECUTIVE BRANCH OF STATE GOVERNMENT (A) (B) THERE IS A COUNCIL ON OPEN DATA. (C) IF A MEMBER OF THE COUNCIL LISTED IN SUBSECTION (B)(1) THROUGH (24) OF THIS SECTION IS UNABLE TO ATTEND A MEETING OF THE COUNCIL, THE MEMBER MAY DESIGNATE THE CHIEF INFORMATION OFFICER OR ANOTHER SENIOR MANAGEMENT STAFF MEMBER OF THE AGENCY OR ORGANIZATION TO ATTEND THE MEETING. (D) OF THE FIVE ELECTED OFFICIALS OR EMPLOYEES FROM LOCAL ENTITIES APPOINTED BY THE GOVERNOR, ONE SHALL REPRESENT EACH OF THE FOLLOWING GROUPS OF COUNTIES: 6
7 (1) ALLEGANY COUNTY, FREDERICK COUNTY, GARRETT COUNTY, AND WASHINGTON COUNTY; (2) CAROLINE COUNTY, CECIL COUNTY, DORCHESTER COUNTY, KENT COUNTY, QUEEN ANNE S COUNTY, SOMERSET COUNTY, TALBOT COUNTY, WICOMICO COUNTY, AND WORCESTER COUNTY; (3) ANNE ARUNDEL COUNTY, CALVERT COUNTY, CHARLES COUNTY, AND ST. MARY S COUNTY; AND (4) MONTGOMERY COUNTY AND PRINCE GEORGE S COUNTY; (5) BALTIMORE CITY, BALTIMORE COUNTY, CARROLL COUNTY, HARFORD COUNTY, AND HOWARD COUNTY. (E) (1) THIS SUBSECTION APPLIES TO MEMBERS OF THE COUNCIL APPOINTED UNDER SUBSECTION (B)(28) AND (29) OF THIS SECTION. (2) THE TERM OF A MEMBER IS 2 YEARS, EXCEPT THAT FIVE MEMBERS MAY SERVE AN INITIAL 3 YEAR TERM AS REQUIRED BY THE TERMS PROVIDED FOR STAGGERING MEMBERS OF THE COUNCIL ON JULY 1, (4) AT THE END OF A TERM, A MEMBER CONTINUES TO SERVE UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES. (5) A MEMBER WHO IS APPOINTED AFTER A TERM HAS BEGUN SERVES ONLY FOR THE REST OF THE TERM AND UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES. TERMS. (6) A MEMBER MAY NOT SERVE MORE THAN TWO CONSECUTIVE (7) THE GOVERNOR MAY REMOVE A MEMBER FOR NEGLECT OF DUTY, INCOMPETENCE, OR MISCONDUCT. (F) (1) THE SECRETARY OF THE DEPARTMENT OF INFORMATION TECHNOLOGY IS THE CHAIR OF THE COUNCIL. 7
8 (2) THE DIRECTOR OF THE GOVERNOR S STATESTAT OFFICE IS THE VICE CHAIR OF THE COUNCIL. (G) THE STAFFING RESPONSIBILITIES OF THE COUNCIL SHALL BE SHARED BY THE DEPARTMENT OF INFORMATION TECHNOLOGY, THE GOVERNOR S STATESTAT OFFICE, AND ANY OTHER STAFF DESIGNATED BY THE GOVERNOR. (H) THE COUNCIL MAY ESTABLISH WORK GROUPS AS NECESSARY TO COMPLETE THE DUTIES OF THE COUNCIL. (I) THE COUNCIL SHALL MEET AT LEAST TWICE EACH YEAR (A) THE COUNCIL SHALL: (1) PROVIDE GUIDANCE FOR: PORTAL; (I) A MAPPING AND GEOGRAPHIC INFORMATION SYSTEMS (II) THE MARYLAND STATE DATA CENTER WEBSITE; AND (III) AN OPEN DATA PORTAL; AND (2) OTHERWISE PROMOTE THE OPEN DATA POLICY ESTABLISHED UNDER OF THIS SUBTITLE BY: (I) DEVELOPING OPEN DATA PROCEDURES AND GUIDANCE; (II) 1. IDENTIFYING: INVESTING IN OPEN DATA; AND A. THE COLLECTIVE COST OF OPERATING AND DEVELOPING A BUDGET THAT DESCRIBES; AND B. FUNDING TO SUPPORT OPEN DATA AND 8

ADVISING THE GOVERNOR AND GENERAL ASSEMBLY ON BUDGET MATTERS RELATED TO OPEN DATA; (III) PROMOTING THE SHARING OF OPEN DATA WHILE TAKING INTO ACCOUNT PRIVACY AND SECURITY CONCERNS; (IV) APPOINTING AND ASSIGNING APPROPRIATE STAFF TO OVERSEE THE DEVELOPMENT, MAINTENANCE, USE, AND PROMOTION OF OPEN DATA, INCLUDING FOR THE MAPPING AND GEOGRAPHIC INFORMATION SYSTEMS PORTAL, THE MARYLAND STATE DATA CENTER WEBSITE, AND THE OPEN DATA PORTAL; (V) PROVIDING GUIDANCE ON OPEN DATA POLICIES, STANDARDS, AND OTHER DELIVERABLES; (VI) PROMOTING, ADVERTISING, AND MARKETING THE APPLICATIONS, CAPABILITIES, BENEFITS, AND RESULTS OF OPEN DATA; (VII) ESTABLISHING PURCHASING GUIDELINES FOR STATE ENTITIES TO USE WHEN BUYING OR PROCURING THE CREATION OF DATA PROCESSING DEVICES OR SYSTEMS THAT ENHANCE ACCESSING, STORING, AND TRANSFERRING DATA IN ACCORDANCE WITH GENERALLY ACCEPTED OPEN FORMATS; (VIII) INVITING AND ENCOURAGING LOCAL ENTITIES TO POST DATA TO THE OPEN DATA PORTAL AND OTHERWISE ADOPT THE POLICY ESTABLISHED UNDER OF THIS SUBTITLE; AND (IX) ESTABLISHING A PLAN FOR PROVIDING ALL OPEN DATA TO THE PUBLIC AT NO COST Article State Finance and Procurement WHEN A STATE ENTITY BUYS OR PROCURES THE CREATION OF A DATA PROCESSING DEVICE OR SYSTEM, THE DEVICE OR SYSTEM SHALL COMPLY WITH GENERALLY ACCEPTED OPEN FORMATS FOR ACCESSING, STORING, AND 9
10 TRANSFERRING DATA AS ESTABLISHED IN PURCHASING GUIDELINES UNDER OF THE STATE GOVERNMENT ARTICLE. SECTION 2. AND BE IT FURTHER ENACTED, That the initial terms of the members of the Council on Open Data that were appointed by the Governor in 2014 as required by (b)(28) and (29) of the State Government Article shall expire as follows: (1) three members appointed under (b)(28) of the State Government Article and two members appointed under (b)(29) of the State Government Article in 2016; and (2) two members appointed under (b)(28) of the State Government Article and three members appointed under (b)(29) of the State Government Article in SECTION 3. AND BE IT FURTHER ENACTED, That this of the State Finance and Procurement Article as established by this Act shall be construed to apply only prospectively to the purchase of new data processing devices and systems as they are needed and may not be applied or interpreted to have any effect on or application to any procurement of a data processing device or system before the effective date of this Act or require the purchase of a new data processing device or systems until replacement of a data processing device or system in use on the effective date of this Act is necessary. SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall take effect July 1,
