2 HIPAA Breach Issues... Lessons from the Trenches This program will provide an overview of the current state of HIPAA and HITECH breach analysis and notification requirements based on the 2013 HIPAA Omnibus final rule. Ms. Watson will discuss the new definition of breach and the new risk assessment standard and factors, provide examples of breaches and appropriate measures to take in response to a breach or potential breach, and offer best practices in responding to Office of Civil Rights (OCR) investigations with examples of recent OCR Breach Enforcement Actions. 1. Understand the laws and regulations that relate to privacy and security in a health care environment. 2. Determine the benefits of Cyber Liability Insurance in the event of a potential breach. 3. Identify best practices for documenting breach analysis, internal breach response, and potential patient notification. 4. And yet, many of us are still being trained or work in settings where problems continue to be the norm. Those problems may involve issues with: 1. Hierarchy; 2. Communication; 3. Conflict resolution; 4. Failure to develop a shared mental model; or, 5. Failure to practice as a team for clinical emergencies. In this program, Dr. O'Connell will explore the behaviors seen in highly functioning teams, then describe, demonstrate, and question how these behaviors and attitudes can be incorporated into your own work settings. 1. 6 Speakers Michelle M. Watson, JD Attorney/Partner, Gilliland & Hayes, LLC, Wichita, KS Ms. Watson's major areas of law practice include health care law and professional liability defense litigation. She has many years' experience advising health care clients in the areas of regulatory matters, HIPAA/HITECH, medical staff issues, risk management, and compliance issues. She has presented to several organizations on HIPAA, HITECH, data breach, and health care privacy. She also represents hospitals, clinics, and physicians in litigation in state and federal court as well as in front of professional oversight and licensing agencies. She is a member of the Kansas Association of Hospital Attorneys, Kansas Association of Defense Counsel, American Health Lawyers Association, and recently authored the Kansas chapter of the AHLA publication, "Data Breach Notification Laws: A Fifty-State Survey." Pat Iyer, RN, MSN, LNC Legal Nurse Consultant & President, Med League Support Services, Inc. Ms. Iyer is a certified legal nurse consultant with extensive experience assisting attorneys with professional liability and personal injury cases. She is president of Med League Support Services, Inc., a 25-year-old independent legal nurse consulting firm. She is past president and current member of the American Association of Legal Nurse Consulting (AALNC). This group consists of self-employed legal nurse consultants, as well as those who work in insurance companies and law firms. She was given AALNC's Lifetime Achievement Award in She is a current member of the American Nurses Association and a member of the American Association of Healthcare Risk Management. Along with three other editors, she was the chief editor of Nursing Malpractice, 4th edition, published by Lawyers and Judges Publishing Company. Yolanda Sims, JD, MHA Loss Prevention & Risk Management Advisor, KaMMCO Ms. Sims provides KaMMCO members with an understanding of loss prevention and risk management issues in the health care field through education and information based on legal research. She interacts daily with a broad array of health care providers and administrators from hospitals, health systems, and physician practices that seek risk advice on various matters such as health information privacy, federal and state regulatory requirements, and policy development. Ms. Sims holds a joint degree, (JD/MHA) from St. Louis University, School of Law and School of Public Health with a certification in Health Law. She is a member of the Kansas and Missouri Bar Associations, the American Society for Healthcare Risk Management, and the Association of Corporate Counsel.

He is a consultant to The Institute for Healthcare Communication and serves on the faculty of the Foundation for Medical Excellence. He teaches in the Residency Programs at the University of Washington School of Medicine, and for residents and attending physicians at the University of California, Los Angeles. He maintains a coaching and consulting practice working primarily with health care organizations and individual providers on all aspects of the psychology of medicine, leadership in health care settings, and professional interactions.
