1 Florida Department of Environmental Protection PETROLEUM CLEANUP ELIGIBILITY November 14, 2011 Since 1996, the Florida Legislature has created five different programs under which a discharge of petroleum or petroleum products from a stationary petroleum storage system may be eligible for State-funded cleanup assistance from the Inland Protection Trust Fund (IPTF): Early Detection Incentive Program (EDI) Petroleum Liability and Restoration Insurance Program (PLRIP) Abandoned Tank Restoration Program (ATRP) Petroleum Cleanup Participation Program (PCPP) Innocent Victim Petroleum Storage System Restoration Program (IVP) 2 1

2 With a few exceptions, section , F.S. requires that cleanup funding from the IPTF be Preapproved : For the Scope of Work and Cost In Priority Order Within Available Budget When funding is available, the Department will ask the current real property owner or responsible party who has an RP agreement with that owner to submit a Contractor Designation Form (CDF) to select a: State Cleanup Contractor; or Specific Preapproval Contractor Qualified Pursuant The Early Detection Incentive Program (EDI) was authorized in section (9), F.S. as part of the State Underground Environmental Response (SUPER) Act of 1986: First Eligibility Program Application Period From 7/1/86 to 12/31/88 Amnesty Covered Pre-Existing Contamination No Deductible No Limit on Funding (Cap) to section (2)(b), F.S

3 The Petroleum Liability and Restoration Insurance Program (PLRIP) was authorized in section , F.S.: Required Application and Proof of Third Party Liability Coverage and Excess Restoration Coverage Prior to Discharge (few exceptions) Covers Discharges Reported 1/1/89 to 12/31/98 Deductible Varies From $500 to $35,000 Based on Date Discharge Reported and Other Factors Funding Cap Varies From $300,000 to $1.2 M Based on Date Discharge Reported and Other The Abandoned Tank Restoration Program (ATRP) was authorized in section (6), F.S.: Application Period From 7/1/90 to 6/30/96 (extended for owners financially unable to comply with tank closure requirements) Must Have Ceased Business of Petroleum Products Storage at Facility on or Before 3/1/90 Petroleum Storage System Must be Properly Closed $500 Deductible No Funding Cap 5 6 Factors 3

4 The Petroleum Cleanup Participation Program (PCPP) was authorized in section (13), F.S.: Covers Discharges Occurring Prior to 1/1/95 Disch. Report Pre 1/1/95 Serves as Application Could Submit Application Until 12/31/98 for Discharge Discovered After 12/31/94 (but must prove it occurred prior to 1/1/95) Requires Limited Site Assessment to be Performed at Owners Expense No Deductible 25% Cost Share The Innocent Victim Petroleum Storage System Restoration Program (IVP) was authorized in Section , F.S.: Site Can be Considered for Eligibility in ATRP Program ( (6), F.S.) After the 6/30/96 Deadline if Owner Acquired Prior to 7/1/90 and Ceased Operating as a Petroleum Storage or Retail Business Prior to 1/1/85 Petroleum Storage System Must be Properly Closed $500 Deductible No Funding Cap 7 8 $400,000 Funding Cap 4
