1 State of Connecticut Office of the Probate Court Administrator Probate Court Regulations Approved by the Probate Assembly s Executive Committee December 14, 2011 (NEW) Section 8A ed Workload 8A.1 (NEW) Authority (Effective 90 days after submission to the Judiciary Committee of the General Assembly) These regulations are issued pursuant to C.G.S. 45a-77 and 45a-95. 8A.2 (NEW) Applicability (Effective 90 days after submission to the Judiciary Committee of the General Assembly) Probate Court Regulation 8A applies only to the definition and utilization of weighted workload for any period beginning on or after July 1, A.3 (NEW) ed Workload (Effective 90 days after submission to the Judiciary Committee of the General Assembly) ed workload is the measure of the relative difficulty of the types of matters handled by courts of probate. A weight value is assigned to each type of matter. values are on a scale of 0.5 through 5.0, the lowest value representing a type of matter for which the least amount of work is typically associated and the highest value representing a type of matter for which the most amount of work is typically associated. A weighted workload chart of assigned weight values is appended to and made a part of this regulation. If a new type of matter is added to the jurisdiction of the probate courts, the administrator may add the new type to the chart with an assigned weight value of 3.0. Only matters listed in the chart shall receive credit for weighted workload. No credit shall be given for multiple or continued hearings of the same matter or for individual matters of atypical difficulty. 1
2 8A.4 (NEW) Annual ed Workload Certification (Effective 90 days after submission to the Judiciary Committee of the General Assembly) (a) The annual weighted workload of a probate court shall be used to determine compensation of the judge of the court under C.G.S. 45a-95. The annual weighted workload shall be the sum of the products obtained by multiplying the total number of each type of matter handled in the preceding fiscal year by the court, including matters in a regional children s probate court under P.C.R. 8A.5, by the assigned weight value for the type. (b) Each court shall enter the weighted workload data required by the administrator into the case management system of the courts of probate. The administrator shall track and periodically review the data for each court and make adjustments necessary to comply with this regulation. The administrator shall give the judge of a court an opportunity to provide additional information on any adjustment proposed by the administrator. (c) Not later than December 1 of each year, the administrator, after considering additional information supplied by the judge under subsection (b), shall certify the annual weighted workload for each court for the preceding fiscal year. 8A.5 (NEW) ed Workload Credit for Matters in Regional Children s Probate Courts (Effective 90 days after submission to the Judiciary Committee of the General Assembly) A judge of probate in a regional children s probate court who hears a matter that has an assigned weight value shall receive weighted workload credit for the matter. The credit shall be added to the annual weighted workload for the judge s probate court. 2
