Interest Rate Mediators (a/k/a Ameriworth Mortgage Company which is also ( Respondent Interest Rate is owned by Morris Shemtoub and incorporated in the State of California on September, 0, where it was located with a principal office location in Encino, California. Respondent Interest Rate s incorporation is dissolved. However, Ameriworth Mortgage Company, which is also owned by Morris Shemtoub, is an active company in California. Ameriworth Mortgage Company was incorporated in California on July, 0 with the same principal office location on Order to Show Cause and Cease and Desist- 1
2 1 1 Ventura Boulevard at the same address in Encino, California. The only difference is the suite number. The Better Business Bureau lists the website for Ameriworth Mortgage Company as The WHO IS Network Solutions result for the website shows the registered agent as Morris Shemtoub. Neither Respondent Interest Rate nor its other name of Ameriworth Mortgage Company is registered with the New Hampshire Secretary of State s Office. Respondent Interest Rate is a Person. RSA - A:1,XVIII.. The National Mortgage Licensing System & Registry ( NMLS does not indicate that Respondent Interest Rate (under either name has ever held a license as a mortgage broker. The New Hampshire Banking Department s ( Department records do not indicate that Respondent Interest Rate (under either name has ever held a New Hampshire Mortgage Broker license.. Morris Shemtoub ( Respondent Shemtoub is the owner of both Respondent Interest Rate (both companies and the registered agent for the website of Respondent Shemtoub is also a licensed California Real Estate Broker with a broker license issued on July, 0. Respondent Shemtoub is a Control person (RSA -A:,V-a, a Principal (RSA -A:1,XIX, a Direct Owner (RSA -A:1 VI-a, and a Person (RSA -A:1,XVIII.. NMLS does not indicate that Respondent Shemtoub has ever held a license as a mortgage broker. The Department s records do not indicate that Respondent Shemtoub has ever held a New Hampshire Mortgage Broker license.. The above-named Respondents are hereinafter collectively known as Respondents. Order to Show Cause and Cease and Desist-
3 RIGHT TO REQUEST A HEARING. Respondents have a right to request a hearing on this Order. A hearing shall be held not later than ten ( days after the Commissioner receives the Respondent s written request for a hearing. Respondents may request a hearing and waive the ten ( day hearing requirement. The hearing shall comply with RSA Chapter 1-A. RSA -A: and RSA -A:.. If any person fails to request a hearing within thirty (0 days of receiving this Order, then such person shall be deemed in default, and the Order shall, on the thirty-first (1 st day, become permanent, all allegations may be deemed true, and shall remain in full force and effect 1 until modified or vacated by the Commissioner for good cause shown. -A:,I and RSA -A:. RSA 1. A default may result in administrative fines as described in Paragraph above. STATEMENT OF ALLEGATIONS. On January,, the Department received a complaint from a New Hampshire consumer ( Consumer A against Respondents concerning residential mortgage loan modification services. 1. On July, 0, Respondents contracted with Consumer A to modify Consumer A s mortgage loan interest rate without a New Hampshire mortgage broker license, in violation of RSA -A:,I. 1. On October,, Respondents collected an advance fee of $1,00.00 from Consumer A, in violation of RSA -A:,IV(m.. Respondents failed to provide a residential mortgage loan modification to Consumer A in violation of RSA -A:,IV(b. Order to Show Cause and Cease and Desist-

On September,, the Department sent a letter via U.S. Certified Mail return receipt requested to Respondents, suggesting Respondents apply for licensure with the Department and resolution of Consumer A s complaint. The U.S. Post Office returned the correspondence as not deliverable as addressed.. On June,, the Department sent a letter via facsimile to Respondents, suggesting Respondents apply for licensure with the Department and resolution of Consumer A s complaint. The facsimile was successfully delivered on June,.. To date, Respondents have failed to provide the information requested by the Department, in violation of RSA -A:1,I. 1 1 /s/ August, Maryam Torben Desfosses Date Hearings Examiner ORDER. I hereby find as follows: a. Pursuant to RSA -A:,I, the facts as alleged above, if true, show Respondents are operating or have operated in violation of RSA Chapter -A and form the legal basis for this Order; b. Pursuant to -A:,VI, this Order is necessary and appropriate to the public interest and for the protection of consumers and consistent with the purpose and intent of New Hampshire banking laws; c. The Department finds pursuant to RSA -A:,II and RSA - A:,II, reasonable cause to issue an order to cease and desist; and d. Pursuant to RSA -A:,I and RSA -A:,II, if any Order to Show Cause and Cease and Desist-
5 1 1 Respondent fails to respond to this Order and/or defaults then all facts as alleged herein are deemed as true.. Accordingly, it is hereby ORDERED that: a. Respondents shall cease and desist from violating RSA Chapter -A and rules or orders thereunder; b. Respondents shall immediately provide the Department a list of all New Hampshire consumers for whom Respondents have residential mortgage loan modification activity and a status of those accounts. This list must include the names and contact information of the New Hampshire consumers, along with monies charged, collected and waived (if applicable. The list shall also be accompanied by all contracts, checks to and from the consumer and any other documents in the New Hampshire consumers files; c. Respondents shall show cause why the Commissioner should not enter an order of rescission, restitution, or disgorgement of profits in the amount of at least $1,00.00 (for Consumer A; d. Respondents shall show cause why an administrative fine of up to a maximum of $,00.00 per violation should not be imposed as follows: (1.
