1 AMENDMENT OF TARIFF OF CHARGES IN RESPECT OF STREET ENCROACHMENTS, REINSTATEMENTS AND PRINTED MATERIAL: 2007/ STRATEGIC THRUST Service Excellence and Good Governance. 2 OBJECTIVE To obtain approval for the amendment of the Tariff of Charges for Street Encroachments, Reinstatements and Printed Material. 3 SUMMARY Every encroachment relating to a building shall be deemed to have an aggregate horizontal dimension equal to the total street frontage of the stand on which the building concerned is situated. The Council therefore has the responsibility of maintaining the footways, kerbing and guttering and Council will from time to time levy revised charges for encroachments to ensure adequate funding to carry out the work. The maintenance work is done on an annual basis by the Johannesburg Roads Agency. The JRA provides documentation of servitudes, as built drawings, copies of aerial photographs etc to the general public and they are charged for. The wayleave policy allows for the Johannesburg Roads Agency to charge for reinstatements to be carried out in the road reserve. These reinstatements should be undertaken when the appropriate application has been approved failing which an increased tariff in applied. OTHER CONSIDERATIONS (1) Social The street encroachment tariff is minimal and payable twice a year. Provides resources for the JRA to manage street encroachment and maintain services and footways and under balconies. (2) Economic The additional resources generated through this tariff enable the JRA to maintain the infrastructure in the applicable areas at a reasonable standard. (3) Financial

2 The proposed tariffs are linked to be specific on the amount spent on the maintenance of footways. The JRA will be spending R on this activity. The proposed tariffs will recover all expenses incurred. 4 POLICY IMPLICATIONS The tariffs were set according to the City Tariff Policy but are not set to recover costs. They are based on inflation (CPI X) 5 LEGAL AND CONSTITUTIONAL IMPLICATIONS This report has been finalised in conjunction with Legal and Compliance to ensure compliance with all relevant Legislation. It should though be kept in mind that by virtue of Section 28 (6) of the Local Government: Municipal Finance Management Act, 2003 (Act 56 of 2003), once the new tariffs have been determined in respect of the 2007/2008 Financial Year, it may not be further increased during that financial year, except when required in terms of a financial recovery plan as contemplated in the Act. For that reason it is essential to ensure that the proposed increases comply with the budgeted needs of the Council in respect of 2007/2008 Financial Year. The tariffs are in compliance with Johannesburg Road Agency by-laws. 6 FINANCIAL IMPLICATIONS The charge for street encroachments is currently R358 per half-year of every 15,74m or part thereof. By implementing a 6 % increase shall be increased to R380 for half a year for every 15,74m or part thereof as from 1 July It is estimated that the proposed increase will generate an additional R per annum in income. All income accrued as a result of this tariff is for the JRA. The JRA is responsible for the maintenance of footways and balconies. The charges for wayleaves is currently as indicated in Annexure A and are proposed to increase by 6 % to the new tariffs to increase the income by R16 800per annum for the JRA. 7 COMMUNICATIONS IMPLICATIONS The relevant information regarding the amended tariffs will be communicated to all role players in the manner prescribed by law. 8 OTHER DEPARTMENTS / BODIES CONSULTED Budget Office Legal and Compliance

3 IT IS RECOMMENDED 1 That, in terms of Sections 11(3)(i) and 75A(1) and (2) of the Local Government: Municipal Systems Act 2000, (Act 32 of 2000) as amended, read with Section 24(2)(c)(ii) of the Local Government: Municipal Finance Management Act, 2003 (Act 56 of 2003), the City of Johannesburg amends its Tariff of Charges in respect of Street Encroachments, Reinstatements and Printed Material as set out in Annexure A with effect from 1 July That, in terms of Sections 17(3)(a)(ii) and 22(a)(i) and (ii) of the Local Government: Municipal Finance Management Act, 2003 (Act 56 of 2003) and Sections 21, 21A(1) and 75A(3)(a), (b) and (c) of the Local Government: Municipal Systems Act, 2000 (Act 32 of 2000) as amended, the City of Johannesburg: (1) displays a copy of the resolution and notice in the manner prescribed; (2) seeks to covey to the local community by means of radio broadcast covering the area of the City, the information contemplated in Section 75A(3)(c) of the Local Government: Municipal Systems Act, 2000 (Act 32 of 2000) as amended; and (3) publishes the notice in the manner prescribed and invites the local community to submit written comments or representations in respect of the amended Tariff of Charges 3 That, if no objections are received, that the amended Tariff of Charges be published in the Provincial Gazette and be effective from 1 July That a copy of the notice referred to in Paragraph 2(3) above be sent forthwith to the MEC for Local Government as well as the National and Provincial Treasury in terms of Section 75A(4) of the Local Government: Municipal Systems Act, 2000 (Act 32 of 2000) as amended and Sections 17(3)(a)(ii) and 22(b)(i) and (ii) of the Local Government: Municipal Finance Management Act, 2003 (Act 56 of 2003). 5 That a copy of the finally approved amended Tariff of Charges be sent forthwith to the National and Provincial Treasury in terms of Section 24(3) of the Local Government: Municipal Finance Management Act, 2003 (Act 56 of 2003).
