1 UNITED STATES OF AMERICA BEFORE THE FEDERAL ENERGY REGULATORY COMMISSION Greater Detroit Resource Recovery Project. ) Docket No. QF NOTICE OF SELF-RECERTIFICATION OF QUALIFYING FACILITY STATUS FOR AN EXISTING SMALL POWER PRODUCTION FACILITY Pursuant to Section of the Commission s regulations, 18 C.F.R (2007), Michigan Waste Energy, Inc. ( Applicant ) hereby submits this Notice of Self- Recertification of an existing Qualifying Small Power Production Facility and Cogeneration Facility, which is a refuse derived fuel generating project located in Detroit, Michigan ( the Facility ). FORM 556 PART A: GENERAL INFORMATION TO BE SUBMITTED BY ALL APPLICANTS 1a. Full name of applicant: The Applicant is Michigan Waste Energy, Inc. ("MWE"). MWE is the operator and lessee of the Facility. Docket Number assigned to the immediately preceding submittal filed with the Commission in connection with the instant facility, if any: Docket No. QF The initial application for Commission certification of Qualifying Facility ( QF ) status was filed by the Greater Detroit Resource Recovery Authority ( Authority ) in the above-captioned proceeding on February 8, 1985 and supplemented on April 26, 1985 (the "Application"). By order dated July 12, 1985, the Commission granted the Facility certification as a qualifying small power production facility, Greater Detroit Resource Recovery Authority, 32 FERC 62,101 (1985). This Notice of Self-Recertification is being filed to provide notice of changes in the upstream ownership of the Facility and to update certain other facts stated in the Application. In a separate order dated July 12, 1985, the Commission also granted the Facility certification as a qualifying cogeneration facility in Docket No. QF , Greater Detroit Resource Recovery Authority, 32 FERC 62,100 (1985). A notice of self-recertification of the Facility as a qualifying cogeneration facility is being filed concurrently.
2 Page 2 of 7 Purpose of instant filing: Notice of Self-Recertification of QF status of an existing Facility to reflect a change in the upstream ownership of the Facility and to update certain other facts stated in the Application. All other aspects of the Facility remain the same as represented in the Application and are incorporated by reference. 1b. Full address of applicant: Michigan Waste Energy, Inc Russell Street Detroit, MI Tel: (313) c. Indicate the owner(s) of the facility (including the percentage of ownership held by any electric utility or electric utility holding company, or by any persons owned by either) and the operator of the facility. As explained in the Application, the Facility was constructed by the Authority. On September 1, 1991, the Authority entered into a Participation Agreement with MWE, Resource Recovery Business Trust 1991-A, PMCC Leasing Corporation ( PMCC Leasing ), Wilmington Trust Company and William J. Wade ( Trustees ). In accordance with the Participation Agreement, PMCC Leasing acquired an undivided 70 percent ownership interest in the Facility from the Authority. Pursuant to a separate Participation Agreement dated September 1, 1991 among the Authority, MWE, the Trustees and Aircraft Services Corporation ("ASC"), ASC acquired an undivided 30 percent ownership interest in the Facility. Concurrently, the Facility was leased to the Applicant, which operates the Facility pursuant to an agreement with the Authority for the management, operation and maintenance of the Facility. Neither owner participant directs activities concerning the output of, or otherwise exercises operational control over, the Facility. Neither PMCC Leasing nor ASC is an "electric utility" or an "electric utility holding company" as defined in 18 C.F.R (n) (2007). MWE is a wholly-owned indirect subsidiary of Covanta Holding Corporation, a publicly traded company which has subsidiaries that own and/or operate qualifying facilities, exempt wholesale generators, and foreign utility companies. 1d. Indicate the electric utilities that are contemplated to transact with the qualifying facility (if known) and describe the services those electric utilities are expected to provide. Indicate utilities interconnecting with the facility and/or providing wheeling service. Indicate utilities purchasing the useful electric output. Indicate utilities providing supplementary power, backup power, maintenance power, and/or interruptible power service: As stated in the Application, the Facility is interconnected with the steam and electric systems of Detroit Edison Company. Detroit Edison Company purchases all of the steam and electricity output of the Facility pursuant to a long-term agreement approved by the Michigan Public Service Commission. Detroit Edison provides the Facility with supplementary power, backup power, maintenance power and/or interruptible power. 4a. Describe the principal components of the facility including boilers, prime movers and electric generators, and explain their operation. Include transmission lines, transformers and switchyard equipment, if included as part of the facility. Incorporated by reference from the Application. 4b. Indicate the maximum gross and maximum net electric power production capacity of the facility at the point(s) of delivery and show the derivation. The maximum gross output of the Facility is approximately 68 MW. The maximum net output of the Facility is approximately 57 MW as certified by the Commission. 4c. Indicate the actual or expected installation and operation dates of the facility, or the actual or expected date of completion of the reported modification to the facility:
4 Page 4 of 7 The Facility commenced commercial operation in d. Describe the primary energy input. As stated in the Application, the primary energy input is municipal solid waste, or biomass. Municipal refuse is delivered to the Facility pursuant to an agreement between the Authority and MWE. 5. Provide the average annual hourly energy input in terms of Btu for the following fossil fuel energy inputs, and provide the related percentage of the total average annual hourly energy input to the facility [18 C.F.R (j)]. For any oil or natural gas fuel, use lower heating value [18 C.F.R (m)]: As stated in the Application, the only fossil fuel input used at the Facility is oil. It is used only for light-off and start-ups. The Facility processes municipal solid waste and refuse derived fuel is its primary energy input. For 2007, billion Btu of auxiliary fuel (oil) was consumed on an HHV basis (assumed light oil HHV of 141,000 Btu/lb.). Assuming 8760 hours per year, this yields an auxiliary fuel use equal to million Btu/hr. For 2007, heat input from refuse derived fuel, the Facility's primary fuel, is estimated at trillion Btu (808,241 tons processed at an estimated HHV of 4600 Btu/lb). The fossil fuel energy input is calculated to be 0.56 percent of the total average annual energy input for the Facility. 6. Discuss any particular characteristic of the facility which the cogenerator or small power producer believes might bear on its qualifying status. Not applicable. PART B: DESCRIPTION OF THE SMALL POWER PRODUCTION FACILITY 7. Describe how fossil fuel use will not exceed 25 percent of the total annual energy input limit [18 C.F.R (j) and (b)]. Also, describe how the use of fossil fuel will be limited to the following purposes to conform to Federal Power Act section 3(17)(B): ignition, start-up, testing, flame stabilization, control use, and minimal amounts of fuel required to alleviate or prevent unanticipated equipment outages and emergencies directly affecting the public. As stated in the Application, the only fossil fuel input used at the Facility is oil. It is used only for light-off and start-ups, and other uses consistent with Federal Power Act section 3(17)(B) and permitted by 18 C.F.R (b). Fossil fuel does not exceed 25 percent of the total annual energy input limit. 8. If the facility reported herein is not an eligible solar, wind, waste or geothermal facility, and if any other non-eligible facility located within one mile of the instant facility is owned by any of the entities (or their affiliates) reported in Part A at item 1c above and uses the
5 Page 5 of 7 same primary energy input, provide the following information about the other facility for the purpose of demonstrating that the total of the power production capacities of these facilities does not exceed 80 MW [18 C.F.R (a)]: Not applicable. PART C: DESCRIPTION OF THE COGENERATION FACILITY See the Notice of Self-Recertification of qualifying cogeneration facility status being filed concurrently.
