PLAINTIFF S REPLY TO DEFENDANTS RESPONSE TO PLAINTIFF S NOTICE OF SUPPLEMENTAL AUTHORITY Defendants attempt to obscure the simple message of the Federal Communication Commission ( FCC ) amicus brief- An individual s consent, once obtained is not unlimited and that [c]onsumers who provide a wireless phone number for a limited purpose... do not necessarily expect to receive telemarking calls that go beyond the limited purpose. FCC amicus brief in the matter of Albert A. Nigro v. Mercantile Adjustment Bureau, LLC, No at 4-5. Mr. Phillip s sole intention and limited purpose was to vote for his favorite team. (Am Compl. 40.) He did not consent to receive telemarking messages. (Id. 40.) Of course the facts of Nigro differ from the facts of the instant case as Defendants point out. Defendants also state, The plaintiff in Nigro received

2 Case 2:12-cv JEO Document 50 Filed 08/28/14 Page 2 of 5 dozens of autodialed calls to collect a debt wholly unrelated to the reason for which the plaintiff provided his mobile number. (Defendants brief at 1-2.) Similarly, Mr. Phillips received telemarketing messages that were wholly unrelated to the reason for which Mr. Phillips provided his mobile number. Moreover, Defendants are wrong that because the Nigro case is about debt collection calls, the FCC relied heavily on its order in In the Matter of Rules and Regulations Implementing the Telephone Consumer Protection Act of 1991, Report and Order, 23 FCC Rcd 559, 2008 WL (Jan 4., 2008).... (Defendants brief at 2.) The FCC stated that consumers do not expect to receive telemarketing calls that go beyond the limited purpose and therefore have not given their consent in the section of its amicus brief discussing the meaning of consent in general under the TCPA. (See FCC brief at 3-5.) The FCC s amicus brief is directly on point and as such, Plaintiff respectfully requests that this Court deny Defendants Motion to Dismiss.
