1 Payments to foreign countries If you have to pay an amount to a person or a firm abroad, it is of course important that payment is made on time, in the agreed currency, and with as low charges as possible. Payment can be made by Transfer Bank cheque SEPA Direct Debit Transfers Transfers are made through the electronic communication system of the financial institutions, SWIFT - Society for Worldwide Interbank Financial Telecommunication. SWIFT has its headquarters in Belgium and regional IT centres in Europe and the USA. The system is used by about 10,500 financial institutions in 215 countries. Information to the authorities in the USA According to the legislation in the USA, SWIFT has been ordered to disclose information to the authorities about transfers in connection with which there may be suspicion that the payment relates to the financing of crime or terrorism. IBAN and BIC In connection with international payments, you should if possible state. The payee's IBAN (International Bank Account Number). This is the payee's account number in an internationally agreed format. IBAN and BIC are necessary for payments to EU-lande, EØS-lande and should be used for payments to Albania, Andorra, Aserbajdsjan, Bahrain, the United Arab Emirates, Georgia, Gibraltar, Israel, Jordan, Kuwait, Lebanon, Mauretania, Moldova, Palestine, Saudi Arabia, Tunesia, Turkey account-holding bank's BIC code (Bank Identifier Code). This is the bank's international code. Also sometimes referred to as the SWIFT address As IBAN and BIC will only get through the bank's payments system if they have been entered correctly, this will provide you with a guarantee that your payment will reach the payee without delay. Types of transfer: You can choose among: EU transfer in EUR/SEPA Processing period: The amount will be available to the payee on the 1 st bank day after the date of execution, at the latest. EU transfer in EUR/SEPA payment can be made to all EU-lande and EØS-lande Payment must include correct IBAN and BIC Standard transfer Processing period: Amounts in other currencies than EUR will be available to the payee's bank after the execution date. Express transfer Amounts in EUR will be available to the payee in EU/EEA countries Amounts in other currencies will be available to the payee's bank no later than on the after the execution date. within 2-3 bank days on the execution date. 1 st bank date If the receiving country's deadline for completion of payments as at the execution date has been exceeded when you want to order the transfer, an express transfer can only be carried out as at the following bank day. Information about deadlines in the individual countries can be obtained at your request. Transfer via MoneyGram Amounts will typically be available within an hour if we receive the order before 1:30 pm. Additional information can be obtained from your bank advisor or on MoneyGram transfers are only used in situations where the payee is to receive cash payment of the amount. Conditions for execution of a payment: International payments will only be made if you provide us with the necessary payment information and make the transfer amount or the corresponding value plus costs available to us. 2 Please note that according to current legislation, we must state your account number with us in the international transfer. Necessary payment information To ensure quick and correct handling of your payment, it is important that we receive the necessary information as precisely as possible. Your transfer request must include: Currency and amount The payee's name and address The payee's bank (name and address) if possible as BIC code The payee's account number if possible as IBAN (International Bank Account Number) Possibly payment purpose Information as to whether bank charges in Denmark and abroad are to be paid by the transmitter or the payee. If the payee's bank and account number are not available as BIC and IBAN in countries where this is possible, additional charges will be made to cover additional manual processing by Nordjyske Bank and abroad. At the same time, we cannot guarantee that the above time limits for completion of the payment can be observed. Requests for transfers must be made via Netbank or by completing our special order form. You can get a copy of the order form at the bank or find it on our websitehttp://alm.nordjyskebank.dk. If it is possible for you to order your transfer through Netbank or Netbank Erhverv, this will be the least expensive solution for you. Bank cheques should not be used if you can use a transfer instead. If you order payment by cheque, we will issue a cheque which is payable at our correspondent bank in the currency in question. The term correspondent bank refers to a number of financial institutions abroad with which we have business cooperation. We only issue bank cheques in currencies where we have business cooperation with a bank in the country in question. You will send the cheque to the payee yourself or you can choose to let us send it against payment of an additional charge. If we do not cooperate with the payee's bank, it may take additional time before the payee receives the money, in cases when the payee's bank wants to cash the cheque with our correspondent bank. At the same time, using cheques involves a certain risk. If the cheque gets lost in the post, you can have a replacement cheque. You will, however, have to cover the amount if the cheque is cashed later but only until the end of the period of limitation. Internationally, cheques become less frequently used from one year to the next, because the cheque is a slow method of payment. At the same time, payment by cheque is relatively expensive, as it requires quite a lot of manual work in the financial institutions. Time limits for ordering Orders for EU transfers in EUR/SEPA payments must have been received by Nordjyske Bank before 3:00 pm. Other orders received before 1.30 pm will be executed on the same day. Orders received later will be executed on the following bank day unless otherwise agreed. Orders placed through Netbank and Netbank Erhverv will be covered by the time limits agreed with the bank. Costs in connection with cheques and transfers The price of an international payment depends on the type of payment you choose. Fees/commission will be charged according to our price book which is available at and in our branches. Please note the following: Transfers Bank charges will apply both in the payer's and the payee's country when you transfer money abroad. When the order is placed, we agree how the charges are to be divided between you and the payee. EU transfers in EUR/SEPA payments In case of an EU transfer in EUR/SEPA payments, the sender and the payee will each pay the bank charges in their own country. The price is the same as for a similar domestic transfer. The payee will therefore pay the same low charge for receiving the money as if the money had been transferred by his/her neighbour. Other transfers You will have the following choices: - All costs to be paid by the sender Page 2
3 If you choose to pay bank charges abroad, we will make a charge in addition to our normal fee/commission when transferring your payment. For payments outside the EU/EEA, we reserve the right to make a charge for international costs exceeding the additional charge already made. - Costs to be divided between sender and payee Most often, the sender will pay our charges in connection with the transfer, and the payee will cover the costs abroad. These costs vary from one country to the other and from one bank to the other. Most often, we will be able to give you an indication of the price level. - All costs to be paid by the payee For payees outside the EU/EEA, you can choose to have the payee cover all costs. In that case we will deduct our charges from the amount transferred when the transfer is made. Cheques Cashing cheques abroad will normally involve costs. The size of these costs varies from one country to the other and from one bank to the other. Exchange rate EU transfers in EUR/SEPA payments ordered before 3:00 pm and other payments in foreign currencies ordered before 1:30 pm will be settled at the official information rate of the Danish Central Bank plus an additional charge unless otherwise agreed. The charge varies for the different currencies. It appears from our price book, which is available at and in our branches. Settlement of payments in foreign currencies ordered after 1.30 pm will normally be made at the market rate when the order is received. Of course, you can always agree on a settlement rate with us based on the market rate at the transaction time.. Settlement of international payments Unless otherwise agreed, international payments will be withdrawn from your account with interest effect (value) on the date of execution. Immediately after the transfer, you will receive a settlement note with information about exchange rate and charges. The charge will be entered separately. Tracking a transfer If the payee claims not to have received the amount, we ask you to inform the payee when and how the transfer was made (appears from the bank's notice to you). The payee will then have the possibility of tracking the transfer in his own bank. The bank can also start a search for the amount. However, we reserve the right to make a charge to cover our costs if it turns out that the payment was made correctly. You will also have to pay any costs in the other country.. Returning amounts transferred An amount transferred internationally may be returned if the involved bank(s) abroad has/have not been able to carry out the payment on the basis of the information stated. The bank will process such returned transfers as an international transfer. Revocation of transfers and stopping a cheque Under special circumstances, you may revoke transfers or request the bank to stop a cheque issued on your account. We will inform you in each case of the existing possibilities and the legal consequences. The bank will make a processing charge for revocation of transfers and stopping of cheques. Please see our price book. SEPA Direct Debit (SEPA = Single Euro Payment Area) SEPA Direct Debit is a payment system in EUR covering the same functions at the European level as the PBS payment service and supplier service in Denmark. According to a written agreement a so-called "mandate" between your trading partner and you, businesses within the EU/EEA can on due dates withdraw amounts from the payer's account to cover goods and services delivered. Payments are made the first time within five bank days and for subsequent payments within two bank days. The payer can in principle request repayment of an amount for up to eight weeks after the date of payment. There is, however, a special payment concept between businesses (B2B = Business to Business), according to which the time limit for objections is only two bank days. 4 Payments from abroad Payments to you from a foreign country are in principle no different from transfers in the opposite direction. Payments will normally be received as transfers or as cheques. The options are described in detail in the following. Transfers Payments from abroad can be transferred directly to your account from the foreign bank via SWIFT. This will normally be the quickest and least expensive method for you. Information which you should give to the payer To avoid misunderstandings and ensure quick payment, it will be a good idea to include information about your bank in your invoices: Nordjyske Bank A/S Foreign Department Jernbanegade 4-8 DK-9900 Frederikshavn SWIFT/BIC: EBANDK22 IBAN (International Bank Account Number). Your domestic account number with us, including the registration number, should only be used in exceptional cases. We can provide you with payment instructions in Danish, English, German, French, Italian, Spanish and Portuguese for your customers Cheques Receiving payment from abroad by cheque cannot be recommended. Instead you should ask for a transfer to your account. You should not accept cheques as payment for goods you sell as a private person via the Internet. There is large risk that cheques issued in connection with Internet transactions are forged. A cheque issued in Danish kroner should be drawn on a Danish bank, as this will reduce the costs of cashing the cheque. Costs in connection with cheques and transfers General information When the amount is deposited on your account, you will be informed of the original amount, our processing fee/commission, any costs abroad and the exchange rate for the settlement, if relevant. Our fees/commissions appear from our price book, which is available at and in our branches. -special information about transfers If the payer has undertaken to cover all costs, you will of course receive the amount forwarded without any deductions. If, on the other hand, the payer has requested that you pay also the costs of the foreign bank, such costs will have been deducted before we receive the amount. The fee is entered separately. - special information about cheques If you have accepted a cheque from abroad, we can help you collect the cheque. Settlement will be made when we have received final payment from abroad, and our collection charge will be deducted. If the bank abroad on which the cheque is drawn makes a charge or commission for the settlement of cheques, such costs will subsequently be withdrawn from your account. Exchange rate The exchange rate for settlements will unless otherwise agreed be the official information rate of the Danish Central Bank less a deduction which varies from one currency to the other. The deduction appears from our price book, which is available at and in our branches. Payments received before 1.30 pm are settled at the exchange rate on the date of receipt, whereas payments received after 1.30 pm will be settled at the following bank day's exchange rate. Page 4
5 Alternatively, settlement can be made according to the current market rate. When will the amount be at your disposal? Transfers from EU/EEA countries Transfers in EUR from EU/EEA countries will be deposited on your account with interest effect (value) on the bank day on which the amount is at our disposal. It is, however, a condition that the transfer has been received by us no later than at 1.30 pm on the day on which the amount is at our disposal. This also applies if the transfer is in a different EU/EEA currency and is deposited on an account with our bank in the transfer currency. If the transfer is received later than 1.30 pm, the amount will be deposited on your account with interest effect (value) one bank day after the date of receipt. Other transfers from abroad Other transfers from abroad will be deposited on your account with interest effect (value) one bank day after the date on which the amount is at our disposal. Cheques Cheques will be deposited on your account with interest effect (value) two bank days after the settlement date. General information Liability The bank is liable for direct losses which you may suffer from the bank's failure to implement or insufficient implementation of payments covered by the Danish Payments Services Act which the bank has undertaken to implement on your behalf cf. section 68 of the Act. Even in areas where a stricter liability applies, Nordjyske Bank shall not be liable for losses caused by: 1. break-down of/lack of access to IT systems or damage to data in such systems which are caused by the events below, regardless whether the bank itself or an external supplier is in charge of operating the systems 2. failure in the bank's power supply or telecommunication, legislation, natural disasters, war, riots, civil unrest, sabotage, terrorism or vandalism (including computer virus and hacking) 3. strike, lockout, boycott or blockade, regardless whether the conflict is aimed at or initiated by the bank itself or its organisation, and regardless of the reason for the conflict. This also applies when the conflict affects only parts of the bank 4. other circumstances beyond the bank's control The bank's exemption from liability does not apply if 1. the bank ought to have foreseen the factors causing the loss when the agreement was made or should have avoided or conquered the reason for the loss 2. the bank is according to legislation in any case responsible for the factor causing the loss. Complaints If you want to complain about Nordjyske Bank, please start by contacting your branch. If after doing that, you still disagree with Nordjyske Bank's treatment of your application or the result thereof, you may contact the person in charge of complaints with Nordjyske Bank.
