Revisions have been made to the insurance minimum requirements. Replace: APPENDICES A N Appendices A N posted on the Authority s website in Microsoft Office format have been replaced with Appendices A N (Revised Addendum 1). Revisions have been made to Appendix I. Words that are underlined in the revised pages represent additions and words that are struck through represent deletions. Except as provided herein, all terms and conditions will remain the same. QUESTION RECEIVED AND RESPONSE: Q1.On Appendix C, there is only space provided to enter one key team member. End of Addendum INSTRUCTIONS: Respondent must acknowledge receipt of this addendum as instructed in the solicitation document. Failure to acknowledge receipt of this Addendum may result in the disqualification of Respondent s response. 3 reasonable attorneys fees, to the extent caused by the negligence, recklessness, or wrongful conduct of the Consultant and other persons employed or utilized by the Consultant in the performance of the Agreement. Nothing contained herein will be construed as a waiver of any immunity from or limitation of liability the Owner may have under the doctrine of sovereign immunity under Section , Florida Statutes. The Owner reserves the right, at its option, to participate in the defense of any suit, without relieving Consultant of any of its obligations hereunder. The obligations of this clause will survive termination of this Agreement and will not be limited by the amount of any insurance required to be obtained or maintained under this Agreement. If this clause is found to conflict in any way with Florida law, the clause will be considered modified by such laws, to the extent necessary to remedy the conflict. Hillsborough County Aviation Authority December 13, 2014 Continuing Environmental Engineering Consulting Services Page 13 of 28 Appendix O Sample Agreement ARTICLE 9 INSURANCE COVERAGES AND LIMITS Consultant will maintain the following limits and coverages uninterrupted or amended through the life of this Agreement. In the event the Consultant becomes in default of the following requirements, the Owner reserves the right to take whatever actions deemed necessary to protect its interest. Required liability and property insurance policies, other than Workers' Compensation/Employer's Liability and Professional Liability, will provide that the Owner, members of the Owner's governing body, and the Owner's officers and employees are included as additional insureds. 9.1 Workers' Compensation / Employer's Liability - The minimum limits of insurance (inclusive of any amount provided by an umbrella or excess policy) will be: Part One (Workers Compensation) Florida Statutory Part Two (Employer s Liability Each Accident $1,000,000 Disease Policy Limit $1,000,000 Disease Each Employee $1,000, Commercial General Liability - The minimum limits of insurance (inclusive of any amounts provided by an umbrella or excess policy) without exclusion for independent contractors, XCU, or broad form property damage covering the work performed pursuant to this Agreement will be the amounts specified herein. Coverage will be provided for liability resulting out of, or in connection with, ongoing operations performed by, or on behalf of, the Consultant under this Agreement or the use or occupancy of Owner premises by, or on behalf of, the Consultant in connection with this Agreement (Tail Coverage). Tail Coverage will be maintained for a period of three years from the date of substantial completion. General Aggregate $1,000,000 REQUEST FOR QUALIFICATIONS (Revised Addendum 1)

4 Each Occurrence $1,000,000 Personal and Advertising Injury Each Occurrence $1,000,000 Products/Completed Operations Aggregate $1,000, Business Auto Liability - Coverage will be provided for all owned, hired and nonowned vehicles. The minimum limits of insurance (inclusive of any amounts provided by an umbrella or excess policy) covering the work performed pursuant to this Agreement will be: Each Occurrence Bodily Injury and Property Damage combined $5,000, Professional Liability - Such insurance will be Project specific and will be maintained throughout the Project and for four years following completion of the Project work by the Consultant. Any deductible amount over $50,000 must be approved in writing by the Owner. Coverage will include all work of the Consultant, including but not limited to areas with possible environmental impact, without any exclusions unless approved in writing by the Owner. The limits of coverage will not be less than: Each Claim $1,000,000 Annual Aggregate $1,000,000 Tail Coverage $1,000, Environmental Impairment (Pollution) Liability - Proof of such insurance will be required during this Agreement if determined by the Owner that circumstances warrant this coverage. Consultant agrees to show proof of coverage without asbestos abatement exclusion, which arises out of, or in connection with, work or occupancy of Owner property in the Consultant s performance under this Agreement. Each Occurrence $1,000,000 Annual Aggregate $1,000,000 Tail Coverage $1,000, This Agreement incorporates by reference the Owner s Operating Directive concerning contractual insurance terms and conditions in effect as of the date of this Agreement or subsequent amendments.
