4 03 OUR EMPLOYMENT EXPERIENCE IN INDIA Businesses in India Our clients cover a diverse spread of industries, including science, research and development and technology design. We also advise a number of insurance companies and other financial institutions, as well as e commerce businesses, telecommunications companies, internet companies and transport and related enterprises. We have developed particular expertise over several years of working with Indian corporations and finance houses and local Indian law firms on a co counsel basis. The increasing growth and liberalisation of the Indian economy is creating new opportunities for businesses looking to develop a European presence. We have the enterprise and experience required to enable Indian companies to successfully establish and staff their businesses in the UK. Businesses in the UK In 2011, the World Bank declared the UK to be the best place in Europe and the G8 in which to do business. Overall, the UK is continuing to maintain its long term position as one of the few globally attractive locations for foreign direct investment. The UK is it a gateway to Europe and has real advantages for businesses as a country which is committed to free trade, offering a range of business solutions. Any business operating in the UK needs to be aware of the employment law and immigration requirements which govern the employment of individuals working in the UK. Workers in the UK have various employment protection rights, some of which are a result of the UKʹs membership of the European Union. 5 INDIA EXPERIENCE 04 India experience IT Solutions Marine Services Indian Nationals Providing a highly successful IT solutions and services company with expert employment and immigration advice to ensure it was able to recruit specialist staff from the UK. Providing specialist UK immigration advice to a leading marine services company with a subsidiary in Mumbai that specialises in providing a vast range of support services to the global shipping industry. Advising Indian nationals intending to live and work in the UK, including applications under the Points Based System, applications for limited leave to remain, indefinite leave to remain and British citizenship. Telecommunications Enterprise Solutions Media And Entertainment Immigration Appeals Advising a leading Indian telecommunications company on offshoring services to India. This included advising on the application of the Transfer of Undertakings (Protection of Employment) Regulations Providing specialist advice to a highly successful enterprise solutions company, with a subsidiary in Hyderabad, in relation to its international expansion and the transfer of employees both into and out of the UK. Advising a company that is part of a group with business interests in media and entertainment, satellite operations packaging, retailing and real estate in relation to UK employment issues including the termination arrangements for its employees. Acting on behalf of a high net worth Indian national in a successful Human Rights Appeal at the Asylum and Immigration Tribunal following her visa refusal and a ban from the UK. Shipping Companies UK Start Ups Dismissal Taxation Issues Advising one of the worldʹs leading diversified shipping companies, which was established 100 years ago as a ship broking company, in relation to the recruitment of specialist staff from India to join its UK operations. Acting for many Indian nationals and corporates seeking to establish new businesses in the UK and, in particular, in respect of governance and compliance issues. Advising a large Indian company in connection with an Employment Tribunal claim for wrongful unfair dismissal and discrimination brought against its UK subsidiary and successfully settling the claim before costs were incurred in defending the claim. Advising a highly successful IT solutions company with offices in Bangalore and Hyderabad in relation to the tax implications of seconding a UK employee to India. 6 05 TEAM PROFILE Team profile Liz Buchan Partner Angharad Harris Partner Asha Kumar Partner Liz Buchan joined Watson, Farley & Williams in 1994 and heads the employment law team. She deals with all areas of contentious and noncontentious employment and labour law matters, and also advises on employee benefits and share options. She has over twenty years experience of employment law issues and is recognised as a leading individual in the field of employment law by Chambersʹ Guide to the Legal Profession. Lizʹs clientbase spans a range of industries including energy/resources, finance, telecoms and media, and she also acts for senior executives, usually upon joining or leaving employment. In 2010 Liz received an award from the Association of Women Solicitors in recognition of her management skills. Angharad Harris has been a partner at Watson, Farley & Williams since Her practice includes a broad range of contentious and non contentious employment matters, acting on behalf of employers and employees. She is a regular speaker on employment law matters for clients as well as for other organisations. Angharad also regularly provides clients with bespoke workshop training for senior managers including training on their leadership programmes. Angharad is the Chair of the Employment Law Committee of the Law Society of England and Wales. Asha Kumar joined Watson, Farley & Williams in 2000, having qualified at a regional law firm. She deals with both contentious and noncontentious employment law matters and has prepared policies and procedures, drafted directors agreements, advised on high level terminations of employment and defended employment tribunal claims. Her experience includes assisting with implementing largescale redundancies programs, global business reorganisations, crossborder employment law experience and has advised on the implementation of a global outsourcing exercise.

She has worked as an employment lawyer in the City for many years and has also lectured for the College of Law. As Head of Employment Law Training Janet is responsible for the quarterly Employment Update, along with the Summer Briefing Programme and the Annual Seminar. Rhodri Thomas trained with Watson Farley & Williams and qualified into the employment group in September 2005, where he advises employers and individuals on a full range of contentious and noncontentious employment law matters. His experience includes advising on engagement and dismissal matters, executive remuneration and share schemes, workforce restructurings and TUPE and redundancy issues, discrimination claims and acting in relation to posttermination restrictive covenants, including handling High Court claims and injunction proceedings. Anna Robinson is a solicitor in the Employment Team. Annaʹs practice includes a broad range of contentious and non contentious matters. She regularly prepares policies and procedures, advises in relation to disciplinary/ grievance processes, manages tribunal claims and assists in connection with matters of a contractual nature. In addition, Anna has extensive immigration expertise, particularly in relation to the Points Based System, and has acted on behalf of individuals in relation to immigration proceedings in the Asylum and Immigration Tribunal and the Court of Appeal. 8 07 TEAM PROFILE Devan Khagram Solicitor Constance Daws Solicitor Elliott Marsh Paralegal Devan Khagram trained with Watson, Farley & Williams and is a solicitor in the Employment Team. He has experience in contentious and noncontentious employment law which includes drafting employment contracts, negotiating settlements, advising on compromise agreements and advising on the employment aspects of share and business acquisitions. Devan also specialises in immigration matters such as all aspects of the Points Based Immigration System including investors, entrepreneurs and Tier 2 and naturalisation applications. Devan is the co author of the Immigration chapter of the UKTIʹs ʺInvestorʹs Guide to the UKʺ publication. Constance Daws is a solicitor in the Employment team, based in. She specialises in a broad range of employment and immigration issues, and deals with both contentious and non contentious employment law matters. Since joining Watson, Farley & Williams, Constance has worked in the firmʹs and Piraeus offices. Elliott Marsh is a paralegal in the Employment Team. He specialises in corporate immigration and has advised on all aspects of the Points Based System. His experience extends to business visitor, settlement and naturalisation applications, amongst others.
