8 ACISS# Suspect: Fernando Rodriguez Inv. A.M.Cobb Florida Department of Agriculture and Consumer Services Office of Agricultural Law Enforcement Bureau of Criminal Investigative Services Region 4 This investigation is related to unlicensed/registered Private Investigator operating in the State of Florida. On 6 June 2013, I was assigned to investigate a complaint against Fernando Rodriguez H/M 01/14/1974, and affiliated business (es), (Global Intelligence Agency). This complaint was referred to the Office of Agricultural Law Enforcement (OALE) by the Division of Licensing (DOL). Upon receiving this investigation, I reviewed documentation supplied by the DOL in reference to a regulatory investigation that was conducted by their office on the above mentioned subject and business(es). It was said in the provided documentation that during the period of 22 March 2013 to Present, in Volusia County, Florida Subject/Business was said to knowingly violate Cease and Desist Orders Issued by the department on both 18 April 2012, and 25 March 2013, during the course of activities regulated by chapter 493, Florida Statutes, when the agency solicited private investigative work through numerous web pages and obtained and performed regulated activities for a client. Also stated in the documentation, was during the above period to present in Volusia County, Florida, Subject/Business advertised the business of a Class A private investigative agency after suspension, expiration, denial, or revocation of its Class A License, when the agency performed regulated services for a client. It was said that during the period of 22 March 2013 to 13 April 2013, in Volusia County, Florida, the subject named above knowingly violated Cease and Desist orders issued by the department on both 23 May 2012 and 15 April 2013 during the course of activities regulated by chapter 493 Florida Statutes when he performed the duties of a private investigator for a client. The above mentioned subject, during the same period also was said to perform the duties of a private investigator after revocation of the subjects Class C License. On 6 June 2013, I performed a criminal history check on Fernando Rodriguez and also verified the current address that he is utilizing on his driver s license. I reviewed all supplied documentation provided by the DOL. On 7 June 2013, I spoke with witness Laura Coleman and updated her on what the happenings were with the case being turned over to me. I was able to update her information and obtain from her the residence address and information of the location that subject Rodriguez was hired

9 to conduct surveillance on. Laura stated that Gary Miller has still been receiving contact from Fernando Rodriguez. I attempted to make contact with Mr. Miller however that was unsuccessful. I informed Laura that I would meet with her to obtain a sworn statement at a later time. I conducted a search of the business names provided to me and found that subject Rodriguez has registered for two (2) fictitious names. On 20 May 2005, he registered attached document for Global Investigative Research Bureau, and on 13 May 2011, he registered attached document for Global Intelligence agency. A search for agency names revealed that a Class A License had only been issued to Global Intelligence Agency. A copy of the status is attached listing Fernando J. Rodriguez as the owner. A web search of the associated cell phone number was conducted and revealed a website was active advertising with the listed number. A search revealed an unrelated Cheaters Investigative Agency, LLC in Homasassa, Florida. On 10 June 2013, I conducted visual address checks at the provided business and residential addresses on file. I was unable to establish any type of connection to the business in question to the addresses provided. All addresses were not operating as a private investigative business and the residential address had no identifying factors that linked the subject Rodriguez to the location. An operational plan will be conducted and formal contact will be attempted with the subject at a later date. An operations plan has been created and approved. A covert sting operation will take place at a pre-determined date and time. On 18 June 2013, I reviewed an online add presented on Youtube displaying the subjects cell phone number. The solicitation advertised private investigative services in Miami and Orlando Florida and has video footage of private investigative surveillance work. On 1 July 2013, contact was made via controlled text message to Fernando Rodriguez at the advertised cell phone/business phone number. An attempt to meet Rodriguez and conduct the sting operation was unsuccessful. Rodriguez only wanted documents to be mailed to his PO Box and a money order made out to his wife. On 22 August 2013, a controlled call/text message was placed to Fernando Rodriguez and he agreed to conduct private investigative services for Investigators. A meeting was arranged for 12:00 pm on Wednesday 28 August 2013 at a construction lot provided by Bobby VonHerbulis, owner of McKee Construction at the corner of School Rd. and Monroe Rd. in Sanford, Seminole County Florida. On 28 August 2013, at approximately 1248 hrs. Fernando Rodriguez arrived at the pre-determined location and met with undercover investigators: A.M.Cobb and J. Velazco. Mr. Rodriguez provided the investigators with an invoice for security investigative services displaying his Company Name, Business Phone Number, Business , a state registration number (Later Found to be Fictitious), Total amount due ($ ), and Fernando Rodriguez s name. Mr. Rodriguez agreed to perform regulated private investigative services for the undercover investigators. After establishing the agreement Mr. Rodriguez was placed under arrest for soliciting to perform private investigative services while not licensed in the state of Florida as a private investigator F.S.S (1). Mr. Rodriguez was also charged with

10 uttering a False/Forged instrument for providing the invoice which contained a false G license number (G ) F.S.S After being placed under arrest, Mr. Rodriguez was transported to the Seminole County jail and booked without further incident.

14 OALE Case /2 Lt. Thomas Raulerson On 8/28/2013 at approximately 12:00 pm I assisted Inv. Cobb with an undercover operation on School Rd, Sanford, FL. The purpose of the operation was to obtain evidence against and arrest an unlicensed Private Investigator. My responsibility was the operation and monitoring of the remote digital recording device. The operation was conducted and a recording was made of the conversation between the suspect, Inv. Velazco and Inv. Cobb. The operation concluded without incident. On 8/29/2013 I created two CD copies of the recording and turned them over to Inv. Cobb. A copy of the recording was also attached to this report. NFI
