2 REQUEST FOR QUALIFICATIONS (RFQ) CONSTRUCTION MANAGEMENT SERVICES FOR MODERNIZATION AT SIX SCHOOL SITES AND POSSIBLE FUTURE PROJECTS The Dinuba Unified School District, located in Dinuba, Tulare County, California ("District") is requesting Statements of Qualifications (SOQ) from qualified consultants who are experienced in the construction of public school facilities in Central California, and are experienced in working with architects, contractors and other facility related consultants as the representative of the District in establishing project scope, project budgets, bidding procedures under both public contract code and alternative construction delivery methods and in representing the District throughout the construction of both modernization and possibly future new construction projects. Although it is subject to change, at the present time, the projects will be constructed under a lease-leaseback arrangement pursuant to Education Code section If the District proceeds with constructing the projects using the leaseleaseback construction delivery system, Oral Micham Construction Company and Harris Construction Company will serve as the lease-leaseback contractors and are currently contracted by the District to provide pre-construction services. Qualified consultants are invited to submit an original via or postal service, plus provide five (5) hard copies of said statement of qualifications that meet the requirements described herein by no later than 11:00 a.m. on April 16, 2014 to the following address: Peggy Garispe Director of Business Services Dinuba Unified School District 1327 West El Monte Way Dinuba, CA This Request for Qualifications does not commit the District to award a contract or pay any costs incurred in the preparation of a statement responsive to this request. The District reserves the right to accept all or part of any statement or to cancel in part or in its entirety this Request for Qualifications. The District further reserves the right to negotiate changes in and to accept the statement(s) that it considers to be in the best interest of the District. 3 GENERAL INSTRUCTIONS Submittal of SOQ s should be reviewed for accuracy before submission to the District since SOQ s may not be adjusted after submission to the District. The District will not be responsible for errors or omissions in any SOQ s. The District reserves the right to reject any and all SOQ s, or to waive any irregularities, or informalities in the SOQ s. 1. Signatures - All SOQ s must include a signature of an authorized officer of the General Contractor submitting the statement. The name and title of the person shall be included following the signature. 2. Project Descriptions The six (6) modernization projects have been approved by the Division of State Architect (DSA) and are awaiting a funding apportionment by the State Allocation Board which is expected to occur in spring, The total estimated construction cost for all six (6) projects is estimated to be $ 15.9 million, excluding soft costs. Additional projects beyond the six (6) modernization projects currently being processed through the Office of Public Construction (OPSC) have not been determined. 3. Contacts - In order to control information disseminated regarding this Request for SOQ s, General Contractors interested in submitting SOQ s are directed not to make personal contact with members of the Governing Board and District Administration, with the exception of the individual listed below: Peggy Garispe Director of Business Services Dinuba Unified School District 1327 West El Monte Way Dinuba, CA pgarispe@dinuba.k12.ca.us It is the desire of the District to select a Respondent that can meet or exceed the requirements set forth by the District and to provide comprehensive construction management services at the lowest cost and highest quality. It is the intent of the District to award a construction management services agreement to one consulting firm for all six (6) modernization projects that could also include additional future projects. 4 Submittals Instructions 1. Written Statements of Qualifications - SOQ s must be received via or postal service by Peggy Garispe, Director of Business Services, Dinuba Unified School District, 1327 East El Monte Way, Dinuba, CA no later than 11:00 a.m. on April 16, Disqualified Statements of Qualifications - Any SOQ received after 11:00 a.m., on April 16, 2014 will be refused. 3. Withdrawal of Statements of Qualifications - A consultant may withdraw its SOQ, either personally or by request, at any time before 11:00 a.m. on April 16, Copies - Each construction management consultant submitting a SOQ must include an electronic version, plus five (5) hard copies of the original. The electronic version should be sent by the due date/time to pgarispe@dinuba.k12.ca.us. Description of Projects The projects can be best described as typical modernization projects at six (6) campuses: Dinuba High School, Washington Middle School, and five elementary schools; Grand View, Jefferson, Lincoln, and Wilson. Project Commencement May Project Completion May 2015 Project Budget The current construction estimate for the Modernization Projects (hard construction costs) is as follows: Dinuba High School $ 3.6 M Lincoln Elementary $.7 M Washington Middle School $ 5.1 M Wilson Elementary $ 3.1 M Grand View Elementary $.9 M Jefferson Elementary $ 2.5 M Page 4

5 Special Conditions 1. Public Record - All SOQs submitted in response to the RFQ become the property of the Districts public records and as such, might be subject to public review. 2. Non-Discrimination The District does not discriminate on the basis of race, color, national origin, religion, age, ancestry, medical condition, disability or gender inconsideration for an award of contract. 3. Drug-Free Policy and Fingerprinting The selected Construction Management Consultant shall be required to complete any and all fingerprinting requirements and criminal background checks required by State law and shall be required to complete a Drug-Free workplace certificate. 4. Costs Costs of preparing a SOQ in response to this RFQ solely the responsibility of the Respondent. 5. Insurance It shall be the sole responsibility of the Construction Management Consultant to provide all any insurance the successful Consultant deems necessary to project said consultant during the term of said agreement to provide construction management consulting services for the aforementioned six (6) modernization projects and any possible future projects. 6. Limitations This RFQ does not commit District to award a contract, to defray any costs incurred in the preparation of a SOQ pursuant to this RFQ, or to procure or contract for work. The District reserves the right to waive any irregularities in the responses received pursuant to this RFQ, or in the process outlined herein for selection of a contractor for the Project. 7. Termination In any contract entered into between the District and contractor, District shall retain the right to terminate the contract for inadequate performance. SCOPE OF SERVICES The successful consultant for construction management services must provide all services to be identified in a future consultant services agreement and/or other contract documents mutually agreed to by the District and Consultant including, but not limited to, the items listed below under pre-construction and construction services. 6 Pre-Construction Services 1. Work with District staff, lease-leaseback contractor and school site staff to develop construction staging plan with regard to unoccupied and occupied school campuses, limited parking, traffic flow and safety needs. 2. Along with the project architect and contractor, undertake value-engineering analysis and prepare report with recommendations to District to maintain established the construction project budget. 3. Work with the project contractor to insure all required permits, inspections and approvals necessary to complete the project are obtained in a timely manner. 4. Work with District staff and the lease-leaseback contractor in arriving at the cost of the general conditions to be included in the Guaranteed Maximum Price (GMP) for each modernization project. 5. Along with District staff, work with the lease-leaseback contractor to determine the appropriate project contingency to be incorporated into the GMP. Construction and Post Construction Services 1. Serve as the District s representative during the construction of the modernization projects. 2. Attend job site meetings as required. 3. Serve as the District s representative in resolving issues related to plans and specifications. 4. Make recommendations to the District administration related to the use of project contingency funds. 5. In cooperation with the lease-leaseback contractor and project architect, provide the administration with the necessary change order documentation in a format that will allow the district administration to make timely reports to the Governing Board on the status of the contingency allowance for each of the six (6) modernization projects. 6. In cooperation with the project inspector contracted by the District, insure that all DSA requirements are met throughout the construction of said projects. 7. As the District representative, insure that the plans and specifications are fully adhered to by the lease-leaseback contractors on the modernization projects. 8. Work with district staff to obtain, if necessary, any substitution of material or deviation of plans and specifications recommended by the project architect and/or lease-leaseback contractor. 9. Work with the lease-leaseback contractor and project architect to make sure all required operations and maintenance manuals, warranties/guarantees and certificates are delivered to the District prior to project close-out. 10. Insure that the District is provided with accurate as-built plans at the conclusion of each of the six (6) modernization projects. 11. If requested, complete a final report and presentation, if necessary, to the Governing Board detailing the work completed and a comparison of projected costs to actual costs. Page 6

7 12. Assist the District in any issues that might arise with OPSC during the construction of the modernization projects. 13. Work with the lease-leaseback contractor, project inspector, testing lab and project architect to insure that all required documents are submitted to DSA and provide the District administration with a copy of all required DSA close-out documents. 14. Provide the district administration and Governing Board, if requested, with timely updates throughout the construction of the modernization projects. 15. Provide other services as requested by the district administration during the construction of the modernization projects. 16. Attend meetings of the Governing Board if requested. STATEMENT OF QUALIFICATIONS FORMAT AND CONTENT In order for SOQ s to be considered, said SOQ must be clear, concise, complete, well organized and demonstrate both respondent s qualifications and its ability to follow instructions. The quality of answers, not length of responses or visual exhibits is what is important in the SOQ. Five (5) bound copies of the SOQ should be provided with all materials spiral bound into books of approximately 8 ½ x 11 format, not to exceed ten (10) pages each. An electronic version must also be sent to pgarispe@dinuba.k12.ca.us All respondents are requested to follow the order and format specified below. Please tab each section of the submittal to correspond to the number/headers shown below: 1. Submittal Cover Include the RFQ s title and submittal due date, the name, address, fax number and telephone number of the consultant. 2. Table of Contents Include complete and clear listings of headings and pages to allow easy reference to key information. 3. Body of Submittal The following sections should be included in the order listed below: A. Cover Letter The cover letter should be brief (one page maximum). Describe how the Scope of Work will be Page 7

8 accomplished for the District and include the signature of the consultant. If the consultant is proposing to co-respond with a consulting partner, the cover letter must identify the name of said consultant. B. Experience in Managing Construction Projects Describe your experiences/background in providing the construction management services required by this Request for Statements of Qualifications, especially public school modernization projects. Provide a list of similar projects where you served as a school district representative on construction projects (preferably modernization projects) while either serving as a school district employee or consultant to the district. Detail any experience you have in completing projects funded through OPSC and your knowledge of the requirements of this funding program. C. Project Team a. Identify key team member(s) for these Projects and provide their qualifications. b. Describe how the Projects would be staffed. D. Client Satisfaction/References Provide a list of at least two educational client references for which you have performed construction services as either a school district employee or consultant to the school district similar to those required by this Request for Qualifications. References must include: a. Name, address, telephone number, and a contact person of the client. b. Name, address, telephone number and a contact person for the architect(s) working on the project(s). c. Describe the project(s) on which you provided construction management services. E. Price Structure and Fees. a. Describe the proposed fee for providing the construction management services outlined in the Request for Qualifications. b. Identify if you fee would be based solely on an hourly rate or whether the fee would include a maximum not to exceed for each project. c. Identify any additional fees you are proposing (mileage, supplies/materials, cell phone, etc). d. Because the six (6) modernization projects are being fully funded by the SAB/OPSC, include a clause in this section that you will provide an accounting to the district administration along with each invoice on the portion of the invoice to be charged to each respective modernization project and that all required supporting documents will be included with said invoices as required by the District. 9 F. Evaluation of Responses to the Request for Proposals Submittals received by District will be evaluated according to the criteria listed below: 1. Conformance to the specified RFQ format; 2. Organization, presentation, and content of the submittal; 3. Experience of consultant; 4. Knowledge of and experience in working on OPSC/SAB funded project; 5. Ability to meet the requirements of the District in a timely manner; 6. Ability to carry out the scope of work outlined in the Request for Proposals 7. Proposed fee. METHOD OF SELECTION The District may conduct interviews with the most qualified consultants that submit responses that are responsive to this RFQ. The District will evaluate consultants on their demonstrated competence and on their professional qualifications necessary for the satisfactory performance of the services required, as evidenced in their responses and/or interviews. The District may negotiate the proposed fees for construction management services to arrive at a fee that is fair and reasonable for both parties. SELECTION CRITERIA All Statements of Qualifications submitted in response to this Request for Qualifications will be evaluated to determine the consultant that can best meet the needs of the District, the requirements of the Projects, and the services to be provided. The selection criteria may include, but not be limited to, the items listed below: 1. Ability to communicate with District personnel, the architect, lease-leaseback contractor, project inspector and other personnel on the projects, which will include at minimum a weekly construction meeting with the district and all project personnel; 2. Experience and expertise of the consultant in providing construction management services; 3. Past record of delivering public, educational projects on time and within budget as either an employee of a school district or as a consultant to a school district; 4. Completeness and quality of the Statement; 5. Recommendations of references; 6. Oral interview (if needed); 7. Price structure/fees; 8. Experience with State (DSA and OPSC) authorities for school facility projects Page 9
