I am in the process of sending Law Enforcement Support Office (LESO) Program updates to all participating law enforcement agencies in Vermont and this is yours. The Defense Logistics Agency is suffering through many of the same budget constraints that you hear about in the news. The Law Enforcement Support Office, as an instrument of the DLA, is bearing much of the pain and you will see their ability to respond to customer requests slow down. The LESO office has several requirements that have emerged from a top-to-bottom review of their existing accounting procedures. The most important: each participating LEA must sign a new Memorandum of Understanding between themselves and the program ("me"). This document spells out how excess property can be acquired and how it must be maintained, based on certain disposition codes. The last signed version of this memo is from October 18, 2005 by Sheriff Amos Colby. I should receive an updated version which I will sign and then send to you. The next version is currently with Department of Defense lawyers. Another requirement will be improved accountability of weapons and this will mean photographing the serial numbers of the two LESO weapons you acquired through the program in addition to signing an annual accountability letter. Please keep a copy of this letter in your LESO files or binder. I hope your department can take advantage of the program and find equipment pieces that can help your department. Vehicles, right now, seem to be an easy acquisition. Three weeks ago we secured two Highly-mobile, Multi-purpose, Wheeled Vehicles (Humvees) for the Lamoille County Sheriffs Department. I am glad we had the opportunity to talk this afternoon on the phone, I want to make sure your department continues to have a clear opportunity to find and requisition surplus Department of Defense equipment. It is also important to understand that the 1033 Program is much more than weapons. It is also a source of potential office furniture, exercise equipment, vehicles and different types of law enforcement equipment. We need to accomplish several things in the next 30 days. The first is to have you fill out the enclosed Law Enforcement Agency Application for Participation. I have partially filled out the form for you. Please fill in the highlighted areas. I will submit this updated application to the Defense Logistics Agency for their approval. Following the acceptance of your application, you can start screening for different pieces of equipment. I will be the in-state approval for these future requisitions. I have enclosed a brochure for your use which further describes what the Law Enforcement Support Office can do. The most immediate task your department needs to complete is our annual 100% check on controlled property. You have two weapons from LESO. Please fill out the enclosed inventory sheet with a simple confirmation of the weapons and a legible name and signature and then send it back to me. In 2012 I may visit your department and we will do the annual inventory in person; I have a requirement for a certain number of visits throughout the state per year. 3 VERMONT NATIONAL GUARD COUNTERDRUG TASKFORCE GMA, Camp Johnson Colchester, VT October 2000 Dear Sheriff/Chief; I want to take this opportunity to introduce myself as the newly appointed Counterdrug Coordinator and 1033 Program Coordinator for the State of Vermont. As such, I have appointed SGT Mark Fraser, VTARNG, as the Program Administrator for the State of Vermont. We will do our best to carry on the tradition of service and commitment of our predecessors (LTC Lewis and MSgt Bean, respectively), hopefully with some fresh ideas and new direction. To that end, we would like to start with a complete review and verification of existing records and documents. This would include; Data Sheets, Memorandum of Agreement, Inventory List, and other pertinent and controlling information. If you would compare your records with the attached and notify our office of any discrepancies and/or corrections. Of importance is the current status of items procured through the 1033 program, regardless of date, and any current personnel changes with contact numbers, such as; telephone, fax, , etc. You should note too, that if there has been a change in the Head of the Agency position, there necessarily needs to be new signatures on all forms and agreements. Under Section 1033, the Secretary of Defense may transfer Department of Defense Excess Personal Property that he determines is suitable for use by the agencies in Law Enforcement activities to include counterdrug and counter-terrorism activities. Each Law Enforcement Agency may request enrollment in the section 1033 by completing the Law Enforcement Agency Data Sheet (LEADS) and the Memorandum of Agreement and forwarding the completed copies to the Vermont National Guard, ATTN: VT-CD Green Mountain Armory, Camp Johnson Colchester, VT The Defense Logistics Agency (DLA) will issue a letter of authorization to allow Law Enforcement Agencies to screen excess equipment at the Defense Reutilization Marketing Offices (DRMO). Sheriff Colby and I finally made contact this morning, November 5, I explained to Sheriff Colby that Vermont Management could not screen for surplus property because the rules and regulations permit screening only by Law Enforcement Officers, with arrest authority, and Corrections Officers. This requirement prevents most Town Constables from screening unless they happen to have arrest authority. Sheriff Colby informed me that he had three Deputies in his Department that have been on the authorized screening since April His problem, as he explained it to me, is not knowing when and where screening will take place. After my conservation with Sheriff Colby, I contacted Lt.Col Haggerty at Camp Johnson. Lt. Col Haggerty administers the surplus property at Camp Johnson. He informed me that his records confirmed that Sheriff Colby does have screening authority. I asked if there was some way of informing Sheriff Colby of screening dates and locations. Lt Col Haggerty said he would fax a schedule to the Essex County Sheriffs Department and would also call and talk to Sheriff Colby regarding his needs. After talking with Lt Col Haggerty I called Sheriff Colby and informed him that a schedule was being sent to him and that Lt Col Haggerty would call him regarding surplus property availability. 7 Dear Senator Illuzzi; Thank you for your inquiry concerning your eligibility to act as a Screener of Excess Government Equipment. Unfortunately, you do not meet the eligibility requirements. Under Section 1003 of the National Defense Authorization Act of Fiscal Year 1997, the Secretary of Defense was authorized to transfer to Federal and State Law Enforcement Agencies personnel property that was excess to the needs of the Department of Defense. The Defense Logistics Agency (DLA) determines weather property is suitable for use by agencies in law enforcement. The DLA defines agencies in law enforcement to be those agencies that have the primary function of enforcement of applicable federal, state, and local law and whose compensated law enforcement officers have powers of arrest and apprehension. The equipment that is declared excess is maintained at the Defense Reutilization and Marketing Sites (DRMS). If you have access to the Internet, you can review what equipment is available through the DRMO Web Site at The Essex County Sheriffs Department is authorized to screen equipment at the DRMS locations. The Vermont National Guard Counterdrug Support Office may be able to assist the Sheriffs Department in locating excess equipment for their department. Each Drug Law Enforcement Agency (DLEA) can request acceptance into the excess government program by submitting a letter to the Counterdrug Coordinator, ATTN: RLSO, Green Mountain Armory, Camp Johnson Colchester, VT Your letter to request participation in the section 1208 program should include the following information: 1. Submitted on DLEA letterhead 2. Description of DLEA counterdrug mission 3. Specialty Equipment Request (i.e. weapons, protective masks, etc.) 4. Type of equipment required 5. The intended use of equipment 6. Point of contact with telephone/fax numbers 7. Location of Defense Reutilization Marketing Office (DRMO) that the DLEA wishes to screen excess government property 8. Name and social security number of two (2) individuals who will be screening equipment The 1208 program coordinator will validate the drug law enforcement mission and provide the DLEA with a Memorandum of Agreement (MOA) for your signature. Once the MOA is signed and returned to the 1208 Program Coordinator, the Regional Logistics Support Office (RLSO) will issue the DLEA a Letter of Authorization entitling the DLEA to use the program, which will be valid for one year.
