2 HOW DOES THE PROGRAM WORK? The program is intended to cover the Physical Property and Commercial General Liability of MABC members operating, or working out of, a Midwifery Practice. To apply for coverage on the program MABC members will be required to complete a 1-page insurance application and submit it to Shaw Sabey & Associates Ltd. for approval and binding. A Midwifery Practice Insurance Policy will be issued to the MABC member(s) as evidence of coverage for participating within the program. Premiums are paid directly to Shaw Sabey & Associates Ltd. by participating members. The Program will be based on a Master Policy with specific coverages and rates. Members will be able to choose to tailor their Practices coverage based on their own circumstances and coverage requirements over and above the base coverages set. 2
3 WHO IS INSURED ON THE MIDWIFERY PRACTICE PROGRAM If the Midwife or Midwives are designated on the Policy Declarations as: 1) Individual(s), the midwife (hereafter referred to as you ) and their spouse are Insureds, but only with respect to the conduct of business as a midwifery practice. 2) A partnership, limited liability partnership or joint venture, you are an Insured. Your members, your partners, and their spouses are also Insureds, but only with respect to the conduct of business as a midwifery practice. 3) A limited liability company, you are an Insured. Your members are also Insureds, but only with respect to the conduct of business as a midwifery practice. Your managers are Insureds, but only with respect to their duties as your managers. 4) An organization other than a partnership, limited liability partnership, joint venture or limited liability company, you are an Insured. Your "executive officers" and directors are Insureds, but only with respect to their duties as your officers or directors. Your shareholders are also Insureds, but only with respect to their liability as shareholders. 5) A trust, you are an Insured. Your trustees are also Insureds, but only with respect to their duties as trustees. Each of the following is also an Insured: 6) Your "volunteer workers" only while performing duties related to the conduct of the midwifery practice, or your "employees" but only for acts within the scope of their employment by you or while performing duties related to the conduct of your business. 3

Personal Property of Officers and Employees $1,000 in respect of any one officer or employee subject to an aggregate limit of $25,000 in any one occurrence. 22. 7 FREQUENTLY ASKED QUESTIONS WHAT ABOUT COVERAGE FOR MIDWIVES WHO DO NOT OPERATE OR WORK OUT OF A SINGLE PRACTICE? Midwives that work out of their own homes or do not have a fixed location will be eligible to purchase coverage on the Midwifery Practice Program subject to review of a completed application and underwriting. WHAT ABOUT COVERAGE FOR OUT-OF PROVINCE OR OTHER LOCUM MIDWIVES WHOM DO NOT HAVE THEIR OWN INSURANCE WHILE OPERATING IN BC? Locums can be added to a Practice Policy as an Insured for the duration of their locum placement. Practice owners should ensure that all locums are reported to Shaw Sabey. Additional premium may apply depending on duration of locum placement. ARE STUDENTS COVERED? Yes, students are automatically covered while training at an insured practice. WHERE AM I COVERED? Anywhere you are operating in Canada, including hospitals, ambulances, client s homes, short term locum placements at other practices etc. IS MY EQUIPMENT COVERED WHILE IN MY CAR? Yes, up to a limit of $7,500 and only if the car is locked while unattended. 7
8 OPTIONAL COVERAGE - Legal Expense Coverage Option 1 $50,000 on Legal Expense - $35 Additional Premium Legal expense insurance which gives you up $50,000 worth of a lawyer s time and services per claim with an annual aggregate of $250,000. You also get unlimited access to a legal advice helpline. Covered legal expense claims include: Defense of Fines, Criminal Charges, WorkSafe BC Investigations Defense of a claim alleging failure to comply with privacy legislation Tax Protection Defence in responding to a tax audit or while appealing a CRA decision with respect to their business tax returns Unlimited Legal Advice and Tax Advice Option 2 $200,000 on Legal Expense - $140 Additional Premium Broadened Coverage highlighted Legal expense insurance which gives you up $200,000 worth of a lawyer s time and services per claim with an annual aggregate of $1,000,000. You also get unlimited access to a legal advice helpline. Covered legal expense claims include: Employment Disputes Defense of Fines, Criminal Charges, WorkSafe BC Investigations Statutory License Protection Defense of a claim alleging failure to comply with privacy legislation Contract Disputes & Debt Recovery Property Protection Bodily Injury Tax Protection Defence in responding to a tax audit or while appealing a CRA decision with respect to their business tax returns Unlimited Legal Advice and Tax Advice *Please note there is a 90 day waiting period on Legal Expense claims from the time we initiate coverage. (ie. They will not accept a claim within the first 90 days. Once the waiting period is done, claims will be reviewed for as long as you maintain coverage).
