If the items were purchased privately, you should obtain a dated statement with the seller s name and address, showing what was purchased and the price. To document replacement value, stores will usually issue a copy of the original receipt. 13 Your possessions / contents cover 14. LIABILITY LIABILITY FOR DAMAGES The insurance covers any legal liability for personal injury and damage to property that you incur as a private individual as well as certain acts committed by small children. According to Danish case law, you will be legally liable if you inflict damage by error or omission. The general rule is that you have neglected to do something or have done something that you should not have done. This general rule is not laid down in any Act. It has evolved through many years of case law. Legal liability covers personal injury up to DKK 10 million and damage to property up to DKK 2 million. ACCEPTANCE OF LIABILITY FOR DAMAGES We are only liable to compensate costs that were paid with our approval. Your acceptance or payment of a claim for damages does not make us liable. If you accept liability for damages, you risk having to pay the damages yourself. You should always contact us before assuming liability for damages. YOUR LIABILITY As a private individual As a tenant in relation to a landlord under the provisions of the Danish Rent Act (lejeloven) concerning a tenant s liability for damage caused by the installations carried out by the tenant with the approval of the landlord. The tenant s liability for the rest of the rented premises is not covered by the insurance As an owner or user of horses and other domestic animals for private use, although not dogs (see Does not cover). As a landowner of a private plot and a single-family or semi-detached house if the house is mainly used for habitation and you live in the house and buildings insurance comprising liability cover has not been taken out (see also the limitations under The following liability is not covered ) As a landowner of a holiday home and plot if buildings insurance comprising liability cover has not been taken out (see also the limitations under The following liability is not covered ) Below are a few typical situations that, from experience, give rise to problems. DAMAGE CAUSED BY CHILDREN In the same way as adults, children may incur independent legal liability. However, case law suggests that children under 5 will not normally be held liable for their acts, and they will thus not have liability for damages imposed on them. However, the insurance provides cover if the age or immaturity of the child is the only reason for the exemption from liability. There is no cover for accidental damage. The cover is subject to an excess of DKK 2,000. Parents will normally only be liable for damage caused by a child if they have left the child unattended. DAMAGE CAUSED BY GUESTS This is damage to property during a normal private gathering, where the legal assessment would typically not make the person causing the loss liable for damages, as the damage was caused by slight negligence or culpability during this gathering. There is no cover for accidental damage. The cover is subject to an excess of DKK 750. CALCULATING COMPENSATION 16.3 CASH PAYMENT 16.5 COMPENSATION TABLES The compensation must, as far as possible, place you in the same financial situation as you were in immediately before the loss. We can choose between the following ways of compensating the loss REPAIR We pay what it costs to repair the damaged property so that, as a whole, it essentially has the same appearance with the same applications, performance and utility value as before the damage. - However, the repair cost may not exceed the value of the damaged property, calculated according to the rules on depreciation. See sub-clauses If the repair cost amounts to more than 50% of the replacement value of the damaged property, you may claim replacement or a cash payment REPLACEMENT If repair is not possible, we may deliver an equivalent item. We may replace items that were purchased used or are more than 2 years old with equivalent used items if this is feasible without considerable inconvenience to you. For new items, i.e. items purchased new within the past 2 years that are otherwise undamaged, the replacement value is paid, equivalent to the price of replacing the item with an equivalent new item from the supplier advised by us. For used items, i.e. items that are 2 years old or more or were purchased used and are otherwise undamaged, the compensation is fixed as the replacement price for an equivalent used item from the supplier advised by us. If we are unable to advise you of a supplier, the compensation is fixed for used items at the replacement price for new items less a reasonable deduction for reduction in value as a consequence of age, use etc. A further condition for used items is that, if identical items cannot be obtained, we pay a cash payment equivalent to the price of an equivalent used item that is comparable in terms of quality, value, performance, application and appearance. We deduct the discount that we obtain from a supplier from the cash payment REDUCTION IN VALUE Compensation for reduction in value may be relevant in some cases if the damaged property remains usable after repair but to a decreased extent or with less value. We do not send you a new policy. As the insurance is subject to payment via Betalingsservice, you must contact us and arrange payment. LATE PAYMENT If the premium is not paid on time, you will receive a reminder. If the premium has not been paid within 21 days of the first reminder, the insurance will lapse. If we send you a reminder, we will be entitled to charge an administration fee, default interest and any other costs. In addition, we will be entitled to charge an administration fee, a fee for printing documents and other services to cover our costs. If these costs increase, we will be entitled to raise our fees to cover the actual costs. Indexation follows the wage index for the private sector published by Statistics Denmark. If this index ceases to be published, or if the basis of the index is changed, we will be entitled to use a similar index from Statistics Denmark. Sums insured, excesses and other amounts are indexed if this is stated in the insurance terms and conditions or the policy. Indexation takes place once a year on 1 January. The premium is indexed once a year on the first date of payment in the calendar year. Indexation is based on the index for the first quarter in the preceding year. YoungLiving / 39 af 41
