1 Contents Insurance terms no This is a translation of the original Danish Insurance Terms and Conditions. In case of any discrepancies, the wording of the original shall prevail. Contractual basis The insurance policy comprises the insurance agreement (the policy), any policy endorsements and the insurance terms. In addition, the insurance policy is subject to the Danish Insurance Contracts Act (forsikringsaftaleloven) and the Danish Financial Business Act (lov om finansiel virksomhed) unless derogated from by these terms. Supervision and Guarantee Fund for Non-life Insurance Companies Tryg is subject to the supervision of the Danish Financial Supervisory Authority and is a member of the Guarantee Fund for Non-life Insurance Companies. 2 Right of withdrawal Only applies to private consumer policies You have a right to withdraw from your purchase of private insurance, but this depends on three different situations: You met with our agent when you purchased your insurance You did not meet our agent in person when you purchased your insurance (distance sale) Your insurance policy has been changed, and you are now entitled to refuse to accept such change Sections 34e and 34i of the Insurance Agreements Act contain more information on your right of withdrawal. Withdrawal period The withdrawal period is always 14 days. The starting point of this period depends on how the agreement was made, see Items If you met with our agent when you purchased your insurance, the withdrawal period starts on the latest of the following days: a On the day when you were notified that you purchased the insurance. b On the day when you received clear written information on your right of withdrawal. 2. In the case of a distance sale, the withdrawal period starts on the latest of the following days: a On the day when you were notified that you purchased the insurance. b On the day when you received the information that we are obliged to send you by letter or In the case of changes, the rules in 1 and 2 above apply. Please note that your right of withdrawal only applies to the change in the case of an extension of cover. The 14-day withdrawal period is determined as follows: If, for example, you buy your insurance on Monday the 1st, but you do not receive the information until Wednesday the 3rd, the withdrawal period will expire on Wednesday the 17th. If the withdrawal period expires on a public holiday, a Saturday, Sunday, Constitution Day (5 June), 24 December or 31 December, it will not expire until the following weekday. How to withdraw from your purchase You must notify us that you wish to withdraw from your purchase before the withdrawal period expires. You may inform us of this either by letter or by . If you would like documentation showing that you sent your notice before the expiry of the withdrawal period, send your notice by registered letter and retain the receipt. However, this means that if a claim occurs in the period from when you purchased your insurance and when you withdraw, this claim will not be covered by the insurance. If you purchased the insurance through a distance sale, you may cancel the purchase if you have not received additional relevant information from us. The purchase will be cancelled from when you submit a notice of cancellation. However, please note that you must pay for your insurance until you cancel the purchase, except for the first 14 days which are included in the general right of withdrawal. When reading the terms, please note: The insurance agreement shows the cover, sums insured and deductibles that you have chosen for your policy. How the indemnity is calculated. In the event of a claim: Report the claim by calling Or report the claim as quickly as possible via our website tryg.dk. You must immediately attempt to mitigate the loss. However, your must not repair the damage and/or remove damaged items unless approved by us. Theft, vandalism, burglary and assault must immediately be reported to the police in the country where the incident occurred. Your responsibilities You have a number of responsibilities which may have an impact on your right to indemnity, including: Fire Oil burners, fireplaces and wood-burning stoves must be installed in compliance with the applicable regulations. Electrical damage Your electrical equipment must not be exposed to water, liquid or moisture. Your electrical equipment should only be used for the intended purpose. Theft Inside of the home: Doors must be securely locked, and windows must be closed and fastened. Do not leave windows ajar, even if a security bracket has been fitted. Outside of the home: Your car must be locked when left, and any valuables must be placed in the boot, closed glove compartments or other closed compartments. Small boats etc. must be locked to a permanent fixture. The motor must be locked to the boat. Bicycles must have a frame number and be locked using an approved lock. Bicycle trailers must be locked or mounted to the bicycle. Carbon fibre and foreign bicycles must be provided with a frame number, which may be obtained at all police stations in Denmark. If your keys are stolen, and there is a risk of abuse, you must immediately change the locks. Weapons and ammunition must be kept in a locked and approved gun cabinet. Weather damage If you live in a house, you must maintain, dimension, fit and clean your gutters and downpipes correctly. Escape Your home must be properly heated to avoid frost damage. Luggage You must ensure that your belongings are always properly packed, and that any liquids cannot damage your belongings. Documentation If you do not have receipts for the purchase of expensive items such as jewellery or designer furniture, we may refuse to indemnify your claim or assess the indemnity based on an estimate. For this reason, it is a good idea to have your jewellery valued by a jeweller and to have your designer furniture valued by a dealer. Further information on documentation is provided in Paragraph 6. Sums insured If the value of your possessions changes, you must contact us to have the sums insured changed in your insurance agreement. 2. Who is covered? The policy covers: You as the policyholder. Your spouse/co-habitant, children and up to two other persons, all resident and registered in the national register as being resident at the property insured. Flat-shares or house-shares with more residents are only covered if stated in the insurance agreement. The following persons are covered by the policy, provided that they are not covered by another policy: Joint-custody children and respite foster children when living with you. Children under the age of 18 who have left home. Spouse/co-habitant in residential home. If one of the persons mentioned above leaves the address, such person will be covered by the policy until a new policy has been purchased; however, only for a maximum of three months after moving. Lodgers and tenants are not covered. Domestic workers in the household are covered by the thirdparty liability insurance for acts performed as part of their day-to-day work in your home, including caring for your children and tending your house and garden. It is not a condition that the domestic worker lives at the address. The word 'you' under the different types of cover in the terms means: You as the policyholder and any other persons covered by the policy. 3. Where is cover provided? The policy covers your possessions in Denmark (excluding the Faroe Islands): At the property insured as stated in the insurance agreement. In a safe-deposit box in a bank. In a recognised storage hotel, store or container. In your spouse's/co-habitant's residential home. The policy also covers: Your possessions in Denmark (excluding the Faroe Islands) temporarily brought or stored outside of the property insured, for the first 12 months. When moving to a new permanent home, both in the old and in the new permanent home for up to three months from the date when your new property is made available to you. Possessions brought to a mobile home, caravan, tent, private pleasure craft, as long as you are staying there or spend the night there. 5 Your possessions for up to three months from the departure date when brought on a journey to/from and in another country, including the Faroe Islands. Legal aid and liability in Denmark. In the rest of the world, including the Faroe Islands, you are covered for up to three months from the departure date. Special conditions apply to possessions stored in a basement in a house/terraced house or in basements and attic rooms in blocks of flats. The sums insured are indicated in your insurance agreement. Temporary relocation abroad If you move abroad temporarily, e.g. in connection with secondment, the property insured in the other country must be mentioned in the insurance agreement. Cover under the policy is subject to a separate agreement with us. During secondment, the policy covers legal aid and liability in the country to which you have been seconded. 4. Which items are covered? The policy covers your private household items, i.e. items normally regarded as belonging to a private home, and: Gold, silver, jewellery, pearls and precious Cash and the like, such as gift vouchers, punch cards and credit notes. The maximum sum insured is stated in your insurance agreement. Electric scooters and electric wheelchairs with a maximum speed of 15 km/h. Bicycles and electric bicycles. The maximum sum insured is stated in your insurance agreement. Small boats up to 5.5 metres, canoes, kayaks, windsurfers and kitesurfers and the like, including equipment and outboard motors of up to 6 HP. Domestic animals not used for commercial purposes. Tools, props, instruments and medical bags without content, which you own and use in your paid occupation. Powered garden tools of up to 25 HP. Borrowed and leased items for private use. Burial plots where you pay for maintenance. White goods are considered building parts and are not covered by the policy. However, white goods are covered if you are a tenant and own the white goods. If you as a tenant, member of a housing cooperative or owner of an owner-occupied flat have a duty, under the lease, rules or articles for the housing association, to maintain the following fixtures in your home, they are also covered: Fixed glass, such as built-in mirrors and mirror doors, ceramic hobs, oven door glass and glass sections in balconies and covered patios. Fixed sanitary ware, such as toilet bowl, cistern, bidet, washbasin and bath tub, installed in their permanent positions as a building part. Movable kitchen units, white goods and glass and sanitary ware in your flat. Awnings, satellite dishes, aerials. Locks. Motorised vehicles, such as mopeds, cf. the Road Traffic Act (færdselsloven), and parts and accessories. However, car safety seats, roof boxes, tyres and rims are covered, if you no longer have a vehicle for this equipment. Pocket bikes, ATVs, choppers, personal transporters or the like as well as accessories. Caravans and trailers. Boats with inboard motors. Aircraft of any kind, including model planes weighing more than 7 kg and accessories. Items of a commercial nature. However, hobby equipment of a professional nature is covered if only used for hobby purposes. 5. Which damage is covered? Below you will find information on the types of damage covered by the policy. Your insurance agreement contains information on the cover, sums insured and deductibles that you have chosen for your policy. 5.1 Fire The policy covers damage caused by: Uncontrolled fire with flames which spreads unaided. Lightning strike, where the lightning strikes your possessions or the building directly. Explosion. Sudden sooting from candles and cooking. Sudden sooting from room heating appliances installed and approved in compliance with the applicable regulations. Damage to laundry in washing machines and dryers, when the damage is due to mechanical or technical failure. Crashing aircraft and parts falling from them. Damage caused by singeing, charring, discolouration, overheating or melting, without a fire. The damage may be caused by embers and sparks from tobacco, fireplaces or bonfires. Damage to items deliberately exposed to fire or heat, e.g. when using pots, pans, heating pads or irons. Washing or drying at excessive temperatures. 5.2 Electrical damage The policy covers: Damage caused by short-circuiting, induction, excess voltage or the like. Food that has spoiled or thawed due to accidental power failure or accidental refrigerator or freezer failure in your home. The policy also covers damage to other possessions damaged by the thawed food. Motorised and electrical equipment for outdoor use only, such as garden tools, electric scooters and electric bicycles. Damage covered by a warranty or service scheme. Damage caused by you or another person with lawful access to your home switching off the power supply. 5/19 Tryg Contents insurance Insurance terms no. 1211
6 Damage caused by exposure to water, liquid or moisture. Damage caused by faulty repair. Damage caused by an appliance being overloaded or not used for the intended purpose. Damage due to incorrect installation or faulty manufacture. Damage to items used for business purposes. 5.3 Theft and vandalism Theft Theft cover depends on whether it occurs in or outside of the home, whether the property has been securely locked, or whether there are any clear signs of a violent break-in. The sums insured are indicated in your insurance agreement. 'In the home' means: A: Inside your home (e.g. house, terraced house or flat). B: Garages, outbuildings and agricultural buildings on the same plot as your permanent home. C: Safe-deposit box in a bank. D: Recognised storage hotel, store or container. E: Residential home for spouse/co-habitant. 'Outside of the home' means: All other places, such as: Garden, greenhouse and carport. Basement and attic rooms, if you live in a block of flats. Holiday house. Sports centre and place of work. When on holiday. Securely locked means that all outer doors and other openings must be closed and locked, and that windows and the like must be closed and fastened. Windows left ajar are not securely locked, even if a security bracket has been fitted. Theft-prone items are items that, due to their value, size or marketability, are more attractive to a thief than other items; such items include IT equipment, including mobile telephones, tablets and PCs, flat screen TVs and music systems, designer furniture, watches, fur coats, art and antiques. 6/19 Tryg Contents insurance Insurance terms no. 1211
7 5.3.1 Theft in the home The policy covers theft of your possessions in the home as set out in the table below: Securely locked (see Paragraph 5.3) Not securely locked In your home, see Paragraph A Home invasion robbery It is not a requirement that your home is securely locked in the event of a home invasion robbery where a person uses force or threatens to use immediate force inside of your home. A special limitation applies to theft-prone items (see Paragraph 5.3). The sum insured is indicated in your insurance agreement. - Domestic animals. - Items located in your home when it is unoccupied or has been lent or leased to someone else. For tenants: - Movable kitchen units, white goods and glass and sanitary ware in your flat. Distraction burglary It is not a requirement that your home is securely locked in the event of distraction burglary, where the offender has gained access to your home under false pretences. Residential home, see Paaragraph E Garage, outbuilding and agricultural building on the same plot as your permanent home, see Paragraph B Safe-deposit box in a bank, see Paragraph C - Theft-prone items (see Paragraph 5.3) - Theft-prone items (see Paragraph 5.3) - Domestic animals. - Items located 'in the home' when it is unoccupied or has been lent or leased to someone else. Recognised storage hotel, store or container, see Paragraph D Does not cover The policy does not cover - Instances where windows and the like have not been closed and fastened, and you are not in your home, see Paragraph A, even if a security bracket has been fitted. - Theft of items 'in the home' when it has been unoccupied for more than six months - Theft of weapons and ammunition not kept in a locked and approved gun cabinet. - Theft in the event of gross negligence. - Theft when committed by a person covered by the policy, assistant, lodger or other persons lawfully staying 'in the home' with your permission or otherwise. - Theft of weapons and ammunition not kept in a locked and approved gun cabinet. 7/19 Tryg Contents insurance Insurance terms no. 1211
8 5.3.2 Theft outside of the home The policy covers theft of your possessions outside of the home up to the sum insured chosen by you and stated in the insurance agreement. Securely locked (see Paragraph 5.3) Not securely locked In building or room - Tools, props and instruments owned by you and used in your paid occupation, when such items are kept in work sheds. - Domestic animals. Outside of building - Domestic animals. Basement and attic rooms in blocks of flats - Theft-prone items (see Paragraph 5.3) - Domestic animals. The policy does not cover - Theft of your possessions from building or room that is unoccupied or has been lent or leased to someone else. - Theft of your possessions from building or room, when windows and the like have not been closed or fastened, and you are not in the building or room. - Theft of weapons and ammunition not kept in a locked and approved gun cabinet. - Lost or misplaced items. - Theft in the event of gross negligence. - Theft of movable satellite dishes, aerials and awnings, see Paragraph 4. - Theft of weapons and ammunition not kept in a locked and approved gun cabinet. - Items in storage. - Tools, props and instruments which you own and use in your paid occupation. 9 Clear signs of a violent break-in No clear signs of a violent break-in Hotel room/apartment, cabin, train compartment and holiday home Closed and locked car Theft-prone items (see Paragraph 5.3) stolen from a car are only covered if placed in: - a closed glove compartment or other closed compartments, - a boot locked independently of the car interior, or - under a luggage cover/hat shelf. Does not cover Closed and locked luggage locker or the like, mobile home, caravan, tent, private vessel or aircraft Theft-prone items are only covered if they are not visible from the outside. Possessions brought to a mobile home and caravan are only covered as long as you are staying there or spend the night there. 10 5.3.3 Theft of small boats etc. Theft of small boats up to 5.5 metres, canoes, kayaks, windsurfers, kitesurfers and the like is only covered if they were locked to a permanent fixture using a lock, chain or the like, which has been forced open. An outboard motor of up to 6 HP is covered if it was locked to the boat using lock fittings, and there are visible signs of violent breakage. Movable equipment is not covered. The violent breakage requirement does not apply if the theft was committed by robbery, assault or open theft Theft of bicycles and electric bicycles From securely locked home, building or room, see Paragraph 5.3 Theft of a bicycle/ an electric bicycle is covered if: The bicycle has an embedded frame number. It is possible to obtain the frame number. The theft was reported to the police. From home, building or room not securely locked or outside buildings. Theft of a bicycle and an electric bicycle is covered if: The bicycle has an embedded frame number. It is possible to obtain the frame number. The bicycle was locked using a lock approved by 'Varefakta'. The theft was reported to the police. Bicycle trailers must be locked or mounted to the locked bicycle. Carbon fibre bicycles A frame number may be obtained from all police stations in Denmark and must be fitted to the bicycle as a label under a layer of clear lacquer or by engraving. Foreign bicycles If the bicycle does not have an embedded frame number, you may obtain one from a police station, which you must then have engraved onto the frame at a cycle shop Robbery, assault and open theft The policy covers: Robbery and assault. This means theft or destruction of your possessions using force or threatening to use immediate force. Open theft. This means theft of your possessions while you are carrying them on you or when they are in close proximity to you. The theft must be committed in the open and without the use of force. It must be noticed by you or someone else while it is being committed. In the event of open theft, the policy covers gold, silver, jewellery, pearls and precious stones up to the sum insured stated in your insurance agreement. Changing of locks In the event of theft or robbery of the keys to the entrance doors to your home, the policy covers the costs of changing the locks, if there is an imminent risk of the key later being used for theft. There is an imminent risk of theft if the offender is able to identify the owner of the key and your home, and if the theft was committed close to your home. Cover is conditional on the lock being changed immediately after the theft Loss of luggage in Denmark The policy covers checked-in luggage transported by plane or train in Denmark. Gold, silver, jewellery, pearls and precious stones, cash and the like and theft-prone items (see Paragraph 5.3) are not covered Vandalism Vandalism means damage committed wilfully and maliciously. The policy covers vandalism to: Your possessions when located in and at your home or holiday home. Bicycles when located in and at your home. If vandalism occurs in connection with theft or attempted theft, the policy covers the damage regardless of where the bicycle was located. Burial plots where you pay for maintenance. The policy does not cover vandalism to your possessions, if: Your home or holiday home has been unoccupied for more than six months. The vandalism was committed by a person covered by the policy or other persons lawfully staying in the home with your permission or otherwise. 5.4 Weather damage The policy covers damage to your possessions caused by: Simultaneous damage caused by storm, hail or the weight of snow on the building which is covered by the building insurance. Melt water and precipitation. The damage to your possessions must be an immediate result of storm damage or other sudden damage to the building or to covering material placed and fastened correctly. Heavy cloudbursts and sudden thaws where the water cannot run off normally but floods the buildings and/or seeps into the buildings through natural leaks. Natural leaks include correctly installed vent-holes, basement wells and chimneys as well as closed doors and windows. A storm is when the wind force reaches at least 17.2 m/sec. A heavy cloudburst is when the amount of rainfall reaches: 15 mm in the course of up to 30 minutes or 30 mm in the course of 24 hours. A sudden thaw is when the amount of precipitation or melt water within a short period of time is too much for correctly dimensioned and cleaned drainage systems to be able to drain off the water. 10/19 Tryg Contents insurance Insurance terms no. 1211
11 If the landlord is liable under the Danish Rent Act (lejeloven) or the lease. Flooding from sea, bay, lake, stream or watercourse. When precipitation or melt water seeps into the building through cracks and leaks, unless you are a tenant, and your landlord is not liable. When the tenant has a duty to repair the structural damage which is causing the water damage. When your gutters, downpipes and wells have not been correctly maintained, dimensioned, fitted or cleaned. When groundwater seeps into or rises up into the building, e.g. through floors, footings, walls and the like. Items located outside of the home, such as your garden furniture or a trampoline. When you have a duty to repair the structural damage which is causing the damage. 5.5 Escape The policy covers damage to your possessions caused by the accidental and sudden escape of water, oil or the like from: Pipework. Containers with a cubic capacity of 20 litres or more. The policy also covers seepage, if the liquid comes from hidden water, heating or drainpipes in the building or from pipes located in rooms in the building for which you have no right of use. In addition, the policy covers leaks in tubes behind built-in white goods and refrigerators and freezers with water supply. Hidden means that it is not possible to obtain direct access to the installations without the use of tools or that there is no permanent staircase. This includes installations embedded into or hidden in floors, channels, crawl spaces, walls, roof spaces and the like. Installations are not hidden if they are only covered by insulation material. Frost burst in rooms not sufficiently heated, unless this was due to accidental heat supply failure outside of your control. Damage caused by building, renovation and repair work. Damage where your landlord is liable under the Danish Rent Act or the lease. Damage where the tenant has a duty to repair the structural damage causing the water damage. Damage caused by you failing to repair structural damage. Loss of the escaped liquid. Damage caused by the rise of groundwater or sewage, unless due to heavy cloudburst or sudden thaw (see Paragraph 5.4). 5.6 Traffic accident The policy covers damage to your possessions caused by: Traffic accidents involving a means of transport in an impact, a collision or overturning. An accident involving a pleasure craft with covered berths not owned by you or other persons covered by the policy, but in which you are passengers. Means of transport include: Motorised vehicles, cf. the Road Traffic Act. Two-wheel bicycles with a wheel diameter of more than 12 inches. Two-wheel and three-wheel bicycles with a frame number. Horse-drawn carriages. Public means of transport. Vehicles for disabled drivers. Damage to the means of transport or the pleasure craft. Cosmetic damage and minor surface damage not affecting the functionality of the item. Damage to domestic animals. Damage to your possessions during track driving or in a race. Damage to your possessions if they are dropped or fall out of the means of transport and are then run over. Damage to your possessions when handed in for transport against payment, e.g. to removers. Gold, silver, jewellery, pearls and precious stones, cash and the like in connection with a pleasure craft accident. 5.7 Damage to luggage abroad Cover under the policy is subject to the same rules as apply to your contents insurance when you bring your possessions with you or send them as luggage to/from or in another country. The policy covers the possessions that you bring or purchase on your journey to/from and in another country for up to three months from the departure date. Damage to luggage The policy covers damage to luggage which is checked in and sent by plane, train or carrier. The damage must be reported to the conveyor, and documentation for this must be sent to us. Gold, silver, jewellery, pearls and precious stones, cash and the like. Damage due to inadequate packaging or leaking liquid. Damage due to normal wear and tear of suitcases and other luggage, such as scratches. Loss of luggage The policy covers loss of luggage checked in and sent by plane, train or carrier. When travelling by coach, the policy covers loss of luggage stored in a separate compartment during transport. It is a condition that the coach trip is part of the trip and that it has been purchased from an established travel agent. The loss must be reported to the conveyor, and documentation for this must be sent to us. Gold, silver, jewellery, pearls and precious stones, cash and the like. 12 5.8 Psychological trauma counselling (Only applies to preferred customers) The policy covers psychological trauma counselling if you have been involved in or witnessed one of the following incidents and this has caused an acute psychological crisis: Serious accident. Burglary, fire, violence and assault. The incident must be reported to the police. Death in your immediate family. Life-threatening disease suffered by you or your immediate family. Suicide or suicide attempt in your immediate family. Your immediate family includes spouse/co-habitant/registered partner, children, children-in-law, grandchildren, parents, grandparents, great grandparents and siblings. The policy covers up to 10 hours of psychological counselling per person. The treatment must be started within three months of the incident. If you need psychological trauma counselling, you must contact us before starting treatment. If we determine that you are eligible for psychological trauma counselling, we will find a psychologist for you. The treatment must take place in Denmark with a psychologist in our nationwide and quality-assured network. If you have received or are eligible to receive psychological trauma counselling under another policy for the same incident. Costs of transport to and from the place of treatment. 5.9 Sudden damage (Only applies if indicated in the insurance agreement) The policy covers sudden damage to: Your possessions. Checked-in luggage brought or sent by plane, train or carrier in Denmark. Glass and sanitary ware (only for tenants, members of housing cooperatives or owners of owner-occupied flats). Damage to your possessions in a traffic accident if they are dropped or fall out of the means of transport and are then run over. A special deductible applies to sudden damage. The deductible is stated in your insurance agreement. Sudden damage means damage due to an external cause with an immediate effect. Cause and effect must be contiguous in time. It is a condition for cover that you can produce the damaged item for inspection. Damage described elsewhere in the terms of the contents insurance policy, regardless of whether they are covered or not. Electronics (e.g. mobile telephones, PCs, kitchen appliances and the like). Small boats up to 5.5 metres, canoes, kayaks, windsurfers and kitesurfers and the like, including equipment and outboard motors of up to 6 HP. Gold, silver, jewellery, pearls and precious Watches. Cash and the like. Cosmetic damage, such as colour differences. Damage due to wear and tear, age, poor maintenance, incorrect use and handling or overload. Damage to domestic animals. Damage to bicycles and electric bicycles. Damage to tools, props, instruments and empty medical bags, which you own and use in your paid occupation. Damage to building parts. Damage consisting of scratches and peeling, unless the item is unfit for use as a result of the damage. Damage caused by faulty repair work and servicing. Damage covered by a warranty, service scheme or the seller's liability under the law pertaining to the sale of goods. Damage due to the use of writing, drawing or painting tools. Damage occurring during or in connection with change of address. Lost or misplaced items. Damage caused by animals. Borrowed or leased items. Damage to luggage due to inadequate packing or leaking liquid. Damage to model planes and accessories. Damage caused intentionally or by gross negligence. For damage to glass and sanitary ware, the policy does not cover: Damage covered by building insurance. Puncturing of double-glazed windows or leaks in window joints, regardless of cause. Damage occurring in connection with conversion, extension, maintenance, installation, dismantling or repair of the damaged item. Frost burst in glass and sanitary ware, unless the damage was due to accidental heat supply failure outside of your control. Costs for tap, mixer tap, toilet seat and other accessories, unless they may be reused after damage to sanitary ware Damage to electronic equipment (Only applies if indicated in the insurance agreement.) The policy covers: Sudden damage to your electrical equipment. 13 Malfunction of electrical equipment, if mechanical or electrical failure means that the equipment cannot be used for the intended purpose. Dead pixels in any kind of flat screens, if not covered by the manufacturer's or the importer's guidelines for accepted dead pixels. Sudden damage to electronic equipment when it has been exposed to water, liquid or moisture. Sudden damage means damage due to an external cause with an immediate effect. Cause and effect must be contiguous in time. It is a condition for cover that you can produce the damaged item for inspection. Damage described elsewhere in the terms of the contents insurance policy, regardless of whether they are covered or not. Watches. Motorised and electrical equipment for outdoor use only, such as garden tools, electric scooters and electric bicycles. Accessories for electronic equipment, such as cables, bags, batteries, memory cards etc. Borrowed or leased items; see, however, Liability in Paragraph 7. Malfunction and dead pixels, when the equipment is four years or older. Damage in the form of scratches and peeling or other cosmetic damage, such as colour differences. Damage due to wear and tear, age, poor maintenance, overload, incorrect use and handling. Damage occurring during repair or service or damage caused by faulty repair. Damage occurring during or in connection with change of address. Faulty or lost software and data etc., including digital photos and music files. Damage due to virus and hacker attacks and the like. Image burns on a flat screen, regardless of the type of flat screen. Damage covered by a warranty, service scheme or the seller's liability under the law pertaining to the sale of goods. Lost or misplaced items. Damage caused by animals. Damage caused intentionally or by gross negligence. Calculation of indemnity The policy covers for four years from the first date of purchase without deduction for age. If you purchase a used item, the policy covers for four years from the original first date of purchase. The damage must be discovered and the claim reported within this four-year period. In the case of sudden damage to items that are four years old or older, indemnity will be calculated pursuant to the rules in Paragraph 6 on indemnity and documentation requirements. A special deductible applies to damage to electronic equipment. The deductible is indicated in your insurance agreement. 6. Indemnity and documentation requirements Reporting a claim You must immediately report any claim to us. When reporting a claim, you must prove your claim for indemnity and provide documentation as well as all information which may be relevant to our assessment of your claim. Theft, vandalism, burglary and assault must immediately be reported to the police in the country where the incident occurred. You must obtain written confirmation of the police report and state the file number. If your possessions are found before indemnity is paid to you, the policy only covers any damage to the items in connection with the theft/robbery. Repair or removal of damaged items must be agreed with us in advance. Documentation requirements In order to receive an indemnity, you must be able to document or prove that you have suffered a loss covered by the policy. You must also be able to document the time of purchase and price of the items. Documentation will usually take the form of receipts or contracts of sale. Photos may be used to prove the claim. If you are not able to document or prove your claim, we may refuse to indemnify your claim or assess the indemnity based on an estimate. For this reason, you should keep your receipts for at least five years. Private purchases When making private purchases, you must be sure to receive a dated statement showing what you have purchased and at what price. The statement must contain the names and addresses of the buyer and the seller. Business purchases Business purchases will only be indemnified if you send a conversion or auditor's statement to us showing that the items have been converted to private use. Items purchased abroad The maximum indemnity paid for items purchased abroad is the purchase price abroad at the time of the claim. If the items are replaced, any customs duties and taxes charged will also be indemnified. Calculation of indemnity The indemnity must as far as possible place you in the same position as you were at the time of the loss. 14 Repair We will pay the cost of repairing the damaged item to essentially the same condition it was in immediately before the damage. 'Essentially the same condition' means that the item will not necessarily be the same as before the damage, but that its performance, use and appearance are essentially the same as before the damage. We may, for example, choose to use unoriginal spare parts. Repair costs may not exceed the value of the damaged item calculated in accordance with the rules on cash payment or replacement. Replacement We will procure or deliver items having a value, quality, performance, use and appearance essentially corresponding to the damaged item. The make or brand of these items does not have to be the same. We will provide new items if the damaged or stolen items were: purchased as new, less than two years old at the time of the damage, and otherwise undamaged. If all the conditions for replacement with new items have not been met, we may provide used items. If you do not wish to have your item replaced, we will pay an indemnity corresponding to the price at which we are able to purchase the item. Cash payment Cash payment is calculated using one of the following methods: Replacement value Current cost Based on depreciation rate tables Replacement value We will pay a cash indemnity corresponding to the price charged by the supplier designated by us, if the damaged or stolen items were: purchased as new, less than two years old at the time of the damage, and otherwise undamaged. The current cost is calculated as the market price of a similar new item less depreciation due to age, use, changes in fashion, reduced usability or other circumstances. In this situation, account will not be taken of the utility value of the item. 'Similar items' means items having a value, quality, performance, use and appearance essentially similar to the item to be replaced. The make or brand of these items does not have to be the same. Self-produced items In case of damage to items that you have produced yourself, such as paintings, works of art, jewellery or clothes, the indemnity will cover the purchase of similar raw materials. Salvage, cleaning and removal costs The policy covers damage to your items in connection with reasonable salvage measures taken to prevent imminent damage to people or items not belonging to you. In the event of damage covered by the policy, we will pay: Reasonable and necessary expenses for salvage, preservation and cleaning. Reasonable and necessary removal and moving-in expenses. Alternative accommodation and other reasonable and necessary additional expenses, including storage, for up to one year if you temporarily have to move out of your permanent home. Any saving and indemnity from other insurers will be offset against the indemnity. In addition, the policy covers reasonable and necessary removal and moving-in expenses due to damage normally covered by building insurance, if you as a tenant, member of a housing cooperative or owner of an owner-occupied flat are not able to live in your permanent home, and the owner of the building is not liable for the expenses. If the damage only extends to basement or attic rooms in blocks of flats, the permanent home will not be regarded as being unfit for occupancy. 7. Liability 7.1 Legal liability for damages The policy covers your legal liability for damages as a private individual in case of personal injury and property damage. According to Danish case law, you will normally be legally liable if you inflict damage by error or omission. If you did not cause the damage, it is regarded as accidental, and you are not liable for damages. The injured party will then be liable for the loss. In addition, you may be liable for damages if other people suffer a loss in attempting to save you or your possessions. This will be covered by the policy, unless the claim is covered by the Workers' Compensation Act (lov om arbejdsskadeforsikring), and unless the rescuer acted in the course of his or her profession. Purpose and obligations The purpose of the liability insurance is to cover your expenses if you have incurred liability for damages and to contribute to indemnifying you if an unjustified claim for damages is raised against you. For this reason, you should not acknowledge liability for damages or a claim, as you will then become liable without knowing whether we will cover the damages. You must always contact us and let us decide how to proceed with the claim if a claim for compensation is raised against you. If the claim for compensation is covered by the policy, we will: Assess whether you are liable for damages. Negotiate with the injured party. We are entitled to pay any damages directly to the injured party. 7.2 Cover exceeding the legal liability in damages Damage caused by guests Damage caused by guests covers damage to items during a normal private gathering, where the legal assessment would typically not make the person causing the loss liable for damages, as the damage was caused by slight negligence or cause during this gathering. A special deductible applies to damage caused by guests; see your insurance agreement Damage caused by children Like adults, children may incur a separate legal liability. However, according to case law, children under the age of five will normally not be considered to be responsible for their actions and liable for damages. The policy still covers property damage and personal injury if the age or immaturity of the child is the only reason for the exemption from liability. A special deductible applies to property damage; see your insurance agreement. Parents will normally only be liable for damages for damage caused by a child if they have left the child unattended The injured party's own insurance Pursuant to the Liability for Damages Act (erstatningsansvarsloven), you will not be liable for damages if the loss is covered by another insurance policy, such as the injured party's family, building, car or business insurance, unless the damage was caused by your gross negligence. 15/19 Tryg Contents insurance Insurance terms no. 1211
16 7.3 The policy covers your liability as A private individual. The policy covers liability for damages for personal injury and property damage A tenant towards landlords pursuant to the provisions of the Rent Act on the tenant's liability for damages. The policy covers damage caused by installations fitted by the tenant with the landlord's approval. Otherwise, the policy does not cover the tenant's liability for the tenancy An owner or a user of horses and other domestic animals for private use. The policy does not cover liability for damage caused by dogs. Compulsory dog liability insurance must be taken out As a doctor when providing medical treatment or medical advice which is not provided as part of your profession As a landowner in respect of: A private plot and a single-family and a semi-detached house, if the house is mainly used for habitation, or if you live in the house, and building insurance comprising liability cover has not been taken out. A holiday house and plot, if building insurance comprising liability cover has not been taken out. However, the policy does not cover: Liability for damage caused by a landowner in connection with demolition and excavation work as well as piling and the like. However, personal injury is covered. Liability for damage caused by contamination. However, such liability is covered if the damage occurred in a oneoff accident and not because you failed to comply with the public regulations in force from time to time. Contamination liability incurred as a houseowner and landowner is not covered by the policy. 7.4 The policy does not cover liability for damage Caused during the performance of service in the interest of the injured party, including as a guest, unless the person causing the loss has acted particularly inconsiderately. It is no relevant whether performance of the service is paid or unpaid or whether it is performed on request on of one's own initiative Caused deliberately, unless the person causing the loss is under the age of 14 or lacked mental capacity due to his or her state of mind Pursuant to the Act on Parental Liability for Children's Liability for Damages (lov om forældres hæftelse for børns erstatningsansvar), deliberate acts committed by children aged 14 or more Caused as a consequence of self-induced intoxication or the influence of other drugs, regardless of the state of mind of the person causing the loss Only based on agreements or only causing a financial loss not caused by personal injury or property damage Caused in the course of one's profession or work comparable with this Caused while hunting, where the liability is covered by hunter's liability insurance or would be covered by the usual compulsory hunter's liability insurance Caused by the use of a motorised vehicle or an aircraft, including radio-controlled model planes and gliders for which separate liability insurance may be taken out. However, the policy covers liability for certain motorised vehicles: Damage caused by the use of electric scooters, electric wheelchairs and the like with a maximum speed of 15 km/h. Damage caused by the use of toys with engine power of up to 5 HP, and personal injury while using go-carts with engine power of up to 25 HP. Damage caused by the use of garden tools of up to 25 HP. Damage to the aircraft, the motorised vehicle or the other motorised items if caused by children aged 14 or less Use of boats However, the policy covers liability for personal injury caused by the use of small boats, except in competitions. Small boats include boats without a motor, windsurfers and kitesurfers and boats with engine power up to 25 HP. However, the policy covers liability for damage to items or animals caused by canoes, kayaks, rowing boats and other boats as well as windsurfers and kitesurfers and the like if the length of the vessel does not exceed 6 metres. It is a condition that the vessel is not powered by a motor of more than 25 HP at the time of damage Damage to borrowed and leased items However, the policy covers liability for damage to borrowed and leased items or animals, i.e. animals and private items normally regarded as belonging to a private home, in the event of sudden damage occurring during the first 30 days of the loan or lease period. However, for bicycles, cover is limited to children's bicycles, i.e. bicycles belonging to children aged 12 or less. 17 Small boats, canoes, kayaks, windsurfers and kitesurfers and the like. Tools, props and instruments which you use in your paid occupation. Building parts. A special deductible applies to damage to borrowed and leased items; see your insurance agreement Damage to items or animals which one of the insured: Owns. Uses or has used. Stores, transports, processes or treats. Has taken possession of. Is in charge of for other reasons than those listed above. 7.5 Sums insured Special sums insured apply to personal injury and damage to animals and items. These are stated in your insurance agreement and are not indexed. 7.6 Costs and interest The policy covers the costs of settling the question of damages, incurred in agreement with us, regardless of whether the sums insured are thereby exceeded. The same applies to interest on damages covered by the policy. If you pay any costs in the case without consulting us, you run the risk that we will not cover the costs. 8. Legal aid The following description of the legal aid cover is not exhaustive. Reference is made to the full wording of the terms on tryg.dk. The policy covers the costs of certain private legal disputes, if: there is a current dispute; the case is qualified and ready for hearing by the courts or arbitration; you have a certain probability of winning the case; and an attempt has been made to settle the case before an approved complaints board or public or administrative authorities. A dispute is a legal disagreement between two or more parties. A dispute may arise in the following situations: Actions for damages. Rent law cases. Purchase and sale of household effects. Minor private leases. Business cases, including employment and industrial injury cases. Disputes concerning separation, divorce, custody, contact and maintenance obligation in the first instance. Disputes with authorities, including cases concerning taxes and duties. Criminal cases. Cases concerning inheritance and administration of the estates of deceased persons. Court cases If your case concerns a claim for up to DKK 50,000, or if the court is not able to assess the monetary value of the claim, your case must, as a general rule, follow the small claims procedure. In this type of case, you do not need the assistance of a lawyer, but may report the case directly to us. Further information on the rules governing small claims is available at (in Danish), where you will also find instructions on how to prepare a writ and a defence. If your case concerns a claim for more than DKK 50,000, you must contact a lawyer, who will report the case to us and apply for legal aid cover on your behalf. The same applies to cases concerning particularly complicated issues or cases having particularly far-reaching consequences. 'Far-reaching' means that the decision will have serious consequences for one of the parties. Arbitration The policy covers disputes which the parties have agreed to settle by arbitration. You must contact a lawyer, who will report the case to us and apply for legal aid cover on your behalf. Mediation The policy covers the costs of using mediation to settle disputes. Mediation is a method of settling disputes through a voluntarily controlled conversation aided by a mediation lawyer. If the opposing party is willing to use this kind of dispute settlement, you must contact the Danish Bar and Law Society's Mediation Lawyers to have a mediation lawyer appointed. This lawyer will then report the case to us and apply for legal aid cover on your behalf. 9. General terms Insurance in another company If you have taken out insurance against the same type of damage from another insurer, you have double insurance, and you must report the claim to both insurers. We do not cover damage for which full indemnity is paid by another insurer. If the other insurer has limited cover in the event of double insurance, the same limitations apply to your insurance with us. This means that we and the other insurer are obliged to pay a pro rata indemnity. Insurance period The insurance period runs for one year at a time, unless otherwise stated in the policy. It will automatically be renewed by one year, unless it is terminated beforehand. Payment The insurance premium is payable once or several times a year. The policy schedule shows which option you have chosen. In addition to the premium, we will charge public taxes and duties, such as general insurance duty and government tax. 17/19 Tryg Contents insurance Insurance terms no. 1211
18 Payment may be made via the payment service provider Betalingsservice or an inpayment form. You will be charged a collection fee to cover our costs of collection and payment. We will send the bill to the billing address provided by you. If the premium is not paid on time, you will receive a reminder. If the premium has not been paid within 21 days of the first reminder, the insurance will lapse. If we send you a reminder, we will be entitled to charge an administration fee, default interest and any other costs. In addition, we will be entitled to charge an administration fee, a fee for printing documents and other services to cover our costs. Change of address and other changes, such as purchase of expensive items If you fail to notify us of certain changes, your right to indemnity may be reduced or lapse. For this reason, it is important that you notify us of any changes to the information in the insurance agreement, such as: The billing address. If you purchase or receive any expensive items and need to buy additional cover. If you need to change the sum insured for losses outside of the home (see your insurance agreement). The roof type on your home, e.g. from a hard roof to a soft roof. If you move to another permanent home. If you no longer have a burglar alarm. If you have children. In case of other changes of relevance to the agreed terms. General exclusions The policy does not cover damage or repair of damage directly or indirectly caused by: Damage caused intentionally or by gross negligence. Flooding from sea, bay, lake, stream or watercourse, earthquake, cyclones, volcanic eruptions or other natural disasters. Faulty and lost software etc. Virus and hacker attacks. War or war-like operations, violations of a nation's neutrality, civil war, riot or civil unrest. Seizure, confiscation or other measure by a public authority. Nuclear reactions and radioactive radiation, regardless of whether such damage occurs in times of war or peace. However, damage which is directly or indirectly caused by nuclear reactions, used for usual industrial, medical or scientific purposes, is covered, if the use thereof was in accordance with instructions and not related to reactor or booster operation. Indexation The premium, deductibles and sums insured are indexed and are stated in the insurance agreement. Liability damage and legal aid are not indexed. Indexation follows the wage index for the private sector published by Statistics Denmark. If this index ceases to be published, or if the basis of the index is changed, we will be entitled to use a similar index from Statistics Denmark. Indexation is performed once a year from 1 January. The premium is indexed once a year on the first date of payment in the calendar year. Indexation is based on the index for the first quarter in the preceding year. Amendment of terms and price changes We may amend the terms and/or change the premium by giving one month's notice to expire on a payment date. The insurance will continue to run with the new cover and/ or premium, when the person who has purchased the insurance pays the premium for a new period. If the premium is not paid, the insurance will lapse on the date of the amendment/change. Indexation or changes following from legislative amendments are not considered to constitute a change of the premium. Option to terminate You and we are entitled to terminate the insurance in writing one month before the expiry of the insurance period, at the latest. You may choose to terminate the insurance giving only 30 days' notice to expire at the end of a calendar month against payment of a fee. However, if the insurance is terminated during the first year, an additional fee will be charged. After any reported claim, you and we will be entitled, for up to 14 days after payment of indemnity or rejection of the claim, to terminate the insurance by giving 14 days' notice. If, when processing a claim, we discover any special risks which may have resulted in many claims being reported, we may elect to offer stricter terms instead of terminating the insurance. Such stricter terms may be a compulsory deductible or change of an existing deductible, a premium increase or restriction of cover. We may also demand that you take preventive measures as part of the stricter terms. You must be informed of the introduction of stricter terms after a claim in writing with 14 days' notice in the period from when you reported the claim and to no later than 14 days after payment of indemnity or rejection of the claim. If you do not wish for your insurance to continue on the stricter terms, you may terminate it by giving 14 days' notice or request the termination takes effect on the date of commencement of the stricter terms. 18/19 Tryg Contents insurance Insurance terms no. 1211
