4 Legislative Overview The Child and Family Services Improvement and Innovation Act requires Annual Credit Report for foster youth.. The President signed P.L into law on September 30, Among other provisions, P.L amends the case review system definition to require that : 1.each child age 16 and older in foster care receive a copy of any consumer credit report annually until discharged from foster care, and 2.must be assisted in interpreting the credit report and resolving any inaccuracies (section 475(5)(I) of the Act). This amendment became effective October 1, 2011; however, GA received an extension for implementation.

5 Youth Impact Its is imperative that we understand the importance of the new federal law that requires each youth to receive assistance with interpreting and resolving any inaccuracies that may appear on their reports because credit report ratings may be used to determine a youth s: 1. future eligibility for credit 2. student or car loans 3. insurance 4. housing or apartment 5. employment

6 Youth Impact Child identity theft occurs when someone uses a minor s personal information to commit fraud. A thief may steal and use a child s information to obtain: Medical Care Phone Services Government Benefits Apartments Jobs Mortgages Utilities Loans

7 Youth Impact Children in foster care are most vulnerable to identity theft because they: move to multiple placements (several people have the opportunity to gain access to the child s personal information: Foster Parents, Relatives, Group Home Staff, Parents etc.) are young in age when the crime takes place. have fewer opportunities to check their financial information. are not educated on how to obtain and read their credit report.

8 Credit Reports For Foster Youth In Care The key players to assist with this process: Independent Living Program Credit Report Specialist (ILP CRS) Special Assistant Attorney General (SAAG) Social Service Case Manager (SSCM) State Office

9 DFCS shall ensure: DFCS Requirements each child in foster care who has reached 16 years of age receives a free copy of their consumer credit report from each of the three (3) nationwide credit report agencies each year they remain in foster care until age 18. youth age 16 years and older in foster care shall participate annually in consumer credit education which includes information on interpreting and understanding consumer credit and credit reports. If any of the credit reporting agencies reports that a youth has a credit history, DFCS shall ensure the youth receives assistance in interpreting the credit report and resolving any inaccuracies in the report. DFCS shall provide youth emancipating from foster care with information on how to obtain annual free credit reports which they may do independently upon reaching age 18.

11 Procedures for Assisting Youth with Credit Report Procedures- Within 30 days of a youth in foster care turning 16 or upon entry into foster care if a youth is age 16 years or older, the SSCM shall: Update the Written Transitional Living Plan (WTLP) to include Credit Report goals: 1. Ensure that the youth participates in an approved consumer credit course. 2. Ensure consumer credit reports from the three (3) nationwide credit reporting agencies are obtained.

12 Procedures for Assisting Youth with Credit Report In order to request a credit report the SSCM will: Submit a legal request to the SAAG to request a Credit Reporting Court Order (CRCO) Complete the Credit Report Request Form (CRR) Once the court order is received from SAAG and the CRR is completed, submit both copies to the ILP CRS at ilpcredit@dhr.state.ga.us Upload the Credit Reporting Court Orders into SHINES Document all efforts

15 Procedures for Assisting Youth with Credit Report Upon receipt of responses from all three (3) credit agencies, the ILP CRS is responsible for sending the SSCM an encrypted of the Credit Report. Once the is submitted to the SSCM, a password is required to retrieve the credit report documents. ILP CRS will submit a password to retrieve the credit report documents from the password encrypted .

16 Procedures for Assisting Youth with Credit Report Within thirty (30) calendar days of receiving credit reports from the ILP CRS, the SSCM shall discuss the credit results with the youth as follows: 1. If the Credit Report indicates that all three (3) credit reporting agencies responded that no credit history exists for the youth, Download the report from the encrypted and provide it to the youth; Ensure the youth understands the content of the report(s); Complete the Youth Acknowledge for Credit Report Receipt document. (Upload into SHINES and submit the other copy to Document discussion

18 Procedures for Assisting Youth with Credit Report 2.If the Credit Report indicates that any of the credit reporting agencies responded that the youth does have a credit history: Download the report from the encrypted and provide it to the youth; Ensure the youth understands the content of the report(s); In collaboration with the youth, initiate the process for resolving any inaccuracies; Complete the Dispute Request. (Upload a copy into SHINES and submit the other copy to ilpcredit@dhr.state.ga.us) Complete the Youth Acknowledge for Credit Report Receipt document. (Upload a copy into SHINES and submit the other copy to ilpcredit@dhr.state.ga.us) Document the discussion and plan to resolve any inaccuracies

20 Subsequent Reports: Subsequent Reports are for youth who received credit reports at 16 and recently turned 17 (anniversary of receiving their credit report at 16) A second court order is not required Request another credit report from the ILP CRS 12 months after the initial report is obtained until the youth in care reaches age 18. Only one report from each credit reporting agency may be obtained in a 12 month period

21 Procedures for Assisting Youth with Credit Report ILP is currently collaborating with the SHINES Team to implement an enhanced process for requesting credit reports through the SHINES system. This process will allow the SSCM to: Request credit reports through SHINES Upload and download credit report documents Receive alerts as a reminder of deadlines Receive alerts for the next process that needs to be initiated

22 Training For Foster Youth In Care Consumer Credit Training Foster youth age 16 years and older in foster care shall participate annually in consumer credit education which includes information on interpreting and understanding consumer credit and credit reports. ILP, in collaboration with ClearPoint, will implement a training session to empower our youth with information to educate and protect them from identity theft. This session will be implemented through ClearPoint s Personalized Learning Program (PLP) for DFCS, RBWO staff and foster youth. The PLP is an online personalized financial education program. The ClearPoint - PLP is a co-branded website that includes interactive financial courses designated to the Case Managers and Foster Care clients.

24 ClearPoint ClearPoint serves as a trusted credit counseling agency, helping people resolve financial challenges and build economic security for themselves and their families. ClearPoint provides credit counseling and education, in both English and Spanish, online, by telephone, and inperson. ILP has teamwork with ClearPoint to assist with: Educating and Training DFCS SSCM and Foster Youth Counseling Foster Youth about their credit status In collaboration with the foster youth and DFCS SSCM, resolving inaccuracies and disputes that may arise on the foster youth credit report
