2 Federal Register, July 16, 2015 U.S. Department of Labor Employment and Training Administration Workforce Innovation and Opportunity Act; Lower Living Standard Income Level (LLSIL) Correction BACKGROUND: Under the Workforce Investment Act (WIA): In Section 101 (25)(B), the definition of LOW-INCOME INDIVIDUAL- is defined as an individual, who: 25) LOW-INCOME INDIVIDUAL- The term `low-income individual' means an individual who-- (A) receives, or is a member of a family that receives, cash payments under a Federal, State, or local income-based public assistance program; (B) received an income, or is a member of a family that received a total family income, for the 6-month period prior to application for the program involved (exclusive of unemployment compensation, child support payments, payments described in subparagraph (A), and old-age and survivors insurance benefits received under section 202 of the Social Security Act (42 U.S.C. 402)) that, in relation to family size, does not exceed the higher of-- (i) the poverty line, for an equivalent period; or (ii) 70 percent of the lower living standard income level, for an equivalent period; (C) is a member of a household that receives (or has been determined within the 6- month period prior to application for the program involved to be eligible to receive) food stamps pursuant to the Food Stamp Act of 1977 (7 U.S.C et seq.); (D) qualifies as a homeless individual, as defined in subsections (a) and (c) of section 103 of the Stewart B. McKinney Homeless Assistance Act (42 U.S.C ); (E) is a foster child on behalf of whom State or local government payments are made; or (F) in cases permitted by regulations promulgated by the Secretary of Labor, is an individual with a disability whose own income meets the requirements of a program described in subparagraph (A) or of subparagraph (B), but who is a member of a family whose income does not meet such requirements. Effective July 1, 2015: Under the Workforce Innovation and Opportunity Act (WIOA): (36) LOW-INCOME INDIVIDUAL. (A) IN GENERAL. The term low-income individual means an individual who 2
3 GUIDANCE: (i) receives, or in the past 6 months has received, or is a member of a family that is receiving or in the past 6 months has received, assistance through the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (7.S.C et seq.), the program of block grants to States for temporary assistance for needy families program under part A of title IV of the Social Security Act (42 U.S.C. 601 et seq.), or the supplemental security income program established under title XVI of the Social Security Act (42 U.S.C et seq.), or State or local income-based public assistance; (ii) is in a family with total family income that does not exceed the higher of (I) the poverty line; or (II) 70 percent of the lower living standard income level; (iii) is a homeless individual (as defined in section 41403(6) of the Violence Against Women Act of 1994 H. R (42 U.S.C e 2(6))), or a homeless child or youth (as defined under section 725(2) of the McKinney-Vento Homeless Assistance Act (42 U.S.C a(2))); (iv) receives or is eligible to receive a free or reduced price lunch under the Richard B. Russell National School Lunch Act (42 U.S.C et seq.); (v) is a foster child on behalf of whom State or local government payments are made; or (vi) is an individual with a disability whose own income meets the income requirement of clause (ii), but who is a member of a family whose income does not meet this requirement. The following guidelines are to be used in determining low-income eligibility. Poverty Guidelines are to be used for the poverty line. The 70% Lower Living Standard Income Level appropriate to the applicant s place of residence should be used to determine eligibility, where appropriate. The 100% of the Lower Level Standard Income Levels are to be applied when determining whether employment leads to self-sufficiency under Workforce Investment Act programs. The 100% levels are not to be used to determine low income eligibility. 3
