2 Gazette No.: 12/2003 Published on 21 Mar 2003 FIXED TELECOMMUNICATIONS NETWORK SERVICES LICENCE TELECOMMUNICATIONS ORDINANCE (Chapter 106) In accordance with General Condition 20 of Fixed Telecommunications Network Services Licence, Hong Kong Broadband Network Limited (referred to as HKBN ) hereby publishes the tariffs, terms and conditions under which it provides the following service plan with effect from and including 21st March, HKBN Package Offer Monthly Fee (HK$) Subscriber is entitled to enjoy any combination of the following services: 298 1) 20 hours Broadband Internet Access service ( Flexible Broadband Internet Service ); 2) HomeTel Service; 3) 100 minutes HKBN IDD 0030 & International Call Forwarding Service. * Optional services are subject to charges stated in Special Terms and Conditions of HKBN Package Offer. Special Terms and Conditions of HKBN Package Offer 1. HKBN Package Offer ( Package Offer ) is only applicable to new subscriber of estates/buildings as specified by Hong Kong Broadband Network Limited ( HKBN ) from time to time. The address for the new installation of the Package Offer must not be subscribing to any service items selected under the Package Offer at the time of subscription of the Package Offer. This Package Offer is subject to a limited supply. 2. This Package Offer is effective upon the successful installation of the relevant service item for the new subscriber within one month from registration (unless the failure of installation is caused by HKBN). 3. Subscriber is entitled to any combination of the following service items under this Package Offer: 1) 20 hours Broadband Internet Access Service ( Flexible Broadband Internet Service ); 2) Residential Telephony Service ( the HomeTel Service ); 3) 100 minutes IDD 0030 &/or HKBN IDD0030 International Call Forwarding Service (the IDD 0030 & Call Forwarding Service ). Subscriber can further choose to use the value-added service in conjunction with this Package Offer. The contract period of this Package Offer is 12 months from the installation of the first service item of the Package Offer. 4. If the subscriber chooses the Flexible Broadband Internet Service provided by HKBN in this Package Offer, it shall include first 20 hours free Internet access, the additional access charges shall be HK$2 per minute subject to a maximum amount of HK$198 (excluding any additional charges as may be levied under the IDD 0030 & IDD0030 International Call Forwarding Service). 5. Subscriber agrees to use HKBN s service for 12 consecutive months in order to entitle to this Package Offer. Subscriber must not terminate any service item in this Package Offer. For the termination of any one of the service items in this Package Offer for whatever reason, subscriber agrees to pay a liquidated damages in a sum of HK$990 or the monthly charges of the remaining contractual period (whichever is higher). 6. HKBN shall debit HK$100 service installation charge of the subscriber s credit card account (if applicable) immediately after the installation of the Package Offer as selected by the subscriber. 7. Subscriber may at any time during the Package Offer upgrade the Flexible Broadband Internet Service to an Unlimited Broadband Internet Access Service for an additional charge of HK$30 per month. An additional charge of HK$25 per month for any optional feature shall be added to the HomeTel Service. Such additional charges shall be effective on the first day of the following month from the date of installation, and contractual period of such Package Offer shall remain unchanged. 8. The Broadband Internet Access Service, the HomeTel Service or the IDD 0030 & IDD 0030 International Call Forwarding Service, any of the above service items, if not subscribed at the time for subscription of Package Offer but subscribed subsequent to the installation of such Package Offer, shall be charged at HKBN s standard rates of respective services. 9. If Broadband Internet Access Service is included in the Package Offer subscribed, HKBN shall immediately after the installation debit the subscriber s credit card account (if applicable) the first month service charge of the Package Offer. If Broadband Internet Access Service is not included in the Package Offer subscribed, HKBN shall immediately after the installation debit the subscriber s credit card account (if applicable) the first three (3) month service charge of the Package Offer 10. Subscriber agrees to abide by the respective GENERAL TERMS AND CONDITIONS for the use of HKBN s Registration of Broadband Internet Access Service, HomeTel Service and Number Porting (Number Switch Over) Service and IDD 0030 & IDD 0030 International Call Forwarding Services and HKBN s GENERAL TERMS AND CONDITIONS and amendment thereto stipulated by HKBN from time to time.

3 Broadband Internet Access Service 11. After the expiry of the 12 months period of the Package Offer, the monthly fee of Flexible Broadband Internet Service will be resumed to HK$68, the additional access charge will be HK$2 / Hour and the maximum monthly fee of Flexible Broadband Internet Service will be $198 which such adjustment may be made by HKBN without further notice to the subscriber. 12. If subscriber selects Unlimited Broadband Internet Access Service Plan in the Package Offer, after the expiry of the 12 months Package Offer, the monthly fee of such Internet access service will be resumed to HK$258 which such adjustment may be made by HKBN without further notice to the subscriber. HomeTel Service 13. If subscriber selects HomeTel Service in the Package Offer, the monthly fee will be resumed to HK$108 after the expiry of the Package Offer which just adjustment may be made by HKBN without further notice to the subscriber. IDD0030 & IDD0030 International Call Forwarding Service 14. If subscriber selects IDD 0030 & IDD 0030 International Call Forwarding Service in the Package Offer, it may enjoy first 100 minutes free IDD 0030 calling time for calling and/or forwarding calls to China, US, Canada landline and mobile number, UK and Australia landline number. (Collectively Offer ) in the 12 consecutive months. The IDD 0030 service will be effective 7 business days after HKBN s receipt of the application form and the IDD 0030 International Call Forwarding service will be effective after successful installation. HKBN shall issue written notice(s) informing the subscriber for the date of effective of the respective service items. The Offer shall be effective on the first day of the following month subject to the effective date as stipulated in such written notice. 15. Caller Number Display of IDD 0030 International Call Forwarding Service is free for the first 12 months ( Offer Period ) starting from the month of registration. Unless otherwise requested by subscriber, the Caller Number Display service will be cancelled automatically upon the expiration of the Offer Period. 16. The monthly free minutes of the Package Offer are non-transferable, non-cumulative and non-refundable. 17. Any additional usage for calling to China, calling to other countries with IDD 0030 or receiving calls forwarded from Hong Kong to telephone numbers registered in the respective countries shall be charged based on the respective IDD 0030 rate plan as registered by the subscriber. Service rate plan will be kept unchanged for subscriber which had registered their IDD 0030 service prior to the Package Offer and the Half Price Rate Plan will be defaulted for subscriber which newly register their IDD 0030 with the Package Offer. Charge is based on a 6-second increment. 18. If subscriber selects IDD 0030 and IDD 0030 International Call Forwarding Service in its Package Offer, after the expiry of the 12 months period of the Package Offer subscriber may continue to use the IDD 0030 service. The monthly fee of International Call Forwarding will be resumed to HK$18 which such adjustment may be made by HKBN without further notice to the subscriber. 19. Subscriber registers for IDD 0030 service with any telephone number, the IDD 0030 service shall remain available despite the telephone number will be ported to other fixed network operator. 20. Applicant shall abide by and agree to the Terms and Conditions governing the registration of IDD 0030 Rate Plan(s) for Residential Customers and the General Terms and Conditions of HKBN as may be in force from time to time. All the charges/rates of IDD 0030 services are subject to change from time to time without further notice. All matters and disputes related to IDD 0030 services and/or charges thereof will be subject to HKBN s final decision.

4 Gazette No.: 12/2003 Published on 21 Mar 2003 FIXED TELECOMMUNICATIONS NETWORK SERVICES LICENCE TELECOMMUNICATIONS ORDINANCE (Chapter 106) In accordance with General Condition 20 of Fixed Telecommunications Network Services Licence, Hong Kong Broadband Network Limited (referred to as HKBN ) hereby publishes the additional tariffs, terms and conditions under which it provides the following service with effect from and including 21st March, Charges of HKBN IDD 0030 International Call Forwarding Service Service IDD 0030 International Call Forwarding Service Particular of Service Customer can forward all incoming voice calls/fax calls to that number to the designated local or overseas mobile phone number, telephone/fax number, voice mail box at subscriber s pre-defined sequence and to make IDD calls. Charge HK$68/month plus usage charge on International Forwarding Service, subject to IDD 0030 International Calling Service as gazette published on 1st February, 2002 and 23rd August, Special Terms and Conditions of HKBN IDD 0030 International Call Forwarding Service 1. Customer understands that the HKBN IDD 0030 Call Forwarding Service ("Service") is provided by Hong Kong Broadband Network Limited ("HKBN"). 2. All offers shall be terminated if Customer changes the service plan or the Service is terminated or Customer breaches any terms and conditions contained herein or the terms and conditions of the General Terms and Conditions of HKBN 3. "Caller Number Display" function is only applicable for receiving calls forwarded from Hong Kong in China through mobile network and/or in Hong Kong. The service area and the availability of the "Caller Number Display" function shall be subject to change/expansion without further notice. Customer understands that "Caller Number Display" function may not be available under certain circumstances. 4. The Service is only applicable to receiving calls forwarded from a Hong Kong mobile number to another number in Hong Kong, China and/or overseas. Customer using the Service to receive forwarded calls in Hong Kong shall be charged at the rate of HK$0.1 per minute or any other amount that shall be determined by HKBN from time to time. 5. The Service shall only be used by Customer in person to receive calls forwarded from Hong Kong and not otherwise except with the prior written consent of HKBN. HKBN reserves all rights to charge Customer the standard IDD rates for the international calling connection charges should HKBN in its reasonable opinion believe that Customer has breached this clause. 6. Should Customers have any enquiry in relation to the calling rate for receiving calls forwarded from Hong Kong in China and/or overseas or want to change service plan, please call the customer service hotline at HKBN will process the application for change of service plan within 7 business days upon receipt of such request and the new service plan shall be effective after the monthly billing cut-off day as specified by HKBN. 7. Customer shall notify HKBN in writing if he wants to suspend or terminate the Service. HKBN shall suspend or terminate the Service accordingly within 30 days upon receiving such notice. Customer shall be fully responsible for all charges payable to HKBN on or before the date of suspension or termination of the Service. 8. HKBN shall have the right to modify, postpone, terminate or cancel the operation, provision and /or the availability of the Service, the standard rate of the Service and/or the selected service plan (whether in whole or in part), without prior notice or giving any reason whatsoever from time to time. No claim or demand of whatever nature and howsoever arising out of the termination of the Service or the selected service plan or any part thereof or any other matter arising thereby shall be made by Customer against HKBN or its directors, employees, agents, shareholders or management in connection with such termination or otherwise. 9. HKBN reserves the sole and final discretion at any time to terminate any Customer's registration under the selected service plan without giving any reason whatsoever or prior notice to Customer. The decision of HKBN shall be final and conclusive. 10. HKBN reserves the right to add, delete or otherwise amend any of the terms and conditions herein from time to time at its sole discretion. HKBN reserves the right to have final decision on all matters in relation to the Service and/or the selected service plan. 11. Customer shall abide by the terms and conditions contained herein, the General Terms and Conditions of

5 HKBN (as may be amended from time to time), a copy of which shall be available upon request. Notices to be given to Customers in relation to the selected service plan (if any) shall be given in any manner as HKBN shall consider appropriate.
