General assessment Q1 - Do you think that the European Small Claims Procedure is a helpful and efficient tool for consumers in cross border disputes?. If no, what are the main issues which prevent it from being useful? Q2 Do you think that the European Small Claims Procedure is a helpful and efficient tool for SMEs doing cross-border transactions?. If no, what are the main issues which prevent it from being useful? III. Specific issues Q3 Do you think that the standard forms provided for in the European Small Claims Procedure Regulation are comprehensible and "user friendly"?. If no, which elements could be changed/improved? Q4 Does the Member State in which you are domiciled provide free of charge assistance in completing the application form? If yes, how is this organised? The competent courts should provide this assistance (the first instance judicial courts in Portugal). The Claim Forms are available in the national portal of justice called CITIUS (aimed to be used for judicial procedures by digital means) with a link to the European Judicial Atlas. Both the national EJN contact point and the Portuguese European Consumer Centre websites also provide information on the procedure, according to their competence. How does it work in practice? Consumers should contact the first instance judicial court of their residence area.
3 How is information of the assistance disseminated? Information of the assistance is disseminated by the means mentioned above which have national coverage. ECC Portugal, in cooperation with the national EJN contact point produced a booklet to inform consumers and competent courts about the ESCP. The booklet was widely distributed in digital and paper versions to all first instance judicial courts and to municipal consumer advice centres, consumer organisations and alternative dispute resolution bodies. It was also distributed to lawyers and judges that attended some events on consumer law. Q5 There are several Member States that have increased the threshold amount for claims in their national simplified procedures. Should the European Small Claims Procedure follow this trend and be available for claims e.g. up to euro? If yes, would you propose any other upper limit? The threshold could be increased to the same maximum value allowed for the alternative dispute settlement procedures. Q6 - The European Small Claims Procedure sets certain procedural deadlines that aim at speeding up the proceedings; however there is no sanction for the non-observance of such deadlines. Do you think that the Regulation should be strengthened to address the effect of lapse of time provided for under the Regulation? If yes, do you have specific proposals for such strengthening? If certain procedural deadlines are not observed and more elements ought to be added to the procedure, than the judge should always be able to take a decision based on the existing elements either to convict or to absolve. Q7 - The court fees, in particular those paid at the start of the proceedings may have a deterrent effect on the use of the European Small Claims Procedure. Do you think that the issue of court fees should be addressed in the possible revision to tackle such problem? If yes, how do you propose this should be done?
4 A certain harmonisation level of court fees should be reached in order to establish more proportionate values in relation to claims amount. Q8 The European Small Claims Procedure, similarly to other civil procedures entail costs for the parties, relating to e.g. translations, service of documents, travel expenses in case of a hearing, remuneration of witnesses etc. Do you consider that these costs should be addressed in the possible revision? If yes, how the costs of the European Small Claims Procedure could be reduced? There is legal aid to facilitate access to justice in cross-border cases. In spite of this instrument, which would probably not be applicable as often as one could realise in cross-border consumer disputes, there are certain facilities that could be more affordable to consumers in general and even facilitated by the new technologies. Some examples: harmonised and certified translation electronic tools and/or templates; protocols passed with embassies to provide the certified translations for free or at reduced costs; the use of videoconference means should be mandatory whenever its costs are lower than the travel costs required to be heard in person.. Q9 -Though the European Small Claims Procedure is a written procedure, the court may decide to hold a hearing. In order to increase the efficiency and speed of the European Small Claims Procedure, could the discretion of the court to hold an oral hearing be limited in some circumstances?, If yes, what would be such circumstances? Q10 -The Member States may accept a transmission of the European Small Claims Procedure application by any means of communication, including . The use of electronic means could be further improved. Do you think that the seller, or the service provider who communicates with the customers through electronic means, should legally accept to receive the documents in the framework of the European Small Claims Procedure through the same means? If yes, would this need any conditions?
5 A condition could be set up for claims related to purchases made off-line too. This condition would require prior consent of the seller/service provider to legally accept to receive the documents either in paper or through electronic means. Q11 The courts competent for the European Small Claims Procedure are mostly the numerous lowest instance courts that may not be appropriately equipped to carry out the procedure. For example the electronic communication and videoconferencing could increase efficiency of the European Small Claims Procedure and reduce its costs. Do you think that there is need for a better organisation and/or for adequate equipment of courts? If yes, what would you propose for better organisation of courts or for their better equipment? In Portugal, the electronic communication and videoconferencing are already set in place in all first instance judicial courts. The main problem would probably arise from national justice budget constraints that can raise limits to such kind of expenditures by the courts. Q13 -Whilst a judgment given in the European Small Claims Procedure is to be directly enforced within the European Union, the Commission has received complaints on the lack of information on the national enforcement rules and procedures in situations when the judgement resulting from the European Small Claims Procedure is to be enforced in another Member State. Do you think that the Member States should be required to provide structured and updated information on the national enforcement procedures for the judgements resulting from the European Small Claims Procedure, including the possible costs, addresses etc.? If yes, how could this be realised? This could be realised by using the European e-justice portal and the European Judicial Atlas in particular, with links to both websites and/or the websites addresses to be mentioned in the claims forms and/or guides to fill them in. Cooperation of EJN with competent courts for ESCP in each country should be strengthened in order to raise awareness of all relevant legal professionals on this procedure and to provide for the adequate information to citizens.
