1 COUNCIL TAX RESOLUTION INTRODUCTION The Local Government Finance Act 2012 made significant changes to the Local Government Finance Act It replaced Council Tax Benefit with Localised Council Tax Support (LCTS) and localised National Non-Domestic Rates (NNDR). With respect to LCTS, the Act required the overall Council taxbase to be reduced by the amount of Localised Council Tax Support awarded. This was, in part, compensated for, by the award of a grant to keep the Band D charge for Town and Parish Councils, Special Expenses and the City Council roughly the same as it would have been before the changes. Town and Parish Councils were consulted on this in January In the case of NNDR, we used to collect this as an agent for central Government and paid over everything collected to them. In localising NNDR we now collect the same monies but distribute them to central Government, Essex County Council, Essex Fire Authority and retain a part for our own use. The proportions of the split of the income are set by central Government. Government assess the amount that we should need to spend and either pay the relevant authority a "Top-up" payment where their share of NNDR is deemed insufficient, or take a "Tariff" payment from the authority where they are deemed to have excess NNDR. This Council is a "Tariff" authority. The Council Tax Requirements for this Council and the precepts for the other precepting authorities are detailed below. Chelmsford City Council s council tax requirement is 10,299,359 after allowing for a deficit on the Collection Fund of 23,136. This results in an average Band D Council Tax of The Parish and Town Council precepts are detailed in the recommendation below and total 1,997,180. The increase in the average Band D Council Tax for Town and Parish Councils is 1.41% and results in an average Band D Council Tax figure of for 2013/14. Essex County Council has proposed a precept of 65,601,685, after allowing for a balance on the collection fund of 125,759. This results in a Band D Council Tax of 1, The Police and Crime Commissioner for Essex has proposed a precept of 8,540,443, after allowing for a balance on the collection fund of 15,820. This results in a Band D Council Tax of Essex Fire Authority has proposed a precept of 4,009,445, after allowing for a balance on the collection fund of 7,686. This results in a Band D Council Tax of The formal Council Tax Resolution is given below. The effect on individual banded properties is shown in Annex A. (h) Valuation Bands That the amounts detailed in Annex A being the amounts given by multiplying the amounts at 3(f) and 3(g) above by the number which, in the proportion set out in Section 5(1) of the Act, is applicable to dwellings listed in a particular valuation band divided by the number which in that proportion is applicable to dwellings listed in valuation band D, calculated by the Council, in accordance with Section 36(1) of the Act, as the amounts to be taken into account for the year in respect of categories of dwellings listed in different valuation bands. 4 It be noted that for the year 2013/14 the Essex County Council, the Police and Crime Commissioner for Essex, and the Essex Fire Authority have stated the following amounts in precepts issued to the Council, in accordance with Section 40 of the Act, for each of the categories of dwellings shown below:- PRECEPTING AUTHORITY A B C D E F G H The Police and Crime Commissioner for Essex Essex Fire Authority Essex County Council , , , , , Having calculated the aggregate in each case of the amounts at 3(h) and 4 above, the Council, in accordance with Section 30(2) of the Act, hereby sets the amounts detailed in Annex B attached as the amounts of council tax for the year 2013/14 for each of the categories of dwellings shown. 3
