1 ABB ABB S.p.A. Factory in Dalmine (BG) "SMOKE-FREE COMPANY" INTRODUCTION Why go smoke-free? The health risks of smoking tobacco are known and scientifically proven. Tobacco use is the principal preventable cause of death, and of disability in Italy, and is a harmful agent connected with many pathologies. In light of this evidence and in order to protect, in the broadest sense, the health of employees in the workplace, we have decided to adopt suitable measures for protection of health. In addition, the consumption of cigarettes is a significant fire risk and as such the rules require strict regulation of methods, areas and "smoke breaks". Scientific data demonstrates how organizations which implement a clear smoke-free company policy have a lower predominance of smokers among their personnel. The employees of smoke-free companies in fact abstain from smoking for longer periods, reduce the level of dependence on nicotine and are more likely to succeed in their attempts to stop. For the purposes of this policy, by "tobacco" we mean any cigarette, cigar, pipe or other tobacco product, including electronic cigarettes. The implementation of this regulation represents a strong commitment for the company and requires the cooperation of all personnel during the cultural change and application phase. All personnel are being made aware of this Regulation. Advantages The implementation of this policy provides the following advantages: 1. Reduction of tobacco consumption in the company and demonstration of a strong position against the risks to individual and collective health generated by smoking tobacco.

2 2. Safe environment for all workers by reducing exposure to second-hand smoke and the possible risk of fire resulting from incorrect behavior of smokers. 3. Adaptation of corporate practices not only to national legislation, but also to the best practices currently proposed by scientific literature and the national centers of reference. 4. Bringing forward and encouragement of the spread of smoke-free workplaces and communities thereby becoming a model for the territory. 5. Company commitment to identifying and promoting tools within the organization to help its own employees stop smoking. Objectives This policy makes it possible to: have a smoke-free company in all interior and exterior spaces; protect the health and safety of anyone entering the company, guests and visitors included; offer smokers ways to stop smoking; establish continuous support through the company doctor as part of health monitoring; reduce the predominance of smokers among the employees; further protect everyone in the company from possible risks caused by fires being triggered as a result of incorrect behavior by smokers in addition to the risks of possibly being run into by the vehicles on the roads of the plant and next to the current smoking areas located outside the buildings; develop non-smoking culture through continuous information and training on health risks; support ABB's role as health promoter, turning it into a model of reference for everyone in terms of the smoking issue; ensure that ABB continues to remain in the provincial and Lombardy network of health-promoting companies (WHP).

3 Regulations of the ban on smoking in the company These Regulations define and implement the corporate policy regarding smoking inside and outside the company premises; these regulations will go into effect on January 1, The regulations listed below supplement, add to or better specify the rules already established by the corporate regulations, the NWCC, current laws and legislation or internal procedures. Italian legislative references: Art. 51 of Law No.3 of January 16, 2003, the Prime Ministerial Decree of December 23, 2003, Legislative Decree 81/2008. Corporate procedure references: PG Environmental Impact and Risk Assessment, PG Management of Factory Entrance Authorization; PG Emergency Management. The definition of Internal Personnel means all ABB personnel working at the Dalmine facility. The definition of External Personnel means all the personnel of other companies working at our facility, visitors (including ABB personnel from other offices) and transporters or in general anyone coming to our Dalmine facility for work, meetings or visits. Art. 1 - No Smoking Rules It is forbidden to smoke anywhere in the Dalmine facility. There are NO places where smoking is allowed within the perimeter of the ABB facility of Dalmine (including outdoor areas such as balconies, terraces, courtyards, gardens, access roads, and entrance and parking areas). This ban applies both to internal and external personnel; it is also forbidden to smoke inside shared company cars. Art.2 - Guests Guests and in general individuals who are not employees present in the facility for work reasons or provision of services are made aware of and are required to comply with these regulations. Art.3 Outside area reserved for smokers A single, specific area located outside the buildings is identified where smoking is allowed. This area is identified and marked with a special Smoking Area sign, and is equipped with ashtrays to extinguish cigarettes ensuring respect for the environment.

4 Art.4 Methods for accessing the smoking area The Internal Personnel, when entering or exiting the factory to go to the outside area reserved for smokers, must always used the turnstile and swipe their personal badge in order to ensure the correct monitoring of people in the facility in case of an emergency. During work hours, the Internal Personnel are allowed to stop working for a smoke break within the limits provided by the general regulations for breaks. The Internal Personnel must inform their Manager that they are leaving their work station; authorization to leave one's work station will be granted by the Manager provided the work station is monitored and in an absolutely safe condition. External Personnel, with badge (i.e. external companies which have a continuous relationship with ABB or ABB personnel from other facilities) when entering or exiting the facility to go to the outside area reserved for smokers, must always used the turnstile and swipe the personal badge in order to ensure the correct monitoring of people in the facility in case of an emergency. External Personnel without a badge, when entering or exiting the facility to go to the outside area reserved for smokers, must always register with the Supervisory Department (Reception). Art.5 Violations and penalties Failure to comply with these regulations and the breaks, in addition to the possible penalties provided by law, is considered non-compliance with corporate provisions and as such may entail the application of disciplinary measures, as provided by the CCNL of reference. Art.6 Supervision The Managers supervise compliance with the regulations in their departments and offices; they intervene in case of violation by reporting non-compliance to Management and the Human Resources Office for the possible adoption of disciplinary provides pursuant to the preceding article.
