1 FY2011 Operation Stonegarden (OPSG) County of El Paso, Texas Operations Order and Budget Op Order Name: El Paso OPSG 2011 #1 Operation COLT Op Order Number: Op Dates: From: 07/01/2012 To: 09/30/2012 Report Date: 07/16/2012 Executive Summary Operation Stonegarden (OPSG) is funded by the Department of Homeland Security (DHS), led by Customs and Border Protection (CBP) Border Patrol which supports overtime, per diem, and lodging for operational purposes to state, local, and tribal agencies for the purpose of enhancing border security. This funding is designated to enhance cooperation and coordination between Federal, State, and local law enforcement agencies in a joint mission to secure the U.S. borders along routes of ingress and egress leading to and from the U.S./Mexico border. The intent of Operation Stonegarden is to enhance law enforcement preparedness and operational readiness along the land borders of the United States (US). The objective of the program is to increase coordination and local capability in support of DHS goals including those of the outlined in the Border Patrol Strategic Plan. The (EPCSO), El Paso Police Department (EPPD), Socorro Police Department (SPD), and Horizon City Police Department (HCPD) are the main local law enforcement agencies to conduct operations in El Paso County to enhance the capability to detect, prevent, and deter terrorists, weapons of mass effect, transnational gangs, smuggling of contraband, and human trafficking. By increasing the presence and number of qualified, well equipped law enforcement personnel in the area, the probability of detecting illegal activities transiting will increase. Participation of the involved agencies associated with this Tactical Operation Period will also increase the probability of detecting potential terrorists and weapons of mass destruction moving from the immediate border area to major population centers in the United States. Officers performing duties in accordance with this operations order act as a second tier of border security in direct support of the Border Patrol Strategic Plan. They will patrol routes of egress from the border in an overtime capacity within their respective jurisdictions; however they will conduct these duties in coordination with the Patrol Agents in Charge (PAIC) of the El Paso, Fabens, and Ysleta Border Patrol Stations or their Point of Contact (POC). I. Situation A. General Situation: Directly across from El Paso, Texas, along the Mexican border, is Ciudad Juarez, Chihuahua, Mexico, with a population of over 1,300,000. The El Paso-Cd. Juarez community is the largest metropolitan area on the border between the U.S. and Mexico. Overall, this metropolitan area is estimated to have a population of over 2 million inhabitants. In the large metropolitan area of Cd. Juarez, an ongoing territorial drug war between rival cartels has resulted in the murder of over 9,400 individuals since January Other criminal enterprises have taken this opportunity to enhance their presence in Cd. Juarez, resulting in additional kidnappings, assaults, and extortions. The increased violence in Cd. Juarez presents an immediate threat of spillover to the City and County of El Paso. This chaotic environment presents an opportunity for international terrorists and criminal organizations to exploit federal and local law enforcement threats along the border. Law enforcement partnerships are needed to combat this challenging situation. Operation Stonegarden will provide the means to successfully accomplish the mission of securing our Nation s border. B. Terrain/ Weather: is on the far western tip of Texas, with 1,013 square miles and a population of approximately 800,647. shares approximately 47 miles of border with Mexico. The Rio Grande River flows between the U.S. and Mexico. The Rio Grande is usually no wider than 50 meters and can easily be forded on foot, horseback and in some instances, by vehicle. Interstate 10 (I-10), Highway 54, U.S. 62/180 are the most prominent transportation routes. I-10 comes within several hundred yards of the U.S./Mexico border. This proximity to the border offers an avenue of approach to the interior of the United States
2 C. Criminal Element: The criminal element in the El Paso-Cd. Juarez area varies from highly organized Drug Trafficking Organizations (DTOs) to local street gangs. The ongoing drug war in Cd. Juarez has drastically increased violent crime on the border. Gang members directly linked to El Paso and the rest of the U.S., have been identified as working for the cartels, providing services from transport of contraband to actual murders. The ability to track and gather intelligence has become increasingly difficult. The criminal element has become sophisticated with increased counter-intelligence capabilities. Any intelligence gathered, quickly becomes obsolete causing safety concerns for the public as well as for law enforcement. These groups have an extensive network on both sides of the border with generations of knowledge in smuggling routes and techniques. D. State and Local: (EPCSO) (915) El Paso Police Department (EPPD) (915) Socorro Police Department (SPD) (915) Horizon City Police Department (HCPD) (915) Mission The County of El Paso local law enforcement s mission is to conduct high visibility saturation patrols on the local highways, as well as off road patrols as a second line of defense to detect/deter, identify, classify and bring about a law enforcement resolution for those involved in criminal activities using routes of egress within. We will utilize an intelligence driven methodology to assess the risks in our area of responsibility based on the threats and vulnerabilities identified. Through a whole of government approach, we will work directly with our law enforcement partners at the local and federal levels to maximize the efficiency and effectiveness of our Stonegarden Patrols. This is directly in line with the goals of the Border Patrol Strategic Plan. We will utilize delegated authorities to enforce applicable laws. In the event that we encounter criminal activity or suspected criminal activity that may have a nexus to immigration during the course of our assigned patrols, we will contact the U.S. Border Patrol to respond. Immigration status will not be determined by deputies or officers. We will utilize the intelligence gathered to determine the most efficient and effective deployment methodology. The County of El Paso local law enforcement will maintain constant communications to continually provide a coordinated enforcement effort and share intelligence gathering capabilities. Officers of the local law enforcement agencies will operate within their scope of authority to enforce all applicable State and local laws. By patrolling the routes of egress and utilizing these tactics, they will effectively increase the law enforcement presence in the areas leading away from the Texas/Mexico border and deter the utilization of these routes of egress by Transnational Criminal Organizations (TCOs) operating in the border area
3 III. Execution A. Management/Supervisor Intent: It is the intent of all law enforcement partners to increase border security through coordination, collaboration, and cooperation with U.S. Border Patrol, El Paso Sector under the provisions of Operation Stonegarden. The main focus of this Operations Plan is aggressive enforcement of Texas law by particpating jurisdictions and to deny criminal organizations opportunities to smuggle narcotics and/or contraband and to refuse potential terrorists entry, egress, and access to transportations hubs in the western region of Texas. The dates for this operational period is between July 1, 2012 to September 30, B. General Concept: The EPCSO, EPPD, SPD, and HCPD will increase border security through direct coordination with El Paso Sector. It is anticipated that the increase in law enforcement presence along entry avenues, major egress routes away from the immediate border, and at transportation hubs will significantly impact the ability of criminal organizations to operate in the El Paso Sector Area of Responsibility (AOR) in Texas. Intelligence information and vulnerability assessments are critical to this operation. C. Specific Responsibilities: Operation Stonegarden allows the Border Patrol to partner with law enforcement agencies to increase coverage and decrease the ability of TCOs to operate effectively within. Resources assisting in the effort include personnel and patrol vehicles, increased traffic enforcement and assignment of officers to specific areas to assist the Border Patrol. All local activities supporting this Operations Order must be coordinated with the Patrol Agents in Charge (PAICs) of the El Paso, Fabens, and Ysleta Border Patrol Stations or their designated POCs. The El Paso County and its sub-grantees shall maintain a posture of readiness to assist all law enforcement agencies along the U.S. and Mexico border in protecting the welfare, lives and security of property and persons living within the borders of the United States. The and its sub-grantees shall abide by all laws, policies and rules that govern their respective operations in the field and with respect to Operation Stonegarden. During Operation Stonegarden activities, EPCSO and their sub-grantees will utilize their designated authority to patrol high traffic areas used to move illegal contraband, narcotics or humans from the Mexican border into the United States. They will employ tactics and procedures necessary to deter illicit cross-border traffic in the geographical areas identified by the U.S. Border Patrol. D. Coordinating Instructions: Agencies will coordinate with U.S. Border Patrol to ensure the ability to redirect resources to areas deemed the greatest risk to national security based on the most current intelligence and illegal border related activity trends. PAICs at the El Paso, Fabens, and Ysleta Border Patrol Stations or their designated representatives will be the point of contact for the and its sub-grantees for Stonegarden operations. The PAIC will be the approving official of all operations at the Station level. The El Paso Sector Chief Patrol Agent will approve Stonegarden coordinating procedures and policies and provide final approval of all operations at the Sector level. All law enforcement personnel to include the grantee and sub-grantees will report any seizure and/or arrest made through the chain of command for internal purposes. Immediate contact will be made to the El Paso, Fabens, or Ysleta Stations Chain of Command for all incidents requiring emergency notification. Any and all seizures and/or arrests will be documented accordingly to the respective agency s SOPs and documented on Stonegarden Daily Activity Reports. IV. Administration/Logistics A. Cost Estimates/Funding Issues: Requests for EPCSO will be addressed below in the body of the Op Order, while requests for supporting elements will be addressed in the Annex of the Op Order

Uniform and Equipment: Deputies and officers will wear their agency s or department s prescribed uniform at all times and shall have in their possession all required duty gear or equipment. C. Special Equipment: Deputies and officers will be equipped with hand held radios, flashlights, cameras and may be equipped with long arms. Deputies and officers will coordinate with the El Paso Sector for other technological resources that may be available for use. The EPCSO is requesting License Plate Readers as originally requested. However, the Robot and Taser Cams will not be purchased. In lieu of the Robot and Taser Cams, the EPCSO is in need of e-ticket Citation systems. D. Alien Processing: Immigration status will not be determined by deputies or officers. Necessary assistance will be requested from CBP to determine types of identifications produced that cannot be identified by a local law
5 enforcement officer. If persons are identified by a CBP Agent as being in the U.S. illegally, that Agent will be responsible for coordinating transportation within their station s AOR, unless extenuating circumstances require a participating local Agency to transport for any criminal/traffic violation. The U.S. Border Patrol will be responsible for processing undocumented persons and for the disposition of cases having a nexus to immigration issues, unless the case falls under the purview of Immigration and Customs Enforcement. E. Medical: On-scene personnel will provide basic emergency care in the field to injured persons. If necessary, Emergency Medical Service (EMS) providers will be dispatched using the 911 emergency notification system (i.e., Ground Ambulance, Life). El Paso Fire Medical Services (915) Life Ambulance Service (915) Flight/Air Ambulance or Air Evacuation is available if additional treatment or transport to an appropriate medical facility. All casualties will be stabilized and transported to the nearest medical facility according to local EMS protocols. Southwestern Air Ambulance (800) Trauma Medical Hospitals: William Beaumont Army Medical Center 5005 N. Piedras Ft. Bliss, El Paso, Texas (915) / 2331 / 2333 University Medical Center 4815 Alameda Avenue El Paso, Texas (915) Emergency Medical Services will be dispatched through Communications (915) or 911 emergency notification systems. F. Detention Transportation: Immigration status will not be determined by deputies or officers. In the event that we encounter criminal activity or suspected criminal activity that may have a nexus to immigration, necessary assistance will be requested from the U.S. Border Patrol. If persons are identified by a U.S. Border Patrol Agent as being in the U.S. illegally, that Agent will be responsible for coordinating transportation within their station s AOR, unless extenuating circumstances require a participating agency to transport. Border Patrol will make every effort to respond timely and provide transport for any suspected undocumented aliens being detained by participating agencies. Each Border Patrol Station will be responsible for coordinating this transportation within their AOR. G. Vehicles: All participating agencies will provide their own vehicles for this operation. OBP will not provide vehicles for any participating agency at this time. State and local law enforcement vehicles will be used in support of this operation. V. Command/Control/Communication A. Chain of Command: Each law enforcement agency will follow its own Chain of Command concept. B. Unit Command: The on-duty supervisor for each participating agency will function as the detail supervisor during the duration of the operation. C. Communication Details: Each participating agency s communications division will coordinate communications with other units/agencies that are not on common frequencies. Communication between local and federal agencies will take place through the utilization of telephone, correspondence, and other agreed upon electronic means

Administration/Logistics Annex The El Paso Police Department is requesting approximately 8,335 hours of overtime to fund three separate assignments; one to sustain an approximately 240 hour operation for the deployment of approximately two supervisors and approximately eight officers for eight hour shifts from or hours. The second operation is to sustain an approximately 240 hour operation for the deployment of approximately four supervisors and approximately thirty-six officers for five forty hour shifts from , , and hours. The third operation is to sustain an approximately 144 hour operation for the deployment of approximately four supervisors and approximately sixteen officers for a eight hour shift for different hours of the day depending on operation needs. The operation hours and man power is approximate. Total number of supervisors and officer may vary per operational need. Regardless of hours used or number of operations the total will not exceed the budget cost for the quarter as provided below. These hours have been identified as targeted hours based on collection of intelligence debrief (July 5 to July 10, July 19 to July 24, August 2 to August 7, August 23 to August 28, September 13 to September 18, and September 27 to October 2. Southbound Operations will be held July 12 to July 14, July 27 to July 28, August 15 to August 16, August 30 to September 1, September 7 to September 8, and September 20 to September 21. Transnational Gang Ops will be held on approximately July 2, July 11, July 17, July 26, July 31, August 8, August 13, August 22, August 29, September 4, September 9, September 22, and September 25). Overtime: 8,335 $60.00 per hour (fringe included) for a total of $500, Mileage Cost: Approximately 40 shifts of driving 400 miles per shift at.50 cents a mile = $8, The cost of the mileage is based on the average mileage of 400 miles per 8 hour shift worked for 10 Officers.
