1 Adopted by the Board of Directors on August 28, 1976 and amended at various dates through February 20, The following House Rules as provided in the By-laws and as otherwise provided for orderly operation of the Club have been adopted by the Board of Directors as the governing regulations of the Club: 1. CONDUCT: Listed below are specific categories of conduct which will not be tolerated. These rules of conduct are intended to promote a desirable social life within the Tarpon Springs Yacht Club. The paramount rule is that all members should act with proper decorum and with proper respect towards one another and towards Club employees, property and the Club s good name. a. Loud and abusive language, contentious confrontations or any action which embarrasses other members or Club employees b. Actions which damage Club property, good will or reputation, c. Excessive use of alcohol or the illegal use of drugs on Club premises, d. Smoking of any kind is not permitted in the interior premises of the Club (FS ), e. The Florida Health Department does not permit the presence of pets in areas where food is served, except certified service dogs and on outside areas (FS ), f. Actions which involve the Club in unfavorable publicity and/or expense such as lawsuits or other actions which cause others to sue the Club, g. Solicitation, for any reason, without the express permission of the Board. The use of the membership roster is restricted to the private use of members unless approved by the Board, h. Actions which tarnish or compromise the private nature of the Club and the privacy of the membership, i. Failure to observe the Club s policy on criticism, comments or complaints as provided herein. 2. AVAILABILITY: The Club facilities are maintained solely for the use of members and guests. Club functions are outlined in the Quarterdeck and monthly calendar. 3. GUESTS: Any member or co-member may have parents and minor children as guests, when accompanied by the member or co-member, without limitation on the number of visits. If the member or comember invites other guests, they are considered guests only if their expenses are charged to the 1
2 member s account. If the guest(s) pay their own expenses they are considered public attendees and may be subject to a cover charge. 4. PRIVATE PARTIES: The Club is usually available for private parties hosted by a member or members. Such parties may not exclude other members from use of the Club; however access to some areas of the Club may be limited. As an accommodation to members who host authorized private parties at the Club, they may be permitted to have certain non-members act as co-hosts with them. Non-member parents or adult off-spring of members may be designated as co-hosts. No other non-members may act as cohosts. All private parties require prior approval from the Commodore and shall be coordinated with the Entertainment Committee for scheduling. Host members shall be responsible for proper housekeeping and observance of the Club rules at private parties. 5. ALCOHOLIC BEVERAGES: Florida Alcoholic Beverage Laws (FS ) govern the sale of alcoholic beverages in the Club. These laws provide that all liquor sales be by the individual drink and shall be limited to members and their guests. No one under 21 years of age may be served. Minors are permitted in the Lounge when accompanied by parent or guardian. They shall not be served alcoholic beverages and shall not be permitted to sit at the bar. They are permitted elsewhere on the premises under adult supervision. 6. PARKING: Parking shall be limited to established parking areas, please observe the RESERVED parking spots. 7. DRESS: Casual dress shall be acceptable at all Club functions, except as otherwise specified in the Club bulletin. The Club bulletin may specify the following minimum suggested male attire for dinner dances and some other functions: Formal or Coat and Tie, or Jacket or Casual. 8 UNIFORMS: While it is emphasized that the wearing of uniforms is optional the following is a description of the authorized uniforms. Uniform A - White blazer or dinner jacket with white insignia; black or navy blue trousers without cuffs; white shirt; black or navy blue bow or four-in-hand tie; black shoes; black socks; black belt. This is the Dress Uniform. 2
3 Uniform B - Blue blazer with black insignia; white trousers; white shirt; blue or yacht club fourin-hand tie; white shoes; white socks; white belt. OR - Gray trousers with black accessories from November 1st. to April 30th. This is the Club Uniform. Uniform C - Long sleeve uniform type white shirt with epaulets; blue four-in-hand tie; white trousers without cuffs; white shoes; white socks; white belt; blue shoulder boards. This is the Summer Uniform. Uniform D - Short sleeve, open neck, uniform type shirt with epaulets; white trousers without cuffs; white shoes; white socks; white belt; blue shoulder boards. This is the casual Summer Uniform. Uniform A and B are recommended by the Florida Council of Yacht Clubs. Uniforms C and D have become customary at TSYC by those who would like to wear a summer uniform. Ladies substitute black cross-over tie, skirts or slacks where appropriate. The blue shoulder boards may be purchased through the Ships Store. The standard insignias are as follows: Member - one gold bar Member, Board of Directors or Trustees - two gold bars Member, Club Bridge (Vice Commodore, Rear Commodore, Secretary, Treasurer, Fleet Captain) - three gold bars Commodore - four gold bars Past Bridge members or Past Commodores may wear shoulder boards with silver bars in line with the highest rank formerly held. Insignia Location: (Uniform A & B). Insignia of rank is worn on the left breast pocket 1/4 inch below the top. Gold signifies current rank and silver past rank. The Club insignia is worn 1-3/4 inches from the top of the left breast pocket. The Council sleeve insignia is worn 4 inches above the end of the left sleeve, centered from right to left. The insignia for the International Order of the Blue Gavel is worn on the right sleeve if authorized. The name tag is worn on the right side of the jacket in line with the insignia of rank. Insignia Location: (Uniform C & D). Insignia of rank is worn on shoulder boards inserted on shirt straps. Gold signifies current rank and silver past rank. On uniform of the council may be worn on the left sleeve and the International Order of the Blue Gavel patch, if authorized, on the right. They are located 2 1/2 inches above the cuff. Insignia of Rank: The insignia of rank for uniforms A and B are as follows: Commodore-Three stars Vice Commodore-Two stars 3
4 Rear Commodore-One star 9. DINING ROOM: TARPON SPRINGS YACHT CLUB Reservations for Dinner are highly recommended. Reservations for all functions and/or events must be made in advance as soon as possible by calling the Club reservation number or booking with the Chef. All cancellations and changes must be made no less than 48 hours before the event. Members who make reservations for functions and fail to show will be billed for the price of such function. Reservations shall be limited to a maximum of 170. Under special conditions the Board of Directors may limit the number of guests allowed per member, while the Commodore is empowered to waive the 170 limit on special occasions. Arrangement of tables, lighting and other preparations shall be supervised by the chef or person in charge of the function. Others than the committee shall not change or interfere with such arrangements. The dining room shall be left in such condition after each Club function as to minimize the work necessary to prepare for the next event. Cleaning costs may be charged to the host member account. All food and drinks consumed or sold at the club must be provided by the club. Non-members and member guests may not bring food or drinks for consumption or sale to the club. Any exceptions must be explicitly approved by the Manager of Operations (or chef) or the Commodore. Members may bring food to share with other members to scheduled non-public events (pot luck). Florida Statutes require that food establishments must have a State Permit (FS ). The club is responsible for the food consumed within and carries liability insurance. 10. PHYSICAL OPERATION: Operation of utilities, including air conditioning, heating, lighting, automatic sprinkling system, etc. shall be under the supervision of the House and Grounds Committee. Any suggestions as to improvements of equipment and/or operation should be submitted to the Committee. Television should be operated in such a manner as to avoid interference with any formal entertainment. 11. CLUB IMPROVEMENTS: Any major improvements of Club property, or additions to or subtractions from Club equipment, or permanent decorations, must be first approved by the Board of Directors. This is to prevent conflicts in budgetary and planning matters. 12. CLUB CONTENTS: Club equipment of any nature shall not be removed from the premises except with specific permission from the Board of Directors. 13. CLUB RESPONSIBILITY: 4
5 The Club will not be responsible for the loss or damage to personal property or personal injury of members or guests that may occur on Club premises. 14. CRITICISM, COMMENTS, COMPLAINTS: Members or guests must not direct or reprimand any Club employee or employees of outside service contractors. Any complaints must be made to the senior Club officer present, who may take appropriate action. However, the reason for the complaint and suggestions for improvement may be made, preferably in writing, to a Club officer or to the Board of Directors. 15. DOCKS: The telephone number of the Dockmaster and his assistant, if any, will be posted at dockside. Boat slips of the Tarpon Springs Yacht Club may be rented only to members of this Club, the Florida Council of Yacht Club members, and members of the Yachting Club of America (limited reciprocity). In boating emergencies, rentals may be made on a temporary basis to other boaters, at the discretion of the Dockmaster, with the approval of the Commodore. Members may rent boat slips, when available, on a yearly written contract. Monthly rental fees are established by the Board of Directors and are subject to periodic review. The contract allows minor, but prohibits major repairs on a boat while berthed at the Club s dock without board approval. Repairs are restricted to time periods that the Club is open. Slip rentals to members of the Florida Council of Yacht Clubs, while visiting the TSYC, are free for the first night with subsequent nights at rates established periodically by the Board of Directors. Rental to others may only be made temporarily with the approval of the Dockmaster and Commodore and shall be at rates established periodically by the Board of Directors. The Yacht Club slips are intended for active boats. Boats which constitute a nuisance may be subject to cancellation of rental rights. Boat owners must maintain in-force hull and liability insurance for their boat in accordance with the dock lease agreement. In case of threatening weather (hurricanes, flooding, etc.) the boat owners are responsible for securing their boats at the docks to prevent damage to the docks and other boats, or the boats may have to be removed to safe ground at the order of the dockmaster. Residence on board a boat berthed at the Club is not permitted. Temporary live-aboard time is limited to seven days, and then only with the consent of the Dockmaster and the approval of the Commodore. Tarpon Springs Yacht Club docks, and the docks of any other members of the Florida Council of Yacht Clubs are not to be used for commercial purposes by any member of this Club. This includes, but is not limited to, the use of the Club docks or facilities by any owner or passenger of a boat operating under charter or any other commercial arrangement. 5
6 Docking and mooring lines are to be maintained in good condition, free of seriously chafed or worn areas, and shall be of a size adequate for the craft involved, as determined by the Dockmaster. Any member with an assigned boat slip who sells his/her boat shall have 90 days in which to purchase a replacement vessel to occupy the slip or relinquish the slip. At that time, the slip will be assigned to the next member on the waiting list. The Dockmaster shall, with the approval of the Commodore, have the right to reassign or change slips assigned to members, for the convenience of the Club. The TSYC has a number of Kayaks for the use by members. Based on availability, non-members may use the Club s Kayaks under the supervision of and the discretion of the Member in charge. Non-members must sign a liability waiver before Kayak use. 16. BINGO The TSYC has a State of Florida license to play BINGO at the club. Rules and Regulations are covered by the Florida Statutes (2011). Club Members involved in the BINGO (Selling tickets, calling and operating the game, dispersing winnings, etc.) are required to be vetted and approved by the State, TSYC shirts and logo must be worn. Minors (under 18) are not permitted to participate or be in the BINGO room. The BINGO is a public event and non-members are permitted to attend. As such, they must comply with these House Rules and Statutes and may be expelled if in violation. 17. BILLING: Statements are mailed on the first of each month and include all charges for the preceding month. FCYC inter-club charges may not be received by the last day of the month and will be billed on the next statement following receipt. Any FCYC inter-club charges in excess of $ will be billed upon receipt and are due and payable by the last business day of the month in which the charge is billed Payments are due by the 15th of each month. A 1.5% service charge will be applied to unpaid balances on amounts over 30 days. Failure to pay any FCYC inter-club charges which exceed $ by the last business day of the month in which the charges are billed will incur a service charge at a rate established periodically by the Board of Directors in addition to any other applicable service charges. Accounts delinquent over 30 days will be so notified in writing and a period of 30 days grace will be allowed at the end of which time all privileges will be suspended, his/her name removed from the roster and the name posted on the bulletin board until payment is made in full. Member may then be reinstated within one year of the suspension without regard to limitations. Any returned checks will be subject to a service charge at a rate established periodically by the Board of Directors. 18. DONATIONS OF PROPERTY 6
7 Any person donating an item(s) to the Tarpon Springs Yacht Club shall sign a statement granting permanent ownership of said item(s) to the Club. 19. CONFLICTS In the event of conflicts between these Club Rules the Club By-laws, precedence shall be given to the By-laws. TARPON SPRINGS YACHT CLUB Board of Directors 7
