2 Bilag K: Koordinationsaftale mellem Danmark og Tyskland vedrørende 800 MHz-frekvensbåndet AGREEMENT between the National IT- and Telecom Agency, Denmark and the Bundesnetzagentur, Germany concerning the use of the MHz band in border areas April 2011

3 1. INTRODUCTION The frequency band MHz is designated for terrestrial systems capable of providing electronic communications services according to COMMISSION DECISION (2010/267/EC) of 6 May 2010 on harmonised technical conditions of use in the MHz frequency band for terrestrial systems capable of providing electronic communications services (ECS) in the European Union (notified under document C(2010) 2923). This agreement covers the co-ordination of base stations. The user equipment, or terminals, is allowed to be used on a non interference basis, in accordance with ITU RR 4.4 The field strength values in this agreement in relation to ECS are based on a receiving antenna height of 3 meters, 10% of the time and 50% of the locations. The latest version of ITU-R P.1546 Method for point-to-area predictions for terrestrial services in the frequency range MHz shall be used. 2. PRINCIPLES AND TECHNICAL CHARACTERISTICS OF FREQUENCY PLANNING AND FREQUENCY USAGE AT BORDER AREAS The Administrations of Denmark and Germany have agreed on the concept of equal access probability as a new frequency planning principle enabling equitable coverage for two or more networks using the same frequency band with the same or different digital technologies in geographically adjacent areas without coordination. Operation of stations in the respective border area exceeding the specified field strength values after performing traditional frequency coordination would disturb the balance in the respective area and is therefore not desirable. The duplex mode of operation shall be frequency division duplex (FDD) with the following arrangements: The duplex spacing shall be 41 MHz with base station transmission (down link) located in the lower part of the band starting at 791 MHz and finishing at 821 MHz and terminal station transmission (up link) located in the upper part of the band starting at 832 MHz and finishing at 862 MHz. Base Stations in border areas may be operated if the produced field strength at a height of 3 m above ground does not exceed the value of 55 dbµv/m in the reference bandwidth of 5 MHz at the border line, and does not exceed the value of 29 dbµv/m in the reference bandwidth of 5 MHz at a distance of 9 km beyond the border. The field strength calculations shall take into account the sum of all signals radiated from the respective antenna sector within the reference frequency block. The respective field strength values for each signal should be applied by each antenna Side 3

4 sector and can be deduced by reducing the limit proportionally to the frequency block portions falling into the reference bandwidth (reduction factor = 10 x log (frequency block portion / 5 MHz). 3. OPERATOR ARRANGEMENTS To further improve the compatibility of terrestrial systems capable of providing electronic communications services in border areas, operator arrangements shall be encouraged to the extent possible. Subject to agreement between operators other technical characteristics or methods can be used such as: preferential frequency distribution arrangements, (if concerned neighbouring systems in all affected countries are using code division multiple access technologies such as IMT-2000/UMTS) preferential code division arrangements (e.g. according to ERC/REC(01)01), frequency carrier definitions (e.g. with LTE), synchronisation of concerned networks. use of other propagation models. Such arrangements are subject to consent of the administrations concerned. In particular, before giving consent to such arrangements, the administrations concerned should take care that all network operators concerned are parties in such an arrangement. 4. PROTECTION OF DIGITAL TV Digital TV may continue to operate and be implemented in the MHz band as set out in the GE06 Agreement and Plan. ECS networks shall not claim protection from digital TV services stemming from the GE06 Plan. ECS base stations may be implemented in the MHz band without coordination in relation to digital TV, if the cumulated field strength does not exceed 39 dbµv/m/8mhz for a receiving antenna height of 10 m, 10% of the time and 50% of the locations, at the border of a co-channel or overlapping GE06 allotment in operation. By 1. March 2011 the following GE06 digital TV allotment is in operation: AABENRAA CH64 GE06 plan rights which are not implemented and in operation do not need to be taken into account when bringing into service an ECS base station. A one month notice will have to be given before implementing and operating a GE06 right in the band MHz (CH61-CH64). Side 4

5 Digital TV allotments/assignments in operation shall be protected until 31. December Broadcasting shall not operate in the 800 MHz band in Germany and Denmark after 31 December Germany and Denmark may keep existing broadcasting entries in the 800 MHz band listed in the GE06 plan after 31 December DEFINITION OF BORDER The borderline is the coastline, where the border is not on land. 6. REVISION OF THE AGREEMENT This agreement may be modified at the request of one of the signatory administrations where such a modification becomes necessary in the light of administrative, regulatory or technical development. 7. WITHDRAWAL FROM THE AGREEMENT Any administration may withdraw from this agreement subject to six months notice. 8. DATE OF ENTRY INTO FORCE The date of entry into force is the date of signature. 9.
