3 Introduction & important information Majestic Home Insurance - Introduction Introduction This certificate is designed to protect your home, contents, valuables and antiques & works of art. We have set it out to be clear and concise. The certificate of insurance, schedule and any endorsement attached form your Majestic Home Insurance document, which you should keep in a safe place. This document sets out the terms and conditions of the contract of insurance between you and us. Please take time to read the whole document carefully, and contact your broker immediately if you have any questions. It is important that you: are clear which sections you have requested and want to be included; are clear what each section does and does not cover; understand your own duties under each section and under the insurance as a whole; advise your broker immediately of any alterations in circumstances which could affect this insurance In return for payment of the premium shown in the schedule, we agree to insure you, subject to the terms and conditions contained in or endorsed on this certificate, against loss or damage you sustain or legal liability you incur for accidents happening during the period of insurance shown in the schedule. Your insurance relates only to those sections of the certificate which are shown in the schedule as being included. The written authority (which number is shown in the schedule) carrying the seal of Lloyd's Policy Signing Office allows your broker to sign and issue this certificate on behalf of us. Important information Please note the following important information regarding this insurance: A. Adjustment premium We will not charge/refund you for any adjustments you make to your policy if the additional/refund premium is under 20 (including Insurance Premium Tax). B. Contracts (Rights of Third Parties) Act 1999 Clarification Clause A person who is not a party to this insurance has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this insurance but this does not affect any right or remedy of a third party which exists or is available apart from that Act. C. Correct sums insured We have accepted this insurance on the understanding that the sums insured represent the full value of the property insured and that you continually check these. Full value should represent: buildings - the full rebuilding cost including fees and extra expenses contents - the current cost as new valuables, antiques & works of art - the replacement cost or current market value, whichever is the greater D. Cancellation of this insurance (i) Your statutory right to cancel this insurance within the Cooling Off Period You are entitled to cancel this insurance by contacting your broker within 14 days of either: The date you receive your policy documentation; or The start of the period of insurance; whichever is the later. Providing you have not made any claims, we will refund your premium. (ii) Cancellation of this insurance after the Cooling Off Period You can cancel this insurance at any time during the period of insurance by contacting your broker. We will only cancel this insurance or any part of it for a valid reason or if there are serious grounds to do so such as; failure to supply requested security documentation, we have es tablished that you have provided us with incorrect information and you have failed to provide a remedy when requested or non-payment of premium. Any premium due to you will be calculated on a proportional daily rate basis depending on how long this insurance has been in force. No return of premium will be given if a claim has occurred during the period of insurance (if you pay by instalments but you have not paid the full annual premium, then the balance of your annual premium will become payable upon cancellation). 1

Data Protection Act 1998 You should understand that any information you have provided will be pr ocessed by us, in compliance with the provisions of the Data Protection Act 1998, for the purpose of providing insurance, handling claims or complaints, if any, which may necessitate providing such information to other parties. F. Financial Services Compensation Scheme (FSCS) Lloyd s underwriters are covered by t he Financial Services Compensation Scheme (FSCS). You may be e ntitled to compensation from the scheme if a Lloyd s underwriter is unable to meet its obligations to you under this contract. Index linking The buildings and contents sums insured will be indexed each month in line with the relevant indexes shown below: Section One Buildings: The House Rebuilding Cost Index issued by the Royal Institution of Chartered Surveyors Section Two Contents: The Consumer Durables Section of the General Index of Retail Prices or a similar index selected by us. We will not charge you an extra premium for any monthly increase, but at each renewal we will calculate the premium using the new sums insured. For your protection should the index fall below zero we will not reduce the sum insured. H. Non-disclosure / misrepresentation / change in circumstance In deciding to accept this insurance and in setting the terms and premium, we have relied on the information you have given us. You must take care when answering any questions we ask ensuring all the information provided is accurate and complete. Please advise your broker as soon as practicable if any of the information you provided is not accurate or complete or has changed since you applied for this insurance during the period of insurance. When we are notified of a change, we will tell you whether this affects your insurance. For example whether we are able to accept the change and if so, whether the change will result in revised terms and/or a revised premium being applied to your insurance. If we are not able to accept the change and it becomes necessary to cancel this insurance, we will do so as described within the cancellation conditions contained within this insurance. If we establish that you were careless in providing us with the information we have relied upon in accepting this insurance and setting its terms and premium we may: treat this insurance as if it had never existed and refuse to pay all claims and return the premium paid if we provided you with insurance cover which we would not otherwise have offered; amend the terms of your insurance. We may apply these amended terms as if they were already in place if a claim has been adversely impacted by your carelessness; charge you more for your policy; or cancel your policy by giving you 14 days' notice in writing and r eturn any premium paid for the balance of the period of insurance. We or your broker will write to you if we: intend to treat this insurance as if never existed; or need to amend the terms of your insurance; or require you to pay more for your insurance. If we establish that you deliberately provided us with false information we will treat this insurance as if it never existed and decline all claims. I. Several liability notice The subscribing insurer s obligations under contracts of insurance to which they subscribe are several and not joint and are limited solely to the extent of their individual subscriptions. The subscribing insurers are not responsible for the subscription of any cosubscribing insurer who for any reason does not satisfy all or part of its obligations. J. The law applicable to this insurance The parties are free to choose the law applicable to this insurance contract. Unless specifically agreed to the contrary this insurance shall be subject to English Law and the language of this contract of insurance shall be in English. 2

5 Definitions Majestic Home Insurance - Definitions Wherever the following words appear in this certificate they will have the meanings shown below: Antiques & works of art Antiques & works of art includes: antique furniture & objet d art book collection clocks & barometers collections of stamps, coins & medals guns paintings & drawings porcelain, china & glass tapestries & rugs Bodily i njury Bodily i njury includes death or disease Buildings Any permanent structure used for domestic purposes (other than farming) within the grounds of your home including: its decorations the fixtures and fittings attached outbuildings (including; greenhouses, stables, garages barns, studios, pool and summer houses) underground service pipes and cables, sewers, drains and domestic fixed fuel tanks lifts, permanently installed swimming pools, hot tubs, tennis courts, drives, lawns, patios & terraces, driveways, footpaths, ponds, fountains, walls, gates, hedges, fences and cattle grids radio and television aerials, satellite dishes, their fittings and m asts which are attached, solar panels, voltaic cells, wind turbines, external lighting, climate control systems and security systems you own or for which you are legally responsible within the premises named in the schedule Business Business contents Contents Any professional activity or non-manual business you conduct at or from the office in your home Office furniture and equipment, stationary, office supplies, software, books, records and documents all belonging to the business or for which the business is legally responsible Household goods, clothing and personal property (including personal property of permanent members of the home who are in full time education while studying away), oil in fixed fuel tanks, which belong to you or for which you are legally responsible, including: gardening equipment, quad bikes, golf buggies, mobility scooters and wheelchairs surfboards, sailboards, rowing boats and dinghies up to 12 feet/3.66 metres long your personal digital data, music, video, photographs and software from your personal computer business contents wine collection Domestic duties Domestic staff Those duties relating to you, your home and gardens, including general maintenance but excluding demolition, alterations, extensions or renovations Any person who is: employed by you under a contract of service self-employed and working on a labour-only basis under your control or supervision in connection with domestic duties or farming activities, including housekeepers, cleaners, nannies, gardeners, grooms, butlers and maids Credit cards Endorsement Excess Family Farming Credit, charge, debit, bank and cash dispenser cards A change in the terms and conditions of this insurance agreed by us in writing The amount you pay of each agreed claim Any family members (including adopted children, step-children and foster children), fiancé(e)s, co-habitees or partners. Family does not include lodgers or tenants Farming including livery carried out by you on a part time basis at the address shown in the schedule that does not involve the employment of others for more than 1,000 hours in total during the period of insurance 3

6 Definitions Majestic Home Insurance - Definitions Fees and extra expenses Heave Home Landslip Money Fees and extra expenses includes the following: architects, surveyors, consulting engineers, legal and other fees cost of clearing the site and making the building safe any cost you have to pay in order to comply with any government or local authority requirements Upward movement of the ground beneath the buildings as a result of the soil expanding The house or flat including conservatories, garages, greenhouses & outbuildings used for domestic purposes at the address shown in the schedule Downward movement of sloping ground Cash, cheques, postal orders, bank drafts, postage stamps (not forming part of a stamp collection), savings stamps & certificates, travellers' cheques, travel tickets, entertainment tickets, luncheon vouchers, gift tokens premium bonds or other negotiable documents all held for private or domestic purposes This definition extends to include money held for charitable purposes. Occupant Period of insurance Premises Schedule Settlement Subsidence Terrorism Person(s) authorised by you to stay in your home overnight The period this insurance is in force as shown in the schedule Address(es) named in the schedule The schedule is part of this certificate and contains details of you, your premises, the sums insured, the period of insurance and the sections of this certificate which apply Downward movement as a result of the ground being compressed by the weight of the buildings Downward movement of the ground beneath the buildings where the movement is unconnected with the weight of the building Any act(s) including but not limited to: the use and/or threat of force or violence; or the causing, occasioning and/or threatening of harm of whatever nature and by whatever means by any person or group(s) of persons, whether acting alone or on behalf of or in connection with any organisation(s) or government(s) committed for political, religious, ideological, ethnic or similar purposes including the intention to influence any government and/or to put the public or any section of the public in fear United Kingdom Unoccupied England, Wales, Scotland, Northern Ireland, the Isle of Man & the Channel Islands When the home is: insufficiently furnished for day to day living purposes, or not permanently lived in by you (or a person you have authorised) for more than 60 consecutive days Valuables We / us / our You / your Jewellery, furs, watches, gold, silver, gold & silver plated items which belong to you or for which you are legally responsible Lloyd's Underwriters (either individual or corporate) who have a share in this insurance as shown in the schedule Person(s) named in the schedule and all members of their family (including nannies and ot her domestic staff) who are permanent members of the household and who live in the home (including whilst temporarily studying away from home anywhere within the United Kingdom) 4

7 General conditions Majestic Home Insurance Conditions 1. Building work You must tell your broker at least 30 days before you undertake any work to build, extend, renovate or demolish any part of the buildings where: the estimated cost is more than 100,000 or more; and/or you have entered into a contract for the works, which in any way, removes or limits your legal rights against the contractor If you fail to do this we will not have to pay any claim caused by or arising from any building work. When we receive this notice we have the option to change the conditions of this insurance. 2. Occupancy of the property You must tell your broker as soon as possible if you: stop using your home as your permanent private residence or; leave your home without an occupant for more than 60 consecutive days When we receive this notice we have the option to change the conditions of this insurance. 3. Premium payment We will not make any payment under this insurance unless you have paid the full annual premium to your broker (or you are up to date with your instalment payments). 4. Reasonable care You must take all reasonable steps to protect the property insured and keep it in a good condition and repair. You must also take all reasonable steps to prevent accident or injury. If you do not take these steps we will not have to pay any related claim. 5

8 General exclusions Majestic Home Insurance - Exclusions A. Biological and chemical contamination We will not pay for: 1. Loss or destruction of or damage to any property whatsoever, or any loss or expenses whatsoever resulting or arising therefrom; 2. Any legal liability of whatsoever nature; 3. Death or injury to any person; Directly or indirectly caused by or contributed to by or arising from Biological or Chemical contamination due to or arising from: terrorism; and/or steps taken to prevent, suppress, control or reduce the consequences of any ac tual, attempted, threatened, suspected or perceived terrorism. B. Electronic data We will not pay for: 1. Loss or destruction of or damage to any property whatsoever, or any loss or expenses whatsoever resulting or arising therefrom; 2. Any legal liability of whatsoever nature; Directly or indirectly caused by or contributed to by or arising from: computer viruses, erasure or corruption of electronic data; the failure of any equipment to correctly recognise the date or change of date; For the purposes of this exclusion computer virus means a corrupting instruction from an unauthorised source that propagates itself via a computer system or network. C. Existing and deliberate damage We will not pay for: 1. Loss or damage occurring before cover starts or arising from an event before cover starts 2. Loss or damage caused deliberately by you or any member of your household. D. Financial sanctions We shall not provide any benefit under this contract of insurance to the extent of providing cover, payment of any claim or the provision of any benefit where doing so would breach any sanction, prohibition or restriction imposed by law or regulation. E. Indirect loss or damage We will not pay for any loss or damage that is not directly associated with the incident that caused you to claim, except where that loss or damage is expressly included within this insurance. F. Radioactive contamination and nuclear assemblies We will not pay for: 1. Loss or destruction of or damage to any property whatsoever, or any loss or expenses whatsoever resulting or arising therefrom; 2. Any legal liability of whatsoever nature; Directly or indirectly caused by or contributed to, by or arising from: ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel; the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof. G. War We will not pay for any loss, damage or liability directly or indirectly occasioned by, happening through or in consequence of war, invasion, acts of foreign enemies, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection, military or usurped power, or confiscation or nationalisation or requisition or destruction of or damage to property by or under the order of any government or public or local authority. 6

9 Claims conditions & procedure Majestic Home Insurance Claims Your duties In the event of a claim or potential claim, you must comply with the duties below, otherwise your claim may become invalid: A. Notification of a claim Notify your broker as soon as possible, sending in full details of what has happened within 30 days and provide any other information or documentation we may require. B. Notifying the police Inform the police or relevant authorities as soon as possible following malicious acts, violent disorder, riots or civil commotion, theft, attempted theft or lost property and where possible provide us with written evidence and any police or relevant reference number. C. Proof of ownership Provide us with reasonable evidence of ownership, value or age for all items involved in a claim. D. Injury to another person or damage to their property Notify your broker immediately and forward any letter, claim, writ, summons or other legal documentation or correspondence you receive within 3 days, if someone is holding you responsible for injury or damage. You must not admit liability or offer or agree to settle any claim without our written permission, otherwise we will not have to pay your claim. E. Temporary emergency repairs Arrange for temporary emergency repairs to be carried out as soon as practicable to prevent further loss or damage and retain any invoices as they may form part of your claim. Before any additional repair work begins, we have the right to inspect the damaged property. F. Co-operation You must co-operate fully with us and our authorised representatives including loss adjusters and ot her experts that we have appointed at all times. How we deal with your claim A. Defence of claims We may take full responsibility for conducting, defending or settling any claim in your name and t ake any ac tion we consider necessary to enforce your or our rights under this insurance. B. Fraudulent claims If you, or anyone acting on your behalf, makes a claim knowing it to be false or fraudulent in amount or in any other respect, this insurance shall be invalid and all claims shall be forfeited. C. Dual insurance We will not pay any claim if any loss, damage or liability covered under this insurance is also covered wholly or in part under any other insurance except in respect of any excess beyond the amount which would have been covered under such other insurance had this insurance not been effected. This clause does not apply to fatal injury (Section Two-Additional cover D). D. Recovering a loss payment We may pursue, in your name but at our expense, recovery of amounts we may become liable to pay under this policy. You must give us all the assistance we may reasonably require to do this. Settling your claim A. Section One - Buildings If your claim for loss or damage is covered under Section One, we will pay the cost of rebuilding or repairing the damaged building up to the sum insured shown in the schedule. We will also pay up to an additional 25% of the sum insured shown in the schedule for fees and extra expenses (see page 10; Additional Cover D.). B. Section Two - Contents We will at our option decide whether to repair, replace or pay for any article based on the replacement cost. We will not deduct any amount for wear and tear. C. Section Five Valuables, antiques & works of art 1. Specified valuables We will decide to repair, replace or pay t he value of any lost or damaged item that has been specified and listed in the specification. We will only pay up to the value listed in the specification. 2. Specified antiques & works of art We agree that you may decide whether we repair, replace or pay the value of any lost or damaged item that has been specified and listed in the specification. If an item is partially damaged and we decide to repair or restore it, we will also pay any agreed loss in value. We will only pay up to the value listed in the specification. 7

Unspecified items of valuables, antiques & works of art Are i tems that are not specified but are included within the amount insured in the schedule. We will decide whether to repair, replace or pay the value of any lost or damaged unspecified item: if we make a cash settlement we will pay the market value at the date of loss if we repair any unspecified item, pair or set we will pay for any loss in value We will not pay more than the current market value up to 10,000 for any unspecified item, pair or set. 8

11 Section One Buildings Majestic Home Insurance Buildings Please check the schedule to see if this section is covered What is covered This section of the certificate covers: Your buildings for physical loss or physical damage up to the amount shown in the schedule, which happens during the period of insurance provided that any loss or damage is not excluded under this section, the General Conditions or the Conditions page of the schedule What is not covered We will not pay for: 1. The excess shown in the schedule 2. The cost of general maintenance or decoration 3. Damage to any part of a machine/system arising out of its own mechanical or electrical fault, breakdown, burn out or failure 4. Loss or damage directly or indirectly caused by or arising from: a. any structural demolition, structural alteration or structural repair to the buildings b. warping, shrinking or normal settlement c. moth, vermin, wear and tear, infestation, corrosion, damp, wet or dry rot, fungus, mould or any other gradually operating deterioration d. misuse by you, faulty workmanship or the use of defective materials e. dryness, dampness, extremes of temperature or exposure to light unless the loss is caused by fire or by frost damage to or water damage from fixed water tanks, apparatus and pipes f. chewing, scratching, tearing, denting or fouling by domestic pets g. pollution and/or contamination of any kind other than as a result of oil from a fixed domestic heating installation at your premises 5. Loss or damage caused by subsidence or heave of the site upon which the buildings stand or landslip: a. to domestic fixed fuel-oil tanks in the open, swimming pools, hot tubs, tennis courts, drives, patios and terraces, footpaths, walls, gates, hedges and fences unless the main dwelling is also physically damaged by the same event b. to solid floors unless the walls of the house are damaged at the same time by the same event c. where compensation has been provided for or would have been, but for the existence of this insurance, under any contract, guarantee or by-law 6. Loss or damage caused by: a. coastal or riverbank erosion b. storm or flood to gates and fences c. storm to open sided outbuildings d. theft, attempted theft, escape of water, escape of oil, malicious damage or vandalism, while your home is not adequately furnished to be lived in e. accidental damage, theft or attempted theft (unless accompanied by violent and forcible entry), whilst your home is lent, let or sub let f. water leaking from fixed water tanks, apparatus and pipes while your home is unoccupied, unless the central heating is maintained at a minimum temperature of 10 Celsius or the fixed water tanks, apparatus and pipes are drained down g. water leaking from swimming pools 9

Alternative accommodation Your reasonable and necessary costs for alternative accommodation while your home cannot be l ived in following loss or damage we have agreed to pay under this section Alternative accommodation for more than three years B. Contents of a property you rent out If you rent your home out unfurnished, we will extend this section to insure your carpets, curtains and domestic appliances against any physical loss or physical damage that occurs during the period of insurance provided they are not insured elsewhere. We will decide whether to repair, replace or make a cash settlement for the damaged or lost item based on the replacement cost More than 5,000 for any one loss C. Extended rebuilding cost If you have had a professional buildings valuation carried out on your home, by a valuer approved by us, within the last three years we will pay t he extra cost to rebuild or repair the damage over and above the sum insured shown in the schedule 1. More than 25% of the sum insured shown in the schedule 2. If any building or part of the building is either Grade 1 or Grade A listed 3. This extra cost if you have not told us about any additions, alterations or improvements you have made to the buildings since the agreed valuation was carried out which have increased the sum insured D. Fees and extra expenses We will pay up to an additional 25% of the buildings sum insured shown in the schedule for reasonable and necessary fees and extra expenses involved in rebuilding or repairing the buildings following physical loss or damage E. Garden restoration Costs you have to pay to restore your garden following loss or damage by fire, lightning, collision or impact, explosion, aircraft and ot her flying devices, theft or attempted theft, or damage caused by malicious people or the emergency services 1. More than 1,000 for any plant, tree or shrub 2. More than 10,000 in total during the period of insurance F. Locating a leak Costs you have to pay for finding the source of any escape of: domestic fuel leaking within your home, or water leaking from your permanent internal plumbing or heating system, fixed water tanks, apparatus, pipes or any fixed domestic heating installation water leaking from the outside underground service pipes for which you are legally responsible at the address shown in the schedule More than 15,000 in total during the period of insurance 10

Purchasers cover If you sell the buildings covered under this section, we will cover the purchaser from the time you exchange contracts until the sale is completed but only within the period of insurance 1. If the buildings are insured under any other insurance 2. Any other additional cover under this section H. Rent due to you Loss of rent due to you which you are unable to recover as landlord while your home cannot be lived in because of: loss or damage we have agreed to pay under this section; or the local authority denying access to your home 1. Loss of rent for more than three years 2. If only fixtures and fittings are covered under the buildings section I. Underground services The cost of repairing or replacing underground service pipes, cables, sewers and drains for which you are legally responsible for 11

14 Section Two - Contents Majestic Home Insurance - Contents Please check the schedule to see if this section is covered What is covered This section of the certificate covers: What is not covered We will not pay for: Your contents for physical loss or physical damage up to the amount shown in the schedule, which happens anywhere in the world during the period of insurance provided that any loss or damage is not excluded under this section, the General Conditions or the Conditions page of the schedule Specific limits The following amounts are the most we will pay for items as part of the total contents sum insured, unless a higher amount is shown in the schedule: 5,000 in total for replacing your personal digital data, music, video, photographs and software from your personal computer 5,000 in total for retrieving your personal digital data from your personal computer 10,000 in total for business contents 5,000 in total for each claim for valuables 5,000 in total for surfboards, sailboards, rowing boats and dinghies up to 12 feet/3.66 metres long, including accessories 5,000 in total for caravans and trailers 5,000 in total for personal documents or title deeds 10,000 in total for home office supplies 10,000 in total for each claim for items that are left outdoors 1. The excess shown in the schedule 2. The cost of general maintenance or decoration 3. Damage to any part of a machine/system arising out of its own mechanical or electrical fault, breakdown, burn out or failure 4. Loss or damage to quad bikes, golf buggies, mobility scooters and wheelchairs, surfboards, sailboards, rowing boats and dinghies or sports equipment (other than saddlery) while being used 5. Loss or damage to any item(s) in transit unless: a. you have arranged to have them professionally packed; or b. you have packed and secured them in relation to the nature of the item and the type of transport 6. Loss or damage directly or indirectly caused by or arising from: a. warping or shrinking b. moth, vermin, wear and t ear, infestation, corrosion, damp, wet or dry rot, fungus, mould or any other gradually operating deterioration c. misuse by you, faulty workmanship or the use of defective materials d. dryness, dampness, extremes of temperature or exposure to light unless the loss is caused by fire or by frost damage to or water damage from fixed water tanks, apparatus and pipes e. chewing, scratching, tearing, denting or fouling by domestic pets f. pollution and/or contamination of any kind other than as a result of oil from a fixed domestic heating installation at your premises 7. Alternative accommodation Your reasonable and necessary costs for alternative accommodation while your home cannot be l ived in following loss or damage we have agreed to pay under this section Alternative accommodation for more than three years B. Contents covered in a residential home or care home Personal property of parents or grandparents who live in a nursing home or residential care home. 1. Any losses for valuables, money or credit cards 2. Any loss if the property is insured elsewhere 3. Any loss for theft or attempted theft, unless it is following forcible and violent entry 4. More than 10,000 per person for any one claim C. Disability costs Necessary alterations to your home to allow you to live there unassisted following an accident occurring during the period of insurance which results in either you being registered blind or your total permanent loss of use of a complete arm, hand, foot or leg 1. Any disability costs unless we have agreed them prior to any alterations starting and our preferred medical adviser examining both you and your records as we deem necessary 2. Arising in Canada or the United States of America after the total period of stay in either or both countries has exceeded 90 days in the period of insurance 3. Resulting directly or indirectly from the transmission of Acquired Immune Deficiency Syndrome (AIDS) or AIDS Related Complex (ARC) by you 4. For any vehicle while it is being used for racing, pace making or speed testing 5. For any motorised vehicle (other than gardening equipment, quad bikes and golf buggies as long as you or someone with your permission are not using them on any public road where you are required by law to have motor liability insurance) 6. For fines or penalties, or for damages which are only intended to punish or make an example of you 15

18 Section Four Legal liability to the public Majestic Home Insurance - Liability This section only applies if the schedule shows that either the buildings are insured under section one or the contents are insured under section two PART A Part A of this section applies in the following way: If the buildings are insured under section one of this certificate, you are insured under Part A (1) below for your legal liability as owner of the premises shown in the schedule If the contents only are insured under section two of this certificate, you are insured under Part A (1) and Part A (2) below, for your legal liability as occupier of the premises shown in the schedule If the buildings and contents are insured under section one and two of this certificate, you are insured under Part A (1) and Part A (2) below, for your legal liability as owner or occupier of the premises shown in the schedule Limit of insurance The following limits apply under this section: The most we will pay in total for the period of insurance for pollution and/or contamination is 10,000,000 In respect of other liability covered under section four: the most we will pay for any one accident or series of accidents arising out of any one event, plus the costs and expenses which we have agreed in writing, is 10,000,000 What is covered This section of the certificate covers: What is not covered We will not cover any liability: Part A (1) Any claim you become legally liable to pay as damages for: bodily Injury damage to property caused by an accident happening at the premises during the period of insurance Part A (2) You as a private individual for any amounts you become legally liable to pay as damages for: bodily injury damage to property caused by an accident happening anywhere in the world during the period of insurance 1. For bodily injury to you or any other permanent member of your home or any person who at the time of sustaining such injury is engaged in your service 2. Resulting directly or indirectly from the transmission of Acquired Immune Deficiency Syndrome (AIDS) or AIDS Related Complex (ARC) by you 3. For loss or damage to property which belongs to you or is in your or your employees care, other than damage to the buildings which you as tenant are legally liable 4. Arising in Canada or the United States of America after the total period of stay in either or both countries has exceeded 90 days in the period of insurance 5. Arising directly or indirectly out of any profession, occupation, business or employment other than farming 6. Arising from any contract, unless you would have been liable by law if the contract had not existed 7. Arising out of your ownership, possession or use of: a. any motorised vehicle (other than gardening equipment, quad bikes, golf buggies, mobility scooters and wheelchairs as long as you or someone with your permission are not using them on any public road where you are required by law to have motor liability insurance) b. any aircraft or watercraft other than surfboards, sailboards, rowing boats and dinghies up to 12 feet/3.66 metres long c. surfboards, sailboards, rowing boats and dinghies while they are being raced 16

19 Section Four Legal liability to the public Majestic Home Insurance - Liability What is covered - Continued What is not covered - Continued We will not pay you for any liability: d. any animal other than livestock in connection with farming, or domestic pets (which are not designated as dangerous as defined in the Dangerous Dogs Act 1991, the Dangerous Dogs (Northern Ireland) Order 1991, the Dangerous Dogs (Amendment) 1997, the Control of Dogs (Scotland) Act 2010 or any amending legislation) 8. In respect of any kind of pollution and/or contamination other than: a. caused by a sudden, identified, unexpected and unforeseen accident which happens in its entirety at a specific moment of time during the period of insurance at the premises named in the schedule; and b. reported to us no later than 60 days from the end of the period of insurance 9. Arising out of your ownership, occupation, possession or use of any land or building that is not within the premises 10. If you are entitled to indemnity under any other insurance, including but not limited to any horse or travel insurance, until such insurance(s) is/are exhausted 11. For fines or penalties, or for damages which are only intended to punish or make an example of you Part B What is covered This section of the certificate also covers: What is not covered We will not pay: Any sums which you have been awarded by a court in the United Kingdom and which still remain outstanding three months after the award has been made, provided that: part A (2) of this section would have covered you had the award been made against you rather than to you there is no appeal pending you agree to allow us to enforce any right which we shall become entitled to upon making payment More than 5,000,000 for any one claim Part C What is covered This section of the certificate also covers: What is not covered We will not pay you for any liability: Any amount you become legally liable to pay under Section 3 of the Defective Premises Act 1972 or Article 5 of the Defective Premises (Northern Ireland) Order 1975 in connection with any home previously owned and occupied by you 1. The excess shown in the schedule 2. Damage to any part of a machine/system arising out of its own mechanical or electrical fault, breakdown, burn out or failure 3. Loss or damage to any item(s) in transit unless: a. you have arranged to have them professionally packed; or b. you have packed and secured them in relation to the nature of the item and the type of transport 4. Loss or damage directly or indirectly caused by or arising from: a. cleaning, repair, renovation, restoration or any other similar process b. warping or shrinking c. moth, vermin, wear and t ear, infestation, corrosion, damp, wet or dry rot, fungus, mould or any other gradually operating deterioration d. misuse by you, faulty workmanship or the use of defective materials e. dryness, dampness, extremes of temperature or exposure to light unless the loss is caused by fire or by frost damage to or water damage from fixed water tanks, apparatus and pipes f. chewing, scratching, tearing, denting or fouling by domestic pets g. pollution and/or contamination of any kind other than as a result of oil from a fixed domestic heating installation at your premises 5. Death of artist We will automatically increase the insured value of any antiques & works of art we insure by 100%, if the artist dies within the period of insurance. We will only agree to this increase for the 6 months following the death, provided you supply a professional valuation or purchase receipt that is no m ore than 3 years old at the time of loss or damage What is not covered We will not pay for: 1. More than 100,000 in total during the period of insurance 2. Any increase if you cannot provide a professional valuation or purchase receipt and proof of an increase in the value B. Defective title If a person proves that you do not have good title to an insured item and you are legally required to return it to its original owner, we will pay the amount you paid for it, or the sum insured shown in the schedule if this is less 1. More than 25,000 for any one claim 2. Items purchased through an auctioneer or dealer who is not a member of one of the following: a. British Antique Dealers Association (BADA) b. Royal Institute of Chartered Surveyors Fine Art Faculty c. Society of Fine Art Auctioneers (SOFAA) d. London & Provincial Antique Dealers Association (LAPADA) C. Items out of bank or safe deposit Where your schedule states that valuables are insured in your bank or safe deposit, we agree to cover them up to a maximum of 50,000 for loss or damage whilst temporarily removed from your bank or safe deposit for up to 30 days in any on e period of insurance without our prior agreement Any loss or damage unless items are worn, in your custody and control or in the same room as you, at the time that loss or damage occurs D. Newly purchased items We will increase your valuables, antiques & works of art sums insured as listed in the schedule by up to 25% during the period of insurance to cover newly purchased items.
