1 FOR COUNCIL MEETING OF: February 28, 2011 AGENDA ITEM NO.: 4.3 (a) TO: FROM: SUBJECT: MAYOR AND CITY COUNCIL JANE AIKEN, MUNICPAL COURT REAPPOINTMENT OF MUNICIPAL JUDGE PRO TEMPORE AND APPOINT NEW JUDGES PRO TEMPORE ISSUE: Shall the City Council reappoint Frank Gruber as Municipal Judge Pro Tempore and appoint David Hittle and Deborah Wilson as new Municipal Judges Pro Tempore for the Salem Municipal Court? RECOMMENDATION: Pursuant to Section 24(7) of the Salem City Charter, Municipal Judge Jane Aiken recommends that Council reappoint Frank Gruber as Municipal Judge Pro Tempore and appoint David Hittle and Deborah Wilson as new Municipal Judges Pro Tempore for a two year period. BACKGROUND: Pursuant to Section 24 (7) of the Salem City Charter, "The council may, upon recommendation of the municipal judge, appoint municipal judges pro tem for terms of office not to exceed two years set by the municipal judge or the council." Salem Revised Code (SRC) Section 4.020(b) provides for the City Council's appointment of pro tempore judges for the Salem Municipal Court. A municipal judge pro tempore shall serve a term not to exceed two years. The length of term shall be recommended by the Municipal Court Judge and set by the City Council at the time of appointment. SRC 4.015(b) states that no person shall be eligible for appointment as municipal judge pro tempore unless the person is at least 21 years of age, a Citizen of the United States and an active member in good standing of the Oregon State Bar. FACTS AND FINDINGS: The pro tempore term for Frank Gruber will expire on March 18, Mr. Gruber has served as Pro Tempore Judge in the Salem Municipal Court since March 2004 and was the elected Municipal Court Judge from 1991 through Mr. Gruber, Mr. Hittle and Ms. Wilson are active members of the Oregon State Bar.
