12 Polish Law (section based on book: Prawna ochrona zwierzat by Marek Mozgawa) Statute dated 21st August 1997 about protection of animals rearranges the legal status connected with the humane protection of animals and adapts Polish legal solutions to international standards.

13 Statute about protection of animals The rule expressed in Art 1 subsection 1 animal as a living creature able to feel and su er is not an object and man shall respect it and provide it with protection and care. But simultaneously in Art 1 subsection 2 the Statute requires a suitable application of the rules relating to objects in terms not covered by the Statute as far as animal is concerned.

14 Before the Statute dated 1997 the animal could have been regarded as equal to objects in the civil and legal sense only when it had been separated from its natural environment hence it had two constitutive features of an object defined in Art 45 of the Polish Civil Code.

15 Under the terms of The Statute it is a criminal o ence to kill an animal without a reason, or in an inhumane way (Art 35 subsection 1), or to ill-treat an animal, or to do the above mentioned things with a special cruelty (Art 35 subsection 2).

16 The national empirical investigations (October 1997 June 1999) showed results: 1242 cases relating to legal and penal protection of animals (including 1080 cases based on Art 35 sub 1) amongst them: 463 cases sent to the court 548 cases abandoned at the preparatory stage 166 cases not accepted for processing

17 The typical o ender: a man primary or vocational educational background usually unemployed as a rule not prosecuted formerly in about 50 % of cases in his 40s

20 The legal and administrative protection of animals is regulated in the part of the material administrative law which refers to the law of the protection of the environment and agricultural law. The Statute dated 21st August 1997 is not the code of the protection of animals. The preveiling legal forms of protection are administrative regulations and administrative decisions.

21 Statute dated 21st August 1997 in details: Regulation of animals: pets, farm, circus, film, entertainment, sport, wild, exotic. It is forbidden to kill an animal without a reason, or in an inhumane way and with physical cruelty

22 Defines cruelty towards animals: intentional causing the pain or su ering, in particular: intentional hurting or wounding the animal, which is not a legally permitted medical treatment or experiment, intentional use of ill animals for work or sport or entertainment reasons or forcing them to act that may cause pain, beating animals with hard or sharp tools, overloading the animals that pull oxcarts with too heavy cargo or forcing them to run too fast, transport of animals causing unnecessary pain, body harm or death, using harness or any other tools forcing the animal to maintain innatural body position, unnecessary pain, body harm or death, surgery operations and treatments done by people without authorization or not in accordance with veterinary art, without necessary precaution and in a way that causes pain that might have been avoided, malicious frightening or provocation of animals, keeping the animals in inappropriate living conditions, abandonment of animals, in particular cats or dogs by an owner or a keeper, using cruel methods in breeding, keeping animals tied up what causes body harm or su ering and depriving them of necessary movement, organizing animal fights.

23 Sections of The Act Section 2 - pets Section 3 - farm animals In particular Art 12 subsection 4: fattening goose and ducks for foie gras is forbidden. But now in Poland, since it is a memberm mber of The EU there is no longer a word import but freedom of trade,, hence foie gras can be and it is transported from the other EU member states. Section 4 - entertainment, theatre, film, sport, special event animals Section 5- deleted, zoological garden matters taken to Protection of Environment Law 2004 in Section 3, Articles Section 6 - wild animals

24 Sections of The Act Section 7 transport of animals Section 8 medical treatment Section 9 deleted, experiments taken to animal Experimentation Act 2005 Section 10 slaughtering and putting to death and reduction of population In particular: Putting to death of an animal can have only a cause such as: economic reason humanitarian reason sanitary need excessive aggressiveness that threatens directly human life and also farm and wild animal lives scientific reasons acting to protect environment

25 Criminal Sanctions in the Act: Section 11 - criminal sanctions 1. He who kills an animal or does an animal slaughter not in accordance with the articles of the Act or causes harm as defined in Art 6 subsection 2 shall be fined, or have a penalty of restriction of liberty or imprisonment up to 1 year. 2. If the perpetrator of the deed is acting with particular cruelty he shall be fined, or have penalty of restriction of liberty or imprisonment up to 2 years. The other articles introduce e many other penalties and legal consequences.

26 Art. 38 and Art 40 Non governmental organizations that protect animals can act as ancillary prosecutor and can co- operate with state and local authorities in disclosure and prosecution of the crimes.

28 Association Empatia Empathy (Polish:: empatia) - awareness of feelings of other beings, ability to imagine their point of view and mental state, sensible identification with them, capability of understanding their emotions. This skill enables us to share life with them and to take responsibility for it. Capacity for empathy is connected with the ability to take a deep look inside oneself and with great personal sensibility for everything that exists.

29 Association Empatia Empatia is an association that has been created by a group of people convinced that our culture needs strong modifications, especially concerning our relation to other sentient creatures. We are registered as a Polish association in the National Court Register (nr ) since January In fact, we have been acting as Inicjatywa Empatia - a non-formal group since February Over 100 members, all of them are vegetarian.. Many of them are vegan.

30 Association Empatia Our purpose is to strive for humanitarian treatment of humans and animals through: * Organising thematic, nationwide campaigns with informational, educational, cultural and interventionist aspects. * Intervening in cases of abuse of humans and animals and conducting protests with respect to current law. * Creating and promoting a new cultural model, outlook on life and a way of living devoid of cruelty, aggression, destruction, chauvinism and indi erence; including promotion of vegetarianism, veganism,, and healthy lifestyle.

72 Snake keepers very often cheat on internet auctions and adopt rabbits and other small animals, then treat them as alive food for their snakes. People who keep snakes at home often do it for their sadistic pleasure, they are also interested in animal fights and other criminal behaviours.

73 Meetings and Reunions Rabbit Watch Association is a thriving artery we organise meetings, reunions, internet discussions for dozens of lovers of these beautiful animals, among whom are children, teenagers, adults and seniors. Age is not important in our discussions, what matters is the common passion.

78 OTOZ Animals The Polish Society for the Protection of Animals OTOZ Animals is a charity established in 2000 and having five branches all over Poland. We are dealing with domestic and farm animals, organising campaigns and lobbying activity aimed at an improvement in the fate of animals. We are a member of the ECFA coalition built by Compassion in World Farming (CIWF) and we have just become Eurogroup member. We are also a member of the World Society for the Protection of Animals (WSPA).

79 OTOZ Animals participated in the adoption of the Animal Protection Act in Poland, organised a transport campaign following the transport of calves from Poland to Italy, organised a conference for local vets as well as teachers and lecturers from Polish Agriculture and Veterinary Medicine Universities.

81 OTOZ Animals: Campaigns Our biggest and most famous campaign was organised two years ago when a film documenting some of the slaughter methods used in Poland was recorded. The slaughter footage was shown by all the Polish TV channels and the first slaughter-related trial in the history of Polish jurisdiction followed.

82 OTOZ Animals: Campaigns The trial devoted to cruelty in slaughterhouses has become a national campaign involving mass media and well-respected Polish personalities. As far as we know, it is the first such trial not just in Poland. It shows how important the enforcement of the regulations is.

83 OTOZ Animals: Campaigns Nowadays together with CIWF we are involved in broiler and laying hens campaign,, lobbying the Ministry of Agriculture and MEPs.

85 Humane Education It is not very advanced but some organizations do it.. For example Viva! Foundation has started this year, and also Rabbit Watch Association has prepared lessons about rabbits.

86 Social Change More people see the problem many people sign petitions against transport of horses or animals in circus. Fur, fish, hunting the problem becomes present in public discussions.. Most people are against shooting the dogs by hunters in case they went to the forest alone at least 200 meters from nearest buildings (in fact many dogs are shot in the presence of their owners). Internet forums, portals, websites those people become engaged, read more and more about the facts, then they start their own associations or actions. Specialistic forums about dogs, cats, guinea pigs, horses, wolves. Rabbits now they become pets and perhaps their status will change, people will treat them like dogs or cats. 2 mln visitors at during 2 years. Newsletter of Empatia people registered. During our actions i.e. Day Without Fur or Fish Day over one hundred of Polish cities take part, thousands of leaflets are printed and sent to them.

88 Achievements Day without Fur, Fish Day hundreds of Polish cities, thousands of leaflets, it was never before Fur farms cooperation with local citizens Transport of Horses everyone in Poland knows the problem and is against it, Media, main newspapers, television very friendly Animal Experimentation Act testing cosmetics on animals is forbidden. The Act was changed for many times, lots of organizations cooperated,, we sent our requests to the former President of Poland and he voted against wrong version of the Act, that was our success.
