How Can This Be happening To Me? (To protect our client s confidentiality, last names are not used.) Take for example, Kirk, one of my clients. Kirk was a hard working man, who worked as an auto body specialist for a large body shop. One night after working all day at the shop in the repaint room, on his way home he was stopped by a police officer. The Officer said that Kirk s driving was erratic. The officer asked Kirk if he had been drinking. The officer said that Kirk s eyes were glossy and his driving was erratic. Kirk told the officer that he was working late and had been around chemicals for auto bodywork all day. The officer didn t believe Kirk and asked him to step out of the car placing him under arrest. He was taken to the police station and charged with a DUI. Kirk was completely devastated by all this. In fact, he was completely taken by surprise that he was charged for a DUI, even though he didn t have anything to drink. Since Kirk needed his driver s license to operate auto equipment around the shop, he was in serious trouble of losing his job. Kirk didn t want to tell his boss about the DUI charge since he would probably be fired. He was confused and didn t know what to do about his situation, or his job. He didn t want to lose everything he had worked so hard for. Things really started to look bad for Kirk, since he had to appear in court in a few days. Kirk was desperate when he first came to our office. He told me that he didn t want to lose his job over a DUI charge. So, I immediately did some checking for Kirk regarding the chemicals he was working with. I hired a chemical expert to investigate the job site and the chemicals Kirk was using that night.

4 When the day arrived for Kirk s DUI case to come to trial, Kirk was extremely nervous, since he had a lot to lose should he be convicted of a criminal DUI. I began to present Kirk s case to the officer regarding the event that led to Kirk being stopped by the officer. I explained that the strong chemicals Kirk was using in the auto body shop affected his eye s causing them to tear and become blood shot. His vision was altered due to the chemicals that were being used. Kirk regularly worked in an area where the ventilation was poor. When I offered the opinions of my expert, it was a tremendous turning point for Kirk s case. Without our expert, it really could have been an uphill battle for Kirk. 5 MYTH #1: MOST PEOPLE ACCUSED OF A DUI CRIME ARE GUILTY! This myth is probably one of the most troubling myth of all - harbored by the public and lawyers alike. In my opinion, lawyers who believe this myth should never represent a client who s been accused of a DUI charge. It causes harm by eliminating objectivity to the clients case. In the cases where the chemical test used by law enforcement, an infrared breath analysis machine and not a blood test is most often used. This type of evidence can be attacked by a skillful defense attorney. Fortunately for us most prosecutors have no idea how inadequate infrared breath machines are at gathering hard evidence. The fact is that these machines are so unsophisticated at gathering data that virtually no scholarly researcher would ever use it as a means of investigation. Yet prosecutors assume that since the state has approved these machines, its accuracy and reliability are not subject to be challenged in a court of law. Did you know that there are at least 30 ways to rebut the evidence presented from these unsophisticated machines if the attorney understands how these machines work? Most importantly what causes these machines to malfunction, and that the machines are a non-specific test for alcohol. (1) In other words, the machine doesn t actually TEST for alcohol. UNBELIEVABLE!!! The most important fact to understand is how these machines work and how to effectively cross-examine the state s chief witness (the operator) of this device on the alleged accuracy of the machine. How about the classic roadside sobriety tests? What I call the opinion gathering evidence done at local DUI checkpoints. Recent studies have shown that these field tests are assumed to be valid. However, most officers who administer these tests either require the wrong test or improperly instruct the suspect on how to perform them. (2) Being skilled at obtaining the right data could help me position a pre-trial ruling that these tests and the alleged indication must be excluded from the evidence due to lack of scientific foundation. Without evidence, the case cannot proceed with the prosecution. You win. I would leave NO stone unturned! The bottom line here is that these cases require a detailed scientific investigation, similar to a complex murder scene that involved DNA evidence, or ballistics tests. MYTH #2: IT S IMPOSSIBLE TO WIN A DUI CASE! Not only does the general public believe this to be true, but so do prosecutors. This myth is the biggest misconception regarding DUI. In fact, the good news is that experienced DUI defense attorneys win many of the cases, when there is not evidence of a car accident or bad driving involved.

6 When I say win a DUI case I mean having the charges dismissed. In Mississippi, there are no plea bargains for DUI offenses. The most important thing to remember here is you don t ever want to lose your driving privileges or land in jail. In the cases that don t allow for jury trials for misdemeanor drunk-driving charges, a defense attorney will have a challenge convincing the judge to acquit the case. By not investigating all your options, you could leave yourself at the mercy of the prosecutor or the judge. Again, if you had to go against the government you d want the most aggressive skillful lawyer going up to bat for you; a lawyer with a lot of experience and a lawyer who has tried to verdict a number of cases. Just to drive the point home, if you remember back to the Trial of The Century, (the O.J. Simpson trial), in my opinion the only reason why O.J. Simpson didn t go to jail for life was because he retained the best experts and lawyers he could find. Those lawyers and experts were able to exploit weaknesses in the prosecution s case. Not only do I, but thousands of people across the country believe that to be true. MYTH #4: DRUNK DRIVING IS A MINOR CRIME. Maybe 20 to 30 years ago DUI charges were minor offenses. Many veteran attorneys remember the days when drunk-driving charges carried a slap on the wrist, and fines of $50 to $150, with no loss of driving privileges. In fact it was a simple walk down to the court house paying a small fine and letting the judge reprimand and you for a few minutes. However, those days are long gone!
