3 VALCOUSTICS CANADA LTD. 101 Masonry Court /Burlington Vibration Update File: Page 1 Railway Vibration Analysis 101 Masonry Court Proposed Residential Development City of Burlington 1.0 INTRODUCTION 1.1 PURPOSE Measurements of railway-induced ground-borne vibration have been carried out to determine whether vibration isolation is warranted as part of building/project design. Valcoustics Canada Ltd. (VCL) previously prepared a railway vibration analysis report for the proposed development located at 101 Masonry Court in the City of Burlington. This report has been prepared to address revisions to the site plan. 1.2 SITE The site is bounded by: 1. the Canadian National Railways (CN) Oakville Subdivision, with the Aldershot GO train station and Highway 403 beyond, to the north (the CN Aldershot rail yard extends to the east of the GO station); 2. future residential development, with Waterdown Road and existing industrial development beyond, to the west; 3. Masonry Court, with existing industrial and existing residential developments beyond, to the south; and 4. vacant land, with an existing parking lot beyond, to the east. Figure 1 shows the Key Plan. 4 VALCOUSTICS CANADA LTD. 101 Masonry Court /Burlington Vibration Update File: Page CN OAKVILLE SUBDIVISION The CN Oakville Subdivision is classified as a Principal Main Line. At this point, trackage adjacent to the site consists of three main line tracks with continuous welded rail in the vicinity of this site. Operations include commuter (GO) trains, passenger (VIA) trains as well as freight and way freight. 2.0 VIBRATION GUIDELINES At the present time there are no vibration guidelines in the land use approvals process in Ontario. In fact there are no universally agreed on vibration guidelines in general. 2.1 CN AND GO TRANSIT GUIDELINES The guidelines for railway induced ground-borne vibration advocated by CN and GO Transit at residential sites are contained in the CN and GO Transit documents, each entitled "Principal Main Line Requirements", dated June 2008 (CN) and August 2006 (GO Transit). The maximum overall proposed limit, in terms of vibration velocity is 0.14 mm/sec RMS. Appendix A provides the standard requirements for Principal Main Lines as contained in the above CN and GO Transit documents. 3.0 METHOD 3.1 MEASUREMENT LOCATIONS Vibration measurements were done at a location, corresponding to the closest proposed building facade to the rail line, labelled as Location A as shown in Figure 2. Note, due to access to the subject site, the vibration measurements were taken at a location approximately 150 m east of the subject at an equivalent setback distance from the railway ROW to the closest residential dwelling building. Thus, vibration magnitudes due to the railway train passbys at closest residential dwelling units to the railway are expected to be same as those at the measurement location. 3.2 TRANSDUCER PLACEMENT An accelerometer was used at Location A to measure the ground-borne vibration generated by the train pass-bys. The accelerometers were securely mounted, with a stud, onto the top surface of a heavy metal plate and placed on the paved surface at grade. 3.3 DATA ACQUISITION A total of eight railway movements were monitored on April 28, The railway movements consisted of GO commuter trains. The vertical axis signal from the accelerometer was recorded digitally, using an LMS Pimento vibration data acquisition and analysis system, and integrated from the measured acceleration to obtain the vibration velocity, in mm/sec. 30 Wertheim Court, Unit 25, Richmond Hill, Ontario L4B 1B9 Tel: / solutions@valcoustics.com

5 VALCOUSTICS CANADA LTD. 101 Masonry Court /Burlington Vibration Update File: Page 3 The accelerometers were calibrated prior to the measurements using an NMF VC20 accelerometer calibrator. 3.4 DATA ANALYSIS Time histories of the overall integrated vibration velocity produced by the train pass-bys were plotted using an RMS averaging time of one second. The analysis procedure conforms to the guidelines recommended by CN/GO. 4.0 RESULTS All train pass-bys produced maximum overall ground-borne vibration velocity magnitudes well below the CN/GO Transit guideline. Appendix B shows the measured vibration velocity time histories due to the railway train pass-bys. The train pass-bys produced overall vibration velocities ranging from to 0.12 mm/sec. The overall levels reported on the vibration velocity time histories in Appendix B are the maximum (one second RMS averaging) that occurred for the duration of each individual pass-by. The ground-borne vibration velocity magnitudes due to the railway trains were all within CN/GO Transit guidelines. Thus, vibration mitigation measures are not needed for this development. 5.0 CONCLUSIONS The ground-borne vibration velocity magnitudes due to railway trains, measured at the closest building facade from the railway right-of-way, did not exceed the CN/GO guidelines. Therefore, vibration mitigation measures are not needed for this development. 9 Canadian National Railway Properties 1 Administration Road Concord, Ontario L4K 1B9 PRINCIPAL MAIN LINE REQUIREMENTS A. Safety setback of habitable buildings from the railway rights-of-way to be a minimum of 30 metres in conjunction with a safety berm. The safety berm shall be adjoining and parallel to the railway rights-of-way with returns at the ends, 2.5 metres above grade at the property line, with side slopes not steeper than 2.5 to 1. B. The Owner shall engage a consultant to undertake an analysis of noise. At a minimum, a noise attenuation barrier shall be adjoining and parallel to the railway rights-of-way, having returns at the ends, and a minimum total height of 5.5 metres above top-of-rail. Acoustic fence to be constructed without openings and of a durable material weighing not less than 20 kg. per square metre of surface area. Subject to the review of the noise report, the Railway may consider other measures recommended by an approved Noise Consultant. C. Ground-borne vibration transmission to be evaluated in a report through site testing to determine if dwellings within 75 metres of the railway rights-of-way will be impacted by vibration conditions in excess of 0.14 mm/sec RMS between 4 Hz and 200 Hz. The monitoring system should be capable of measuring frequencies between 4 Hz and 200 Hz, ±3 db with an RMS averaging time constant of 1 second. If in excess, isolation measures will be required to ensure living areas do not exceed 0.14 mm/sec RMS on and above the first floor of the dwelling. D. The Owner shall install and maintain a chain link fence of minimum 1.83 metre height along the mutual property line. E. The following clause should be inserted in all development agreements, offers to purchase, and agreements of Purchase and Sale or Lease of each dwelling unit within 300m of the railway right-of-way: Warning: Canadian National Railway Company or its assigns or successors in interest has or have a rights-of-way within 300 metres from the land the subject hereof. There may be alterations to or expansions of the railway facilities on such rights-of-way in the future including the possibility that the railway or its assigns or successors as aforesaid may expand its operations, which expansion may affect the living environment of the residents in the vicinity, notwithstanding the inclusion of any noise and vibration attenuating measures in the design of the development and individual dwelling(s). CNR will not be responsible for any complaints or claims arising from use of such facilities and/or operations on, over or under the aforesaid rights-of-way. F. Any proposed alterations to the existing drainage pattern affecting railway property must receive prior concurrence from the Railway and be substantiated by a drainage report to the satisfaction of the Railway. G. The Owner shall through restrictive covenants to be registered on title and all agreements of purchase and sale or lease provide notice to the public that the safety berm, fencing and vibration isolation measures implemented are not to be tampered with or altered and further that the Owner shall have sole responsibility for and shall maintain these measures to the satisfaction of CN. H. The Owner shall enter into an Agreement with CN stipulating how CN's concerns will be resolved and will pay CN's reasonable costs in preparing and negotiating the agreement. I. The Owner shall be required to grant CN an environmental easement for operational noise and vibration emissions, registered against the subject property in favour of CN. June 2008

There may be alterations to or expansions of the rail facilities on such right-of-way in the future including the possibility that GO Transit or any railway entering into an agreement with GO Transit to use the right-ofway or their assigns or successors as aforesaid may expand their operations, which expansion may affect the living environment of the residents in the vicinity, notwithstanding the inclusion of any noise and vibration attenuating measures in the design of the development and individual dwelling(s). GO Transit will not be responsible for any complaints or claims arising from use of such facilities and/or operations on, over or under the aforesaid right-of-way. F. Any proposed alterations to the existing drainage pattern affecting the railway right-of-way must receive prior concurrence from GO Transit and be substantiated by a drainage report to the satisfaction of GO Transit. G.
